I think it would be worth trying to organise for the appeal. There is something called an "amicus curiae" brief that a group can submit (who are not party to the case) to help the court come to a more informed decision particularly with regards to the wider impact. I do find it utterly ridiculous that they are asking a judge/lawyers to decide a medical issue when they have true no training or expertise. And that is before all the obvious bias at play. If I was in this case, I would be objecting on “lack of foundation” sooooo much. This is a science and medical issue and should be addressed as such. If they have a problem with the medication, they need to appeal and petition the government on those reasons. If that isn’t working that means that some form of democracy may be taking place and they shouldn’t get to f***ing abuse their funding and the legal system to force their views on others.

There is something called an "amicus curiae" brief that a group/s can submit (who are not party to the case) to help the court come to a more informed decision particularly with regards to the wider impact. It would have to be some impressive groups though with clout too.

Some women do not expect to get pregnant. In the case of “I didn’t know I was pregnant.” My mom didn’t expect me but she kept me. Many married couples cannot afford children in this economy and use protection but may still get pregnant. It isn’t fair for them to have to shoulder the burden. My friend Alyssa says they aren’t pro-life, they are pro-birth. What if you have a health condition that makes pregnancy dangerous? What if you find out the baby will be born with trisomy 13 or something that can be genetically found out before birth and will kill them within months? It’s more humane to end it before they even get the chance to suffer. We put down pets and find that humane but it’s inhumane to abort a baby that will live MISERABLY for however long they may live be it a few minutes or a few months

The fact that judges in this country regularly don’t recuse themselves when they clearly have conflicts of interest in the form of religious beliefs and face no repercussions is absolutely mind blowing. These groups and at least one SCOTUS justice have outright stated they hope to repeal all abortion, contraception, and LGBT protections. A SCOTUS justice straight up said that based on his religious beliefs and he is ruling on these cases. These people read The Handmaid’s Tale and are using it as a playbook. It is horrific. Part of me wants to get the hell out of here as soon as I can to go practice in some place like New Zealand. But part of me wants to stay and fight for my patients and this country. Of course because we want equal rights, bodily autonomy and safety but also because we are the first line for them to cross. Well, they've crossed that line, moved on to more radical seeming targets, like abortion and eventually birth control. Suddenly much of the cis population is saying, "But how did this happen?!?" We can't go back in time. But we can move forward together. Cis women need to be standing up for trans rights. Trans people need to be protesting for racial justice. Black people need to be working to empower unions. Unions need to be advocating for employment rights for people with disabilities. @@1495978707 it’s not about the mailing, but about questioning whether it was safely distributed in the first place and questioning whether it’s safe and overruling the FDA approval (meaning the FDA would have to approve it again, but at that point it would already have been established that local jurisdictions have authority over the FDA). Obviously they can appeal it to a higher court until it makes its way to the Supreme Court, but they’ve already established an anti-abortion position at this point. That's very much the point, the risks of any medical intervention have to be considered against the backdrop of the baseline risk of doing nothing. After all it is ultimately a risk benefit analysis, so by not taking into account those baseline risks you are missing a significant portion of the benefits of the proposed course of treatment. If one were to take the same stupid attitude with other conditions then operating theatres would no longer exist as surgery is inherently risky to some degree, just that risk is warranted in cases where there is a strong prospect of reducing or eliminating a greater risk from the underlying condition. Hell you would actually end up having to throw out the entirety of medicine in general if you tried considering it in isolation from the conditions that are being treated and the risks posed from doing nothing.

@@minagica To quote a study from the AAP published in July 2022: "We found that an average of 5 years after their initial social transition, 7.3% of youth had retransitioned at least once. At the end of this period, most youth identified as binary transgender youth (94%), including 1.3% who retransitioned to another identity before returning to their binary transgender identity. A total of 2.5% of youth identified as cisgender and 3.5% as nonbinary. Later cisgender identities were more common among youth whose initial social transition occurred before age 6 years; their retransitions often occurred before age 10 years." So not a high percentage. And the majority of children who retransition to a cisgender identity do so under the age of 10-a.k.a. before any hormone replacement therapy or even puberty blockers would be taken. And one often-quoted NIH study from January 2011 claiming that 84%* of trans youth retransition was deeply flawed in its methodology. To quote a Huffington Post article about the study from January 2016, the study "did not actually differentiate between children with consistent, persistent and insistent gender dysphoria, kids who socially transitioned, and kids who just acted more masculine or feminine than their birth sex and culture allowed for. In other words, it treated gender non-conformance the same as gender dysphoria. Worse, the study could not locate 45.3 percent of the children for follow up, and made the assumption that all of them were [retransitioners] … As a result, the 84 percent [restransition] figure is meaningless, since both the numerator and denominator are unknown, because you have no idea how many of the kids ended up transitioning (numerator), and no idea how many of them were actually gender dysphoric to begin with (denominator)."

@@jordannimz5180 the 2022 study: by what age? And what percentage would desist if they haven't been "affirmed" prematurely and thus pulled into a sunk cost fallacy? The 2011 one made the exact same "mistake" that "gender affirming care" does when it comes to kids, taking every gender non conforming child brought in and assuming "yep, they're trans! Let's start them off on transitioning, cha-ching!"
@jordannimz5180 Жыл бұрын
@@minagica At the beginning of the 2022 study, the children were 3-12 years old (and had all already transitioned socially-the deciding factor for inclusion was whether the children were using pronouns not associated with their gender assigned at birth; 11.7% had begun puberty blockers prior to the study starting) and recruitment for the study took place between 2013-2017, so the participants are currently anywhere between 8-21 years old. "Past work has suggested that the ages 10 to 13 years are an especially critical time for retransition." In this study, "[all] but 1 of the 8 cisgender youth had retransitioned by age 9 years (the last retransition was at age 11 years)", and "[in] the nonbinary group … 6 of 11 retransitioned between ages 10 and 13 years, with the remainder retransitioning before age 10." Re: reasons why this study may have had such a low retransition rate: "on average, participants had socially transitioned 1.6 years before joining [the] study. It is possible that some youth initially try socially transitioning and then change their minds quickly. Such youth would be unlikely to be enrolled in this study because their eligibility period would have been quite short and therefore the odds of finding the study and completing it would have been low. This means the children in our study may have been especially unlikely, compared with all children who transition, to retransition because they had already lived and presumably been fairly content with that initial transition for more than a year." Re: if there were differences between AFAB and AMAB children: "the initial sample was disproportionately made up of trans girls. This is counter to recent reports that more peri- and postpubertal transgender youth seeking clinical services recently are transmasculine. Historically, and consistent with our data, samples of parent-identified prepubertal gender nonconforming youth have included more assigned males at birth. Importantly, we did not observe a significant gender effect in terms of rates of retransition, so we do not predict any change in pattern of results if we had a different ratio of participants by sex at birth." Re: the future of the youth involved in this study: "We anticipate continuing to follow this cohort into adolescence and adulthood. This continued follow-up is necessary because it is possible that as more youth move into adolescence and adulthood, their identities could change. As we already saw, some youth will retransition more than once, so the present identities should not be interpreted as final."

I also had an (at the time) undiagnosed blood clotting disorder that caused a sibling of mine to suffer pulmonary embolism during her pregnancy years later. There was no way the outcome for us or that baby would have been good. And, in-fact, i would have been putting myself and that baby in great danger. So, I was given Misoprostol at about 8 weeks. It was my lowest point in life and it has taken a lot of growth and healing to come to terms with it. But thanks to that decision then, that boyfriend and I were allowed the proper time and circumstances to thrive and eventually get married. And to start a family when we were healthy and ready. We now have a happy, strong 2 year old and another on the way. I can’t even imagine what our lives would look like now if that Misoprostol (or abortion in general) hadn’t been an option. But I can assure you it saved me, my boyfriend, that fetus, and our families a great deal of pain and suffering.

The problem is that all it would take is one cop to arrest a doctor for giving the medication to a patient and that doctor looses thier license, thier job, maybe even fined/thrown in prison. At the federal level it could be legal, but at the state level it basically IS illegal. The Supreme Court could order the FDA to turn back it's approval status. Then, the ball's in the FDA's Court. They could follow precedence and do as commanded or they could make a new precedent. Basically, it's more likely to be a state by state issue still.

Its basically tyranny of the minority. Judges are supposed to be impartial, but it is quite obvious that their political & religious leanings impact their interpretation of the law. Choose a friendly district and count on appeals to push it up to the Supreme Court. With the Supreme Court currently stacked with Conservatives and Congress too dysfunctional to counter the court's behaviors (usually if the court strikes down a law, Congress could just draft a new law that works around what they objected to, essentially putting the law back into effect again), the minority is able to bypass the democratic system and shove what they want down the majority's throats.

I count myself so incredibly lucky that I was able to have my fallopian tubes removed here in Texas. I had the procedure done literally the day before RvW was overturned. The entrances to my uterus have also been ablated and sealed off. I don't know if it made a difference that I live in a blue city (Houston), but I knew it was only a matter of time, and getting pregnant could literally kill me. Just starting with my uterus, it's heart shaped with a full septum down the middle. I wouldn't be able to carry a pregnancy to term. Then add on the fact that the medications I'm on could either seriously harm or kill a fetus, but going off of them (which I would probably be forced to do), could kill me. I'm an epileptic. With autoimmune diseases and heart problems. I need my medication. Women shouldn't have to pursue extreme measures to maintain their autonomy and reproductive rights. If these extreme religious groups keep gaining traction and if they succeed in this, make no mistake: contraception will be next on their agenda.
