One phone call? She made one phone call?! Good grief! For something that important you shouldn't depend on one phone call. She should have made at least several, sent some letters, and best of all made a personal appearance at the office. When I was trying to get my mother into our choice of a long term care facility, I just never shut up. Every chance I got I was advocating for her.

Actually, it all runs downhill to the poor cops, who shouldn't have to deal with people who have a medical problem, but everyone else (Mental Health teams, family, schools, Hospitals, etc) have washed their hands.

yeah, this is ridiculous. Homegirl called the DA to seek treatment for her brother. She didn’t hear back and was like “oh well, I tried”. It’s not the DA’s family, it was her family. This episode highlights the beginning of what we see everywhere today… people not taking responsibility for the things they are responsible for.

@@loyaltyisroyalty5616 sorta kinda. It is EXTREMELY difficult to get an adult remanded for psychological care. You basically have to have them declared mentally impaired/incompetent and assume legal guardianship. The only other viable avenue is for them to get so bad that they break the law, and THEN they psych care as a result of their crime.

Actually, you can't force an adult over the age of 18 to get treatment against their will, unless it's been ruled by a judge. So...this actually would fall on the police in this matter. Unfortunately, I understand far more about this subject than I would like.

You are so right. Thing is, that the people who get fixated or a treatment are thankful afterwards, because they know later, that they would have harmed someone. But SJW can´t understand that. They have a very narrow view of what is right and wrong.

Is it just me or is everyone really hating so much on Clare Kincaid so much this episode? She made a mistake, yes, but she had god knows how many other cases on her docket. Doctors, the sister and even the perpetrator himself all had a bigger responsibility to keep him on his medication, way before you get to Claire.

I have a family member who deals with mental health. We have tried to get help for them but we cannot sign papers or put them away for their own good unless they do something wild. Why should someone fire a forest fire when a match could have been blown out. it is really stupid.

Because as shocking as it may seem, we have people who would put their own mother in a home, just to collect their government check.. So in order to lock someone away in a home like that, their has too be evidence that they are actually not capable of taking care of themselves or that they are a danger to others. Because of that little rule, many people who are perfectly sane and stable are not locked away because they had a greedy brother or mother or even son.

@@lfaf9509 .. If a family puts someone in a home THE HOME receives the income, NOT the family. What a family MAY attempt to do is take the profits from mama's estate and use it to put mama in a home of ill repute just to save money if not blow the money before the state can get it. This can be easily avoided.

@@infonut Technically that is not the case, it all depends on the check and what the state knows and what the family decides. Case in point, my mother in law was in a home for the last few years of her life. My father in law set it up so that one of her checks went to a account with the Home, and the other checks she got went to her bank account. He used that money to buy her the things she needed, and to take her out of the home every weekend when he came off the road.. In order for the "Home" to get that money, the family or the person with the power of attorney or the patent themselves depending on the situation, has to set it up to be that way.

She tried but couldn't take his "right" not to be hospitalized for more time. That's why she wrote and asked the lawyers to take him more time but it's a gray area in the law and when his brother took his medicine he is a great lawyer, at the end he got not guilty for medical reasons and the sister told the judge and everyone that he is gonna kill again when he stop taking his medicine.

You can't get a family member hospitalized if they don't want it. And, even if they do want it, there aren't enough spaces. And, even if they do get hospitalized, the treatment is stabilize and release, not long term help. We need to change the system.

@@infonut When my mother needed to go into a long term care facility, we picked a very good one. They didn't have room there right away, so they put her in a place where she wasn't happy. I never quit advocating for her to get into the better one. Every chance I had i gave a speech about how our choice was better for her. We finally got her into that place and it made a huge difference in her life. So yeah, some people do advocate for their relatives.

The thing is that the sister can’t force him to be hospitalized and supervised, but the courts can. She informed the proper people that he needed to be put away so they could do their job and not only punish him for the crime he committed, but prevent future crimes from happening. They didn’t despite being warned and him exhibiting escalating behavior, and now multiple people are dead because of it. So yeah. It is Miss Kincaid’s responsibility 🤧

my brother has severe schitzoaffective disorder which caused him to get violent, as a result he got sent to prison and im pretty sure he actually came out worse than when went in. rehabilitation over incarceration

you are part of the problem. @@YeshuaKingMessiah For someone with jesus name in their profile you sure seem to have missed out on the whole empathy and compassion part of the new testament. That attitude of "Oh I don't care where you shove them, just so long as I don't have to deal with them." is exactly the reason these problems are allowed to fester and turn into murder cases. Paranoid people already fear persecution and that type of lock em up attitude just goes to ensure they avoid seeking the treatment they need.

This is the hospital's problem, they did not make sure he took his meds. The sister too. Stop blaming others. There is nothing police can do unless "something happens" can you imagine how many people would be arrested just for "following" someone down the street (maybe they were going the same way as the other person?) uttering hurtful threats when stressed out, thinking? It's ridiculous. We can't know what someone will do UNTIL they actually do it and people get hurt or die and it's nobody's fault but the perpetrator. Mental disease or not.

Ann Dowd is an incredible actress and is in a bunch of episodes of the show. Her best is the episode "Compassion", where she plays a pediatric oncologist, I think there is actually a clip of it on this channel.

It's really a two way street, she called, she reached out on behalf of her brother, who needed help, the rest should have been up to the state, and board of mental health officials, if a person presents a danger to themselves and others around them, at the first sign of a red flag, there must be some kind of intervention or monitoring said individuals. A fine is not the answer, there should be a followup, and maybe several followups, to prevent things like this in real life.

Why didn’t she go to hospital then??? She called the cops, who have the least power to help her brother because he has to be a a proven danger and him being able to hold a conversation and being willing to take his medication means that he can’t be held against his will. The sister didn’t her diligence don’t blame the people that she tried to pawn him off to.

Never realized Jael was wife of Heber (whom the Heber-ews-Hebrews, are named after) She didn’t lure him in He came skulking to their tent as he figured they would hide him, since their family was friendly to King Jabin. He was a coward so a woman easily killed him, prob asleep.

Well, Kincaid had the opportunity to get him off the street _earlier_ when he was stalking Joanna, but she and the police let him go. So if she had done better due diligence the first time, discovering his history of violence, He wouldn't have been released to later kill and maim those innocent people in his mania. She's at least partially responsible through neglect. (But we know According to Town of Castle Rock v. Gonzales it's not the Police's job to actually "Serve and Protect.")

I’m sorry but a lot of people in the comments are very ignorant and stupid, operating on the opinion that somehow, the main ones responsible for people with destructive mental health disorders are their family members. You have to understand this: nobody chooses to be born with a mental disorder, nobody chooses to be traumatised enough to develop one, and especially nobody chooses to have a family member with a mental disorder. His sister couldn’t do ANYTHING about his disorder once he had turned 18, an age he had long since surpassed when he committed his first crime. People have rights, even mentally ill people, so they can’t be hospitalised against their will without court interference. I should know this because I also have a debilitating mental disorder. And on the note of him not taking his meds - mentally ill people can take responsibility just the same as anyone who isn’t mentally ill. They just need help, such as with therapy and said medication. He knew he had to be on his medication but stopped when he felt better. I understand this, because being on my medication makes a lot of things very difficult for me and makes me feel restricted. But I, like this lawyer character, also understand that just because it makes me feel bad doesn’t mean it’s not saving me from a worser evil, because my meds are preventing a horrible thing just as his were. And given how intelligent he actually is, he absolutely knew this too. What he did was of depraved indifference. He knew what could happen, he just wanted to feel good. Just like a man drinks to feel good but may pay no attention to the consequences when he sits behind a wheel while drunk. Depraved and indifferent.

Its fun to watch through these clips and see which actors they reuse in different roles. The blond lady around 5:40 was the main criminal in another episode, she played an oncologist who was completely broken by her job and seeing so many kids die. Ann O'Dowd!

I think a better word would be “responsibility.” For example, if you know that your family member is a danger to themselves and others it is your responsibility to put them in a hospital, before it becomes anyone else’s “problem.“

They used to be able to institutionalize dangerous people BEFORE they did something bad. But in the 70's(I believe) the Supreme Court said that was unconstitutional.

@@paulhunter6742 They overturned it because it was never a constitutional right. The problem is it's nearly impossible to make something that wasn't included in the constitution in it now as you need 90% support from all the states or something like that and over 70% of people don't believe Abortions should always be allowed at any point in pregnancy. Conversely the vast majority of people do not believe they should be banned outright. The fact that it was that way for 50 years does not mean it was legally correct.

This might be a factor but I heard a story in my family where one of my older family members had their spouse committed against their will because they couldn't get divorced. Wasn't even dangerous or mentally ill, she just didn't want him around. The mental health care system in the US is shitty for sure but if people are doing stuff like that, I can see why some things needed to be changed

ugh wth in hospitals your supposed to be in a gown that has your stuff hanging out everywhere!!! I was in the hospital last week over 6 days of having diarrhea!!! soon as I got put in my room 4 nurses had to help me get in a gown cause I was extremely weak

Now a days, the hospitals, don't really want to deal with them. It treat from home, even if they have issues. If they don't take their meds, they can't force them to, if they freak out. That is on you for, its not their fault.

I would have slapped that A hole if he ever talked to me like that. If he really went through with sueing the DA and the city he probably either lost or the charges were dropped. Anger is not a good enough excuse for the courts to side with you.

These types of crimes often are committed by repeat offenders who continuously get slaps on the wrist. Crime would decrease if we started locking people up forever for things like violent robberies and assaults.

This just shows that aslyums while seen as cruel did good things. Kept those that refuse treatment or were willing to harm others. In a location they would he treated and protect to public from harm. To many bleeding hearts and "cost cutting" allowed them to be closed. Mental health can be helped and handled. If the person is unwilling to be recoved and helped. They should be forced to stay where they cant harm others or themselves.

@@nosetooth8712 State hospitals that still function as "insane asylums" are largely a thing of the past. It's outpatient care and for a few (as these are very limited)- a group home or CILA. Otherwise - it's jail.

Rounding up every sick person and locking the doors is what you want? Because well, so much are non-violent. You just don’t want to look at them. Correct me if I’m wrong. It’s just that asylums were that terrible, it’s only the non ill and non workers that beg for these things. Segregation all over again.
