The attitude of those blue gang members is dispicable. Officer Nemtsov seems to don't care about your rights. This is the same as Police asking one member of the the public with dark skin color to leave because a person with white skin color doesn't like dark skin color or the other way around. It's not solving a breach of peace it's taking sides with someone who infringes on someone else's right to be treated equally in public according to the law. This will be a federal lawsuit.

He also seems foreign? But even the american cops do not understand that a sign/policy is not law? And do not understand that a building/gov agency CANNOT make law. Only Congress/Reps can, and even they cannot make a law that violates 1A. All the cops who spoke to deny, need to be arrested. The cop in the hat was just doing body guard duty, and didnt issue threats of arrest (wasnt up to him anyways). So hed just be a witness against them.

The bottom line is you must commit a crime to be trespassed from public property. It’s interesting how when you asked that Sargent if the complaint will go directly to iA, he hesitated, stuttered, then said it will go through the “channels”.🤦🏽 Does that mean it will get passed around to all the officers that are subject of the complaint?

So let me understand the Sargent… if a public servant wants to put up a sign in a public building restricting our rights they now have the RIGHT to infringe on someone’s constitutional rights … so who has rights ? The government or the people and who’s rights trump the another?
@kenalpha3Ай бұрын
More important is the building/gov agency cannot make law. Only Congress/Reps can, and even they cannot make law that violates 1A. So more auditors should repeat that point when the dummies say "but there's a sign." TT said this, but I think saying it more would help.

I don't normally comment on videos like this, but I wanted to say that your calm manner is refreshing to see. A lot of auditors go out of their way to be provocative, belligerent, to shame others, or even just to show off how smart they are, (and I'm not necessarily saying that's not justified) but it often escalates things more dramatically. From how you conduct yourself, it seems like your purpose is genuinely to educate others and to affect change in the places you're visiting; rather than looking to farm clicks by being so abrasive that you bait those people into the whole misbehaviour, assault, arrest, civil suit, settlement pipeline. It's the difference between making a living from exploiting the failings of others, and making a living (hopefully) trying to get others to be better. Anyway, it's nice to see.
@debrajol3585Ай бұрын
What are they thinking?? There’s no expectations of privacy in public. Asking him WHY HE NEEDS A FOIA & ID to make a complaint, it’s his business . They’ve been confused about public vs private & not a single one will correct this. The 3 stripe who stepped in to take the complaint is even misguided. Elgin needs a reality check!!! ~~That man who has issues with them keeping his ID & belongings was fortunate James was there recording bc that would’ve been a take down! They surrounded him when they know they’re in the wrong. He can’t work meaning he can’t eat or feed his family but they don’t care.. and then they wonder why people get upset. That leads to people doing something they don’t want to do to feed their family. How hard is it to copy his ID & return it!?!! This whole department needs training!!! Hey T T, I posted this on LackLuster and Logn Island Audit as well, I love what you all do and I LOVE how you deal with the cops, however, I’m going to post this here because no one will respond to me. I see SO many people talking about easements, easement DO NOT grant access. People NEED to understand the difference between an easement and public right-of-way. A public right-of-way is legal ground for people to be on, 30’, 40’, 50’ 60’ 100’ to 200’ depending on the roads, much like public space or property. An easement DOES NOT give the public the right of access. There are easements that grant public access, however, most of the EASEMENTS are easements that do not grant public access, these easements are for utility companies and drainage purposes only. A person CAN NOT walk between to houses because there is a PUBLIC UTILITY EASEMENT. This is Very important because and “EASEMENT” could get you sent to jail. Please quit using the word EASEMENT and use PUBLIC RIGHT-OF-WAY. I do this for a living and create these type of documents.

Do you see what the police did something very slimy? They changed what the original complaint was about the original complaint was about James recording in a public building in public accessible areas. But when James explain to them that he had a right to film in public accessible areas and when the young lady officer read the sign there was no statute connected to cell phone recording that was there policy and policy is not law. So what they did after knowing filming in public was lawful they change the charge to trespassing because that sign had a statute for trespassing but you have to have committed a crime to be hit with trespassing in public but James never did anything illegal to get a trespassing warning. You can't just kick someone out of a public building without that person breaking a law and do it under trespassing just because you don't like what a person may be doing, it has to be something unlawful. This is equivalent to them kicking a person out of a public building just because they don't like the color of clothes they are wearing and try to do that under trespassing.

And courts have ruled that federal and state facilities have the right to reasonably restrict non-traditional public access as defined by the Supreme Court (sidewalk, park, etc). They have also ruled that government entities do have the right to reasonably restrict public areas if the activities being performed have no longer have anything to do with the previously stated intent. Personally, I'd just wait till they start recording an area that has kids and then start telling everyone around them that they are a pedophile who just trying to record kiddies publicly. Let the mob take care of them after that.

Totally. Any one can put up a sign. Right. No blacks no mixed races no children. No clothes no whatever. And people r so stupid to obey these signs. I went to see a surgeon to do cataract surgery. Well my daughter was with me and this doctor always was saying “I don’t know how you see your lens r bad”. Ok. Fine let’s move on lady, well I guess my daughter was wearing some scent and she says to me you r to tell anyone with you not to wear scents didn’t you read the sign out side the office door, I looked her into her eyes and said everytime I have been here you say omg omg your lens r so bad how the hell do you expect me to then read the stupid signs all over this place eh ? Sorry I don’t read signs at all. Because there r so many all over the place every where you go there is some sign saying something and I don’t plan to do it anyways it’s a waste of my time. My daughter when we got out of the office was laughing so hard and hugging me saying good one mom, she deserved it . I couldn’t help it. To be mean to my girl and then blame me for not reading signs well I hope she knows where to stick the next sign. I have had my surgery and still don’t bother to read signs as I don’t give a crap 💩

You really ARE a true professional. Calm under pressure, de-escalating those who are supposed to be the ones confirming and upholding our rights, and subsequently informing them of that which they've already sworn an oath to uphold. It might seem like thankless work, but it's so necessary and SO APPRECIATED! I could never do what you do with the grace, courage and professionalism you consistently display. Kudos and respect, always James.

Amazing, the female cop who doesn't know the law and is enforcing what the security guard wants. She thinks that by passing the buck to the security guard, she and her officers are off the hook. Im watching this thinking I should be used to cops being clueless about the law at this point. But every single time, I'm simply amazed. We have cops on our streets who literally don't know or understand the law. It's surreal.

Former security guard here. I have worked at major sites such as international airports and international convention centers... you CANNOT body block or make physical contact with anyone at any time (in my TTA voice). These guards care too much smh. I didn't give a damn, as long as no one was in danger. But in their defense, some of these site managers set them up for dummy missions. Mines got mad because I let the FBI up to a secure floor of the county executives, who was under federal investigation. So she thought I was supposed to put my freedom on the line to obstruct justice. I told that bird to pound sand 😂. I had one ask me what I would do if someone came in with a vest that goes boom... I said mf run 😂😂😂.
