Child Status Protection Act (CSPA) can sometimes be a confusing and complex law. What may seem to make sense (such as rushing the approval of a petition) can actually be harmful to a case. Daughter of USC was 20 when case was accepted at USCIS last 2019, her IR2 was accepted, expedited, accelerated during NVC phase, last month, US Embassy refused to give her interview schedule as she turned 21 this year, accdg to them she aged out and changed her category to F11. Can you help us please?

What about EB1 cases where priority date is current and the AOS and I140 is filed just before the child turns 21

Hello Sir, I filed a Concurrent application for adjustment of status application for my son who is legally in college with an F1- Visa. I'm a green card holder. As at when I filed the application, my son was 20, the bulletin was current and still is. He got his combo card, was scheduled for interview but postponed due to the virus. Now he is over 21. Based on the above, is his age frozen as at the time of application or he has aged out?

Hi sir. Appreciate all your youtube videos. I’m learning alot. Here’s our story my grandma applied for my mother family visa since 1999 when I was 6 years old. But uscis takes too long to process we received a letter back 2009 but from then we never heard anything from them. Me and my brother are 27 and 28 now . Can we still be under CSPA?

Mother filed on Aug 28, 1997 for daughter, husband and 2 children, ages 6 & 8, respectively then, a family petition for USA immigration. It was only approved by VSC on 2020 (after 22 years processing) and 2 children’s have now 28 and 30 years old. Upon interview at US Embassy Manila on Oct 18, 2022, the 2 children now ages 28 & 30, respectively were denied Visa; while their mother and father were granted Visa. Question: Is there possibility of reversing the Visa denial by filing a petition at the US Embassy in Manila? Or, any other way to get approval of Visa for the 2 children, ages 28 & 30 years old for family togetherness sake? Would appreciate any advise on this Dilema 😊of family unity. Filed GC and got Ead with I140 Approved . Child age is 16 and dates retrogressed in November 2021 so Final action dates are current for 2 months only and country of birth is India . Is the child protected ? Please clarify

You will be okay as you are in the IR2 category your age freezes at the moment your petition was filed.

Good Afternoon, My Mom petition me from Philippines to USA. I received my approved US immigrant petition accompanied with my son. Her Mom and I were not married and separated since 2013. I am the one who took care to my son since the time we're separated and nothing support came from her mother. Can I Ask a question Do I need the consent of her mother for our US petition or Not?
