Until I retired, I worked as a mechanic for a car and van hire company. As a sideline, occasionally they would buy a few cheap cars from the local BCA auction, usually PXs from main dealers, and sell them on. All of them came through my workshop for a thorough check over, and everything that needed to be done was done (even to the extent of stripping a gearbox to replace a dodgy synchro ring in one case), so I passed them on with a clean conscience. We never had a customer bring one back. In fact, we had quite a few repeat buyers over the years. On only 2 occasions, we caught out by a car which would cost more to fix than we could get back. In those cases, we put it back in the auction and swallowed the loss, but overall, the rest were good cars when we sold them. In the end, the prices they were fetching at auction meant there wasn't enough profit left in it, so it wasn't worth doing any more.

Just abit disappointing that a larger portion of your vids are just advertising especially for Chinese crap (sorry but as someone who works in a garage these cheap code readers make my eyes roll everytime...) I have to skip huge portions of your vid because they're so boring, I'm a long term subscriber and viewer of your vids for years but I feel really bored and disappointed by your vids to the point where I can't be bothered to watch them and sit through 5+ mins of advertising

I'm currently pursuing a 'dealer' via Small Claims who agreed to let me get my car repaired at my local garage. Long story but I stupidly bought a car 200 miles away from home. The fault appeared as I had almost reached home. All of this is documented, he agreed the repair, which was about £600- money I dont really have. Rather than pay me back the cost of the repair invoice, he has been attempting to wind up his business. It now appears under a different name in Auto Trader- same stock, same contact details, different company name. You seem to be one of the good guys. Sadly, there are a lot of rogues, sellers and buyers.

there was a program on the bbc about an engine replacement company (ltd) who would set up do 6 months work then "close the business" by changing the name on companies house and repeating the process. apparently it's all legal and nothing can be done about it :(

@@recs5351 Yeah, I remember seeing that. Terrible. Apparently there are some things I can do though, but unfortunately they'll cost me. From what I can see, the business I bought from hasn't actually been wound up, just a change of name. We'll see I suppose.

As a dealer with today's prices were asked to pay strong money and totally take it on the chin when it's a rodent, zero comeback, it's yours, then when you sell your necks in a noose for mths, I do loads to my cars, but then the customer doesn't want to know, it's just price driven, they're their own worst enemy as they won't leave you enough in them to do everything, but it's the same with most things I guess.

Hey Chops...could you please share this cautionary story on your channel to warn others. Thank you. R.E. Active scammers pouring oil in coolant tanks whilst viewing. I am currently selling a 2011 Merc C250 estate. A couple days ago we decided to put an ad on Gumtree and within 10 minutes I had messages from a guy really interested in viewing the Merc and would arrive in an hour or so. As he said, he arrived about an hour later with another guy with him. These 2 were in their late 30's and obviously from an Eastern European country (not sure which). They both proclaimed to be mechanics. Oddly, they parked their car round the corner slightly out of sight. Myself and my Dad went out to do the viewing. Instantly, they asked for a print out of the internet version of the MOT history (i.e. separating myself and my Dad). During the walk round, they opened the doors, boot, and bonnet and were walking round inspecting and asking my Dad questions. Whilst they were at the boot, one of them started checking the spare wheel well (lifting the boot lining up obstructing any view forward in the car); the other one quietly walked round to the front of the car and after a couple of seconds closed the bonnet and continued round the car...seemingly nothing out the ordinary. They instantly asked to go for a test drive in which they drove 'like they stole it'; weaving harshly, saying it needs a couple things changing. NOW...this is where things got odd. The one driving, which was the one who went to the front of the car whilst his mate distracted my Dad; immediately popped the bonnet and looked down the side of the engine and said "look! oil!", he then instantly open the coolant expansion and stuck his finger in and pulled out an inch of pitch black oil and said "Look! Oil! The head gasket has gone!". Obviously shocked and flustered, they almost without breathing said "the engine is broke. we will have to tow on recovery. i will swap engine with my one i have. I give you £1,000.00 (we were selling, for an already cheap, £3,750.00). They pressured my Dad and me to make an decision there and then, saying "we will not come back, we are here with cash, we pay and recovery, we not come back" over and over; not giving my Dad time to think. I kept on saying "we will have to consider out options" but they kept on pushing. They eventually said "okay, £1500" to which i said "give me and my Dad a minute to think it over". Now that we had time to think I said to my Dad "I think this is a scam"...and as he got less and less flustered things started to become clear. The sending away of me (a second person to the viewing process), the dividing and distracting tactic, the driving the car like a madman, going straight to the "oil leak" and checking the coolant tank, then pushing for a massive discount because "its broken", not letting my Dad have time to think. These scamming A-holes had poured an inch worth of used, black, smelly engine oil into the coolant tank of our Merc! One of them even took the engine oil cap off and tried to say "look, milky" (there was nothing). Before we went back my Dad said..."of course the engine hasn't gone...you wouldn't get thick black oil in the coolant tank". We went back and said "no thanks, we'll just part it out"...but they would not take our answer. They kept pushing and pushing and pushing. Until we just went and made them shake our hands and said "thank you for your time, sorry about this"; making them think we were none-the-wiser. They even had the cheek to call a couple days after asking if they could send the recovery truck round with the money!!! They came in a 55 plate Mercedes E-class saloon in that biege/silver colour. TLDR: In summary...through a Gumtree add 2 Eastern European men came to view our 2011 Merc C250 estate, proceeded to secretly pour old engine oil into the coolant expansion tank, then test drive our car like they were rallying, and tried to convince us that our engine had blown and should sell it to them for 25% of what we were asking. DO NOT allow people viewing your vehicle to separate and distract you. Keep them together and in sight at all times...and certainly don't leave the bonnet open when you're not actively looking at the engine. We're still slightly in shock at the sheer cheek of them!! We shudder to think of how many older people they have scammed. Please beware of scammers!! If something doesn't seem right; insist on taking a few minutes to gather yourself and think...if something seems off - it is!!! Sorry for the length!

Leaving aside the scamming aspect of the story...did you ascertain whether they were insured to drive your car, especially as they rallied it. Best to let them sit on passenger seat during test drive

Hi James good to hear that Judges are applying common sense in these cases. My sales invoices now quote 30p per mile usage if the vehicles are returned , lesson learned thanks for the good advice.

How is it the same 30p per mile whether it is a 5k car or a 15k car? Surely it should be done as a percentage of the sale price

Good video, bit short tho bud, I had a cc case in the early 90s,a cortina was wearing tyres, turned out to be a bent subframe, subframe 15 quid, labour 30,they'd had the car for a while, maybe they'd hit something, anyway I lost and paid like 70 quid, those were the days, no ecus, turbos, massive bills, next one was a clutch that went in a rover sdi, put a recon clutch in, he was towing, that went, anyway his specialist said we'd misaligned the gear box, which is impossible, either it goes on or not, anyway lost that, cost me 180 quid.

I bought an Alfa 159 ti sportwagon about 5 years ago and drove it back home - roughly 120 miles. Just for peace of mine, I got my local and very trusted garage to look it over - that cost me nearly £1100 to fix. Brake discs and pads all round, tyres and battery as well as replacing two missing wheel bolts. I will admit that my heart overruled my head with this purchase, and I needed to replace things like a front upper wishbone as well as snapped rear springs (a common fault) later on. Never bothered to contact the trader, as I figured that he probably knew about all of this prior to selling. I will say that I wasn't that bothered, as the Alfa was a hoot to drive and got a lot of positive comments wherever I went. Recently moved it on and replaced it with a little Honda CR-Z with full service history and less than 60k on the clock - it's in very good nick and came with 6 months warranty. The only thing I've had to do is re-gas the air con for £60 - other than that, it's been a cracking little car. My point is that an ethical dealer makes all the difference when buying a car.

I had a 156 Sportwago for about 8 years and loved it, but they do just wear stuff out. Brakes, flywheel, turbo inlet pipe, lots of bits that just wore out over time. No way the dealer didn't know about that.

My Cazoo return moves slowly forwards. After having a £2,000 DPF fault diagnosed at my expense and rejecting the car I finally have a date for them to pick it up. I've had it now for over a month. It failed after the first nine days and 461 miles. The email says there's a £1 per mile charge for every mile over 250. I really hope this relates the the 7 day test drive thing because if they charge me £211 for the tiny use I've had of the car I'm going to be even more livid than I already am.

@@-DC- I've had two from them. First one had a problem and they told me to take it to Kwik-Fit and give them an account number which was no bother. This time around they never even responded. It seems in all their cost cutting they've destroyed their ability to do customer service.

Basically the customer who put 12000 miles on the car in 7 months was trying it on and wanted free driving for that period which is ridiculous and he is imho of dishonest character. The customer wanting his £2000 back signed a contract. A contract is between two parties. Not until on side decides they don’t like it.Again another chancer.

Ding dong a judge who uses common sense thank god for that it’s restored my faith in the justice system, I would never have taken that car back after 7 months & 12,000 miles from being too embarrassed to do so of course the turbo could have let go at anytime if they were lucky it would have been within weeks of them purchasing it but it wasn’t and obviously the more miles you put on the car the greater the risk of the turbo was on its way out , also 12,000 miles in 7 months ain’t exactly average miles that means over 12 months at that rate they are doing over 20,000 a year maybe they need to buy new or nearly new with a good proportion of the manufacturer’s warranty left on it to cover them a bit more anyway just a random observation

If i was spending decent money on a car, I would want it to last a year (even if used). I had to send a vehicle back for a full refund after 25 days to a main Renault dealer as they didnt tell me about the vehicle's history nor the steering issue that was present when sold. Drove it 100 miles back only for them to refuse to fix anything. After getting an independent MoT and then complaining to Renault Head Office the dealer accepted our rejection for a full refund. Still cost me the price of a steering check at my local garage, an MoT and four 200 mile round trips in fuel!

Hi James. On both cases I agree with the Judge 😁😁😁 If you want to be sure you charge the correct amount for use, just use the price per mile the tax man allows for deduction of business use for a private car (which actually includes fuel). It would also be fair to charge for cosmetic damage in the same way lease companies do.

Exactly….an old motor can go wrong, it ain’t new and ain’t under manufactures warranty, this is why they not £20k anymore… different if say the next MOT finds a chassis leg tied in a Knott that had to be there from purchase but stuff developing faults etc it’s going to occur…

Hi James, change coil pack and plugs, when the coil pack on them start braking up it also flags up ramdam ECU codes. The ECU is normally fine

Customer who signed contract should have been fined by judge for wasting court time. "Normal" miles fee is 45 pence, I think this should be set in law. Turbo failure, if it was a PSA engine, so HDi, TDCi they absolutely demand servicing on time with the correct oil. So a comprehensive service history is an absolute must, or you adjust the price you pay down and take the chance. You can mitigate it by replacing the turbo oil feed line and sump strainer on purchase but that adds cost. Failure on these occurs because dirty oil blocks the tiny oil strainer in the turbo high pressure feed at the block.

Lol. Granted turbos do fail. On older cars. I’ve had two fail. But every time one has gone I’ve had loads of warning. I’ve never had one instantly fail

re the pence per mile - just as a benchmark, my employer pays me 40p per mile for the first 10,000 miles if I use my car to go somewhere for business. Of course that includes a contribution towards having insurance for business use, fuel, RFL and wear and tear - so not a direct comparison. Think 50p was a bit high - your 30p sounds about right👍

I bought a car about 10 years ago for £9k. On the way home I found multiple issues. I took it straight back ... the dealer said it was "bought as seen" but he would take it back on two options ... 1) he would re-advertise it on my behalf on a commission basis or 2) he would refund me two thirds of the money. Either way I would only get £6k back ☹ Dearest 1 day hire I ever bought.

Story 1 is odd: the customer got a report which did not support their case since it stated 'wear and tear' but submitted it anyway...

Both issues were handled as I'd expect from the legal system - both thrown out because the customer was a "chancing beggar". The turbo issue - when you pay for an independent report, it should be unbiased, if it isn't there is a problem and either side could argue foul - hence you don't get the report you pay for (much like house surveys). The second issue was purely contractual, when you sign - make sure you know what you are signing, if you disagree, don't sign; there is rarely recourse unless the contract was outright illegal!

Alternatively I have I have been involved in several Small Claims actions against a builder,architect and a solicitor and won them all. I learnt to to just give refunds whatever with cars !

Sad, car dealers like you James are normal people just doing a Job, a car dealer should get compensation for going to court loss of time earnings etc. Most of the public are ok but you do get idiots . They should be fined for wasting everyones time & stress involved. I had a landrover defender in 2012 bought brand new with in 6 months and 6000 miles it was wearing tyres out drivers side front and back outside edge passenger side inside edge took it back to land rover telling them not happy got fobbed off they said i was going around to many roundabouts they eventually bought it back less £2500 . If they had put a new set of tyres on it that would have done me. 5 years later I bought another one 2nd hand which i ran of 3 years and bought another after that but must admit now going Jap. Much more reliable

Why not have in the original goods of sale contract the deductible amount per mile if the car is returned after a period of time, then there is non of the nonsense with disputing the amount.

I purchased a Ford bmax last year 2014 for £7000 I currently done 12k miles over 4 months it went in for a turbo they for some reason replaced it 4 times because they wasn't happy they replaced all injectors loads of sensors had the dpf cleaned its now been 14 months the garage still have my vehicle I wanted a refund because I did 12k miles they only offer me £1000 back the car still has a fault/ turbocharged turbo/ dpf issues Black smoke / limp mode it been to Ford and they still can't find this issue where do I stand very annoying 😢

Good point, the Skoda Octavia fuse box is prone to that. It's layered inside and water gets between the layers shorting various circuits.

I used a jet wash in the engine bay of my transit connect van. But it was a company vehicle so it wouldn't have been my problem, but it was absolutely fine and came up like new. The person before me drove through a ford and the engine bay was full of dried muddy water it was terrible.

I got caught 3x by our area manager jet washing Toyota engine bays when working for Toyota back in 1990, never had any issues in the 5yrs there! There was a warning sticker under the bonnet if i remember saying not to jet wash the engine 😂 I was told what to do!!

I think the information that was missing is critical for a decision that is what was the mileage when the customer purchased the car if it was 100 miles the decision would be different if the mileage was 150,000. ie. more miles more normal wear and tear. 12000 miles to me is ridiculous to expect full price. Interesting that your price per mile is £0.30 per mile, if you look at new car PPC the over mileage cost is much lower, 50p sounds like a rip off.

Going by HMRC £0.30 is a fair offer considering that your offer does not have to include fuel costs. The HMRC mileage rate for 2021/2022 year 45p per mile for cars and vans for the first 10,000 business miles travelled (25 pence over 10,000 miles) 24p per mile for motorcycles. 20p per mile for cycles

The public, I am a retired Chartered Accountant. A client had a Tax enquiry, perfect resilt, no tax to pay , never looked at any personal items. Billed hm £350 ( about 15 years ago). He said that since I was a qualified accountant he was not subject to tax enquiries !! I told him the Institute had a grievance procedure but didn't tell him he had to pay a deposit of £500. He paid me

30p or 50p a mile isn't a fair way to do it though. On a car costing 10s of £1000s that's nothing but £2K for a £4K car after less than 6mths??!! If I paid £10K for a 10yr old car in supposedly very good condition and the gearbox fell apart after 3 months of normal use I'd expect the garage to take it on the chin and fix it for free or give me a full refund. Otherwise why pay the extra in the first place when buying privately is so much cheaper?

Agree with both, but 50p a mile is steep, unless it's on a car that was £40k+ new and still worth £20k+. 50p would put me off buying from a dealer. 30p to 35p is acceptable.

12000 miles ideally that's two services later. If your paying £4-5+k for a used car, £100 for an oil and filter ever 5-6k miles is cheap preventive maintenance

I hate the game, I walked from a mint focus st2 mk3 as the hpi come back 20k shaved off.. reistered by the VMC.. another trader bought it and slapped it on ebay for 2k more. Hpi clear lol Seems there bent both sides. Had an e93 with 313m, all refurbed.. owner come back after hitting a pot hole.. shattered wheel.

Agree mostly but 12k use and then a knackered engine seems a bit harsh for customer to bear all cost , perhaps a goodwill reduce repair bill would have been sensible or buy back / credit just my 2 cents

I do 700miles a week, so 12k in 7 months is nothing (cars I get don't cost me more then £900 usually last me 3-5 years) betting the turbo was making noises before it self destructed I wouldn't be to happy if it only lasted 7 months for such low milage, thought but my use is quite high (usually everything els that isn't the engine fails and needs replacing)

Customer came wanting the cheapest diesel runabout to do takeaway deliverys , £795 210000 mls toyota avensis , drives it 15k miles in 5 months and wants to return it as it uses 1 litre of oil per 1000 miles . 😂😂😂

Yes. More Legal stories, please. In the second case, I fully agree with the judge, as they effectively entered into a new Contract and the Consumer should have objected at that point in time. It is pretty well established that the Courts are very unwilling to open up a Contract to assess the relative benefits of the parties as it is a negotiated arrangement and the Court cannot possibly be expected to know all the circumstances at the time of that negotiation and the relative values imputed. Having said that, I also feel that the Garage was on the margin with its 50p per mile adjustment ... and I wonder how much higher that figure could have gone before the Court might have been tempted to seek to establish that it wasn't a fair arms length negotiation ... Using Inland Revenue allowable mileage rates is often a good basis for establishing a devaluation rate for this purpose. In the first case ... the demand for 100% is probably what sunk that claim, as clearly the Consumer had obtained considerable value out of the vehicle already, so it was clearly not reasonable. I am unsure whether the 100% claim was required due to legal constraints, but clearly an attempt to reach a fair settlement first would have put the Consumer's case in a far better light. Keep up the good work !

I think with the last case should be a deduction for use . But amounts per mile should be done on age and mileage of car. To lose 2k for useage on a newer low millege car would be fair. But if it was a older car with 80k on the clock that cost 4-5k to deduct that much would be unreasonable. Deductions should be done more on how much the dealer feels 6 months and 4k extra miles would effect the price they would get for it once the car had been fixed. 18 month old car with 10k on clock that cost 20k.may only be able to sell now for 18k then 2k should be the deduction. 10 year old car with 80k on the clock that cost 5k. Could probably be resold for somewhere between 4-4.5k. So smaller reduction. Car has already done most of its depreciation by this point

Helpful advice - Do NOT leave a Bluetooth OBD2 reader plugged in permanently. I left my Carly adapter plugged into my BMW 5 series for 3-4 days, I was lucky the car started and it even warned me of the low battery on the dashboard screen. Luckily a long trip on the motorway and I topped my battery back up but I did get lucky.

Judge made what seems to be a fair call on both cases. In the second case, if the customer had been unhappy with the deal, they should have made it clear, and if pressured to agree noted it was under protest. It’s not necessarily reasonable to charge a fixed per mile usage reduction where the dealer is at fault. This could lead to a situation where the dealer is at fault, but effectively makes profit out of the limited usage of the customer, and the increase in mileage may not actually impact on the basic value of the car. Say the vehicle is £5k, is £2k a reasonable deduction for the impact on the value of the car for an increased mileage of 4,000 miles? To illustrate, at that rate of depreciation, a brand new car such as an £18,600 Skoda Fabia, doing 10k a year would be worth -£1,400 after 4 years. The usage charge should be fair and reasonable, assessed on a case by case basis.

I think the judgement is that it was probably faulty at the point of sale, but only in terms of wear and tear which the purchaser of a second hand car ought to reasonably expect. If you buy a used car you shouldn't expect it to perform like a new one! Sometimes the justice system works, me thinks.

A few years back we bought a used car for about £4k, a mile down the road the engine light came on, garage instantly went to the "You didn't buy a warranty" nonsense. Turns out the timing chain had stretched, common fault on the model, the other owner did sort us out, but it was back again 6 months later with the same issue. We did get our money back in the end, but I did feel sorry for the garage. That's the problem with used cars, people do sell sheds to the trade, the clutch is on its way out, was blowing a bit of smoke that went away after a service etc. The trader won't know anything about it until it rears its head, and everyone loses out except the initial seller.

I can't believe someone would do that, you wouldn't go into a restaurant, eat a meal, enjoy it then come back 7 months later and ask for a full refund. The case with the blown turbo they should've had the car serviced after they bought it before the 6 months was up as that would've highlighted a failing turbo before it wrote the engine off, more so if they were putting that kind of mileage on it, they put a year's worth of mileage on in 7 months. If you're not car savvy take it to a trusted garage and ask them to give it the once over.

Surely the customer must have noticed that the turbo was whining under acceleration and smoke from the exhaust before the turbo bearings failed? There definitely would have been a noticeable change in how the car drives before the turbo failed at least a few days beforehand and they could have avoided the hassle by getting the turbo replaced instead of driving it harder until it failed.

Just had the turbo fail on our Mazda cx5. Car had been totally fine up until a week before the failure. The car is my wife’s and I was in the car that day and noticed a very faint whooshing sound under 2k rpm. She couldn’t hear anything at all. No offence to the woman drivers, but they maybe don’t pick up on things like a man would. Low and behold a week later the turbo fully failed, no real warning just went. Heavily smoking and no boost. So it can fail fairly quickly if left

Check see if it has a fuel filter next to the cam, under the timing cover. Can cause miss fire, should be changed @ 40000miles.

Trouble with the price argument is that it could still be a 12 year old car so the wear and age related issue as the same as 12 year old 4k car.

When I was sixteen I worked for a body repair shop that bought and sold the odd car and van. Only cheap stuff nothing fancy the owner was the type of person that did not take any messing about from customers who tried it on he used to say to them what are you another rodney that wants a caviar car for fish and chip money. Sometimes he would tell them to go away he would not sell them anything. The thing is like he used to say you only get what you pay for. Based on the fact his cars were cheap to start with this is true you pays your money and takes your pick it's the same for all of us.😁❤

I wonder how much of the car with turbo failure was caused by the owner themselves not allowing the turbo to cool before switching off, I see a lot of people dont do it and a lot that do not even know about it, only needs about 30-40 seconds at idle to do it.

If there are faults on a vehicle, take it to the seller to rectify. Your time and costs won't be paid by the seller for your running around to source and fit the parts.

the first one is daft that it even made it to court. surely a turbo failing from wear and tear is just common knowledge. if the seals or something were gone on it, i doubt the car would have lasted 12k miles from point of sale. the customer should have just accepted that the turbo was old and had potential to fail, as does every part on any car. and as for the second one. you can't rent a car for free, so why should someone be able to essentially hire a car and then return it for no cost what so ever. if they signed the contract too, then that's the deal done, it down in writing. if you dont like it you shouldnt have signed it at the start

That chick bought a Audi Q7 for 7,000 quid in the name of her old mother, then wanted a full refund as soon as it got expensive. The case was dismissed because it was not her car but she had the chance to join her 90 year old moms lawsuit which did not took place. 🤭

How on earth could the customer of the car that had 12,000 miles in 7 months think they are entitled to a penny let alone a full refund . Any car even brand new could get a problem it was doing over 400 miles a week. Absolutely idiotic.or just bloody chancers. Regarding the dealer charging £2000 for use of the car well that's fine if it's a £50 grand car but 50p a mile on a car say at £5000 he's been extremely greedy 50p seems too much. James if you charged 30p that to me is fair but anymore than 35p unless it's an expensive car is too much. Regarding the fiat 500 the twinair is renound for misfire usually coilpack.

haha wish I saw this yesterday.. I grabbed the topdon 600s .... way more than id ever need but couldnt say no at the price drop.. and am sure itl pay itself off qucik enough in diagnostics myself... and I wanted to be sure I could do things like dpf regen and put breaks into service mode.. ect did think of an app system but i duno if i can be bothered with the faff, rarther have a unit and have no doubt of plug and play. and their store pages were filled with more gibberish

I mostly agree with both cases but the pence per mile i would say is excessive, most pcp deals have excess mileage between 4 and 20 pence, business mileage is paid at 45p a mile including fuel which would take most of that cost up. Depends on the car and mileage too though. 1/5 the value of a 90k mile car is probably too much but something triple the value with a fraction of the miles may not be.

I think the higher pence per mile is to discourage those that think its a cheap hire car for a week or two. Remember within 30 days they need no reason really to action a return
