My brother as a long haul trucker was pulled over and they accused him of DUI, in TN. He asked for a breathalyser. They said, "We don't do that". Arrested him even though he did everything they asked. Left his load/rig on the side of the road. Took him to jail. His company had to send someone to pick up the load. A family member had to find $3000 to bail him out. A family member also had to drive seven hours to get him. His CDL was revoked until it came back clean. I'm that time he lost his vehicle, couldn't get work, lost a huge amount of weight while waiting almost a year(11 months) for the results to come back negative. In that time he had a massive heart attack which left him permanently disabled. Because his heart function is so poor now he's been permanently barred from having a CDL.Not one lawyer would help him .

It’s in the hand of the cops. I’ve seen that take 8 months to a year. In the meantime they will get you to plead to a lesser charge. So it’s not easy unless you have the dollars for the attorney to represent you in the ENDLESS court appearances. The cops will purposefully drag it out as long as they can. It’s far from easy.

The cop just KNEW the kid had pot on him (he obviously didn't), so he staged a false arrest for an excuse to search him and search his car (I still don't understand why they towed it when the mom could have driven it home, but that gives them an excuse to search the car before it is towed). In these sorts of cases, even if chaefes are dropped, best case you spent time in jail then had to pay $$$ on a lawyer. Many can't afford that, put them in a deep hole. Often a lerson loses job bc of being absent or just bc of the weight of the charges. Aperson could end up losing their housing. This could all ruin a persons life, even IF charges dropped. Cop won't see any punishment, so free to do again. Ruin more lives. Some might end up wrongly convicted, and ruin life beyond repair. All bc of cop ego.

Almost every one is on some type of prescription medication or smokes weed or drinks once or twice a week or actually does drugs, and at least one of those will almost always show up and can be used to justify their arrest. Anyone who's been arrested for DUI for years has known this, their field sobriety test is useless if not recorded anyway because they are not doctors and even if they were there are a hilarious number of other reasons you would fail, like disorders that prevent your balance or mess with your eyes, neither of which you are legally obligated to reveal to them because they don't effect your driving abilities anyway because you don't need to be able to balance in a car and it doesn't actually effect your vision if your eye muscles don't track motion perfectly because your brain compensates for it and no one can see through your own eyes. Like for instance having a lazy eye causes you to fail, especially if you have one that isn't immediately noticeable and never needed to be corrected. And having ataxia will make you fail because you can't balance right

Check the laws of your state (and prior to leaving on a trip - whichever states you will be traveling through). MOST states allow you to refuse both FST and Preliminary Breath Test (because those can not distinguish between mouth alcohol and lung contents alcohol). You **will** still get arrested and have to go to court, but the Fifth Amendment ensures you do NOT have to help provide any evidence against yourself. FST are somewhat subjective, cops DO NOT FOLLOW THEIR TRAINING FROM NHTSA and many do not even remember what their training tells them to look for in order to have RAS to pull you over for DUI. Plus most cops DO NOT ASK if there is any physical reason you can't perform them. They also frequently have people perform the tests on a sloped surface - LIKE HIGHWAYS. I have Fibromyalgia. It affects my balance. I had the ends of my right tibia and fibula surgically reattached. I have Ehlers Danloe Syndrome which affects my joints and I have *literally* sprained each ankle at least once just by stepping off a sidewalk/curb into parking lots. I also sometimes have a very hard time knowing if my foot bottom is level/flat. I have mild strabismus so I have resting Nystagmus. I can not perform ANY of the FSTs because of medical/natural reasons without failing them completely sober.

She is trying to find a Civil Lawyer, now. She was coming home from work, and does not drink, or do drugs. She knew her blood work would come back clean, and it did.
