The Supreme Court is deciding this issue. Congress is the sole authority on this issue under the 14th Amendment, especially since the insurrection provision states no procedure for the application of the disqualification and as a practical matter it really can only apply to ex-Confederates who took conflicting oaths first to the US and then to the Confederacy. Anybody else would at least have to be convicted of the federal offense of insurrection to have this disability applied.
