Gotta say…..Mr Kennedy says I’m too young to own an AR. 🤨 I’ve got a BIG problem with that. And the Constitution has a BIG problem with that. Dude. People my age (18-20) are adults entitled to every other right in the Bill of Rights. People my age fought under General Washington, and in the Civil war, and every other conflict. My ancestor took his family musket and became a drummer in the Continental Army when he was 15 for a short time before his father went and brought him back home. People my age were (and still are) part of the Militia, as defined by Congress, and were required to own military style rifles if they were called upon. A flintlock rifle or musket is analogous to modern ARs because they are both the most commonly used rifles of their time, used for hunting, sport, and military use. And you get mad at people who criticize you for holding views that are inconsistent with the Constitution? You said gun control can be a helpful tool. What did you mean by that? And what are you doing with that dumb AI company that is messing around in the NICS system?

You have to adapt with the times. If you took the average 20 year old of today back to the days of the constitution they would be considered children.

However, sir,the bottom line is this: the Constitution protects the right of the people to keep and bear arms. All adults who are part of the political community (those that are old enough to vote, own land, enter contracts, and who are entitled to EVERY OTHER ENUMERATED RIGHT), are part of “The people”. Congress even mandated that 18-20 year olds (and in some cases 16 year olds were also part of the militia) to buy their own military style rifles and were required to bring them to militia training. The founders were well aware of the maturity of different ages, because they laid down specific age requirements elsewhere in the Constitution. And after all, some of the founders themselves were in this same age range; Alexander Hamilton and James Monroe were both very young. It is absolutely, and unequivocally unconstitutional to infringe on 18-20 year olds’ right to bear arms based on age. Under your logic, sir, should we ban young adults from posting speech on social media because “times have changed”? Do any of our rights stand firm under the misguided assumption that because a few years have passed the Constitution no longer applies? Emphatically I say NO! Would the Founding Fathers approve of Americans disregarding the Constitution because they simply disagree with it? In their foresight, they added Article V which lays out the amendment process. If you want to change the Constitution, then amend it! I feel that we have lost our respect for the Constitution, which is not simply a document. Alexander Hamilton stated this about the Constitution, “For my own part, I sincerely esteem it a system which without the finger of God, never could have been suggested and agreed upon by such a diversity of interests.” Many men who have sworn to uphold, support, and defend the Constitution have died for the same. What would they say if they knew that some would treat that Document, that they died to uphold, with such disrespect as to knowingly violate it under the dubious premise that “times have changed”?

A friend of his was a victim of a home invasion in CA recently and had to use his gun in self-defense. Tim made posts and videos supporting him. That friend lost his permit a few days later because of the same type of ridiculous regulations he supports. Tim should know about the limits the Posse Comitatus Act places on active duty support to civilian law enforcement. There are definitely legal barriers-significant ones. That being said, there is a considerable amount of support the National Guard, in a State Active Duty status, can provide.

Just viewed this Real Talk. Part of the answer to not sending Federal Military support to the border is The Comitatus Act of 1878. There are several exclusions which have been used. Also there are a number of veteran organizations which are helping veterans and their spouses heal and provide support.

Mr. Kennedy (using that since I don't know his military rank) is incorrect when it comes to sending U.S. armed forces to the southern border. The Third Amendment (often referred to as the forgotten Amendment) only covers quartering of troops in private residences without the permission of the owner. To my knowledge this has only been violated once. It was in the aftermath of Hurricane Katrina when federal troops occupied abandoned homes. When it comes to drone flights, all airspace above 500 feet is controlled by the U.S. government via the FAA. States cannot regulate, nor can individuals prohibit, flight in that airspace. Example, after 9/11 Massachusetts tried to establish a restricted area over the Quabbin reservoir, where Boston's drinking water comes from. The FAA quickly slapped them down. Lastly, since people coming over the border illegally include criminals and now increasingly men of military age from countries inimical to the U.S., the activity can legally be considered an invasion, and the military has not only the authority but the duty to repel invasion. Mr. Kennedy mentions Pearl Harbor. If the Japanese had actually invaded Hawaii or California, would not the military have moved to repel that invasion?

First, I love the use of “inimical.” Good word. That’s said, I think he’s referring to the Posse Comitatus Act. Look it up. He’s probably right. You’d have to use the state’s national guard units, not the active army.

I was a Tim fan for many years until he said that a 18 year old shouldn’t be able to have an AR-15 or carry a firearm. After that, he tried to backtrack because he said it was taken out of context. I watched that interview many many times and it wasn’t, he was talking to Lance Armstrong about it. If he taught and believes in the Constitution, shall not be infringed should be taken seriously.
