Technically, but it's not just about engine running. The law states you can only hold a phone if safely parked. That requires you to not be in traffic, engine off and handbrake applied. Safely parked can include designated spaces and the roadside... in this instance, the driver was definitely committing an offence.

We all know that a person walking around a building Trumps a person driving while on phone and swearing in the eyes of the law lol. Actually the law is that even if a vehicle is stationary , it is an offence to use the phone whilst the motor is running. That guy committed an offense besides a public order if someone heard him swearing and were offended. However the police were not bothered about that. They were more interested in a member of the public looking at their building. Me thinks this country is upside down.
