The best part is to sue someone for defamation you have to prove that what they said wasn't true so if it's found out that it is true in discovery that's a big problem for you and if it is true but you don't disclose it and discovery that's an even bigger problem

The issue is the legal fees you get hit with before you even get to that point, in the vid, it mentions this rattle guy is having trouble even getting a lawyer, and if that's the case, all it takes is 1 misstep in filing stuff with the court and it could easily hurt him big time, one of the reasons you pay a lawyer so much is because they know how to navigate the legal minefield to get you into the court to begin with

In most places, defamation requires both knowing that what you’re saying is untrue and saying it anyway with intent to cause harm. That’s why it’s hard to sue for defamation. Not to mention that a lot of states have anti-SLAPP laws. So I see this getting thrown out without supporting evidence to prove defamation is likely before they’ll take it.

Yeah what a lot of people don’t realize, especially litigious people, is that no one “wins” when you go to court. It’s extremely expensive and mentally damaging to both parties. In some jurisdictions the defendant can get their attorneys fees paid by the plaintiff if it’s found to be frivolous, which is what I genuinely hope happens. I hope he has media liability coverage for his channel.
