The judiciary ought to be beyond reproach, unimpeachable and spotless in order to exercise the power and bear the responsibilities bestowed upon it by the constitution. When there is a question of lack of impartiality, the ONE AND ONLY thing to do would be to recuse onself from such a case, and avoid any instance of doubt. By litigating the conduct of judges in open court, you only sow more seeds of doubt. Why must you be in the panel? Why should the respondent defend the panel?? Is it to say that if a compromised judge has able litigators arguing for their case, they get to adjudicate a case in which one party is aggrieved but cannot win the recusal argument ?? Fighting to remain empaneled is not a win for the judiciary or the individual judges. We have just witnessed the making of bad jurisprudence, and i hope that one day a higher court will do better.

@@ismailowino2866 I can see that you are spared more than verbiage. Understanding is key. The problem is not whether or not Mrima and Ogola are biased. That cannot be determined in court. The problem is that THEY FAILED TO DISCLOSE THE ASSOCIATION for members of the bar to assess before the proceedings begun. It is common practice in A COURT OF LAW. In other courts, I don't know what is common practice.

We were alive in 2017 when Raila filed his election petition against President Uhuru Kenyatta's win before the Supreme Court. Justice Jackton Ojwang' sat in that bench. The wife to Jackton Ojwang', Prof. Colleta Suda was appointed a CS directly by Uhuru Kenyatta, a respondent in that case.
