It makes sense now why Johnny didn't list TMZ as a co-defendant for the defamation suit because TMZ could easily invoke Journalist's privilege. However, since TMZ is not a party, and a former employee is willingly volunteering to provide the information, Journalist privilege isn't applicable in a civil matter. In regards to the NDA between Morgan and TMZ, that's an employment issue that TMZ will have pursue separately. However, if TMZ decides to pursue the NDA case, then Johnny's team can definitely get involved as the issue relates to their defamation case assuming he's proven that he was defamed. I watched the former TMZ employee's testimony. As a former journalist myself, it didn't seem that he violated any journalistic ethics. Whether he violated any non-disclosure agreement (NDA) with TMZ is unknown, but would not be within the purview of this court in this case.
