Part 18: • Tom Mesereau on Bill C...
Part 1: • Tom Mesereau on Defend...
--------
In this clip, Tom Mesereau shared his thoughts on the Derek Chauvin trial, and he believes the video with George Floyd warranted first-degree murder charges. Tom went on to explain that pre-meditation can happen within the moment of an incident, and he pointed out that Chauvin kneeled on George for over nine minutes. Tom then added that he admires well-trained and honest police officers, but he believes that dirty cops are a disaster. To hear more, hit the above clip.
Mesereau shared his thoughts on the Ma'Khia Bryant incident in Columbus, and he admits that he didn't see the video. However, Tom questions why so many Black people seem to be targeted by police in routine situations, which he says signals that there's something wrong with the system. Moving along, Tom shared his thoughts on R. Kelly's case, and he spoke about meeting the controversial artist, which you can hear more about above.

@@S5King7 Then what is this guy talking about? He's going away for life. It is like saying 'nah, he should have served 40 years for murder in the first rather than 40 years for murder in the second.' In the grand scheme of things what difference does it make? The time he would be spending in jail would be the same, in fact, it is a worse curse because the other prisoners would treat him even worse for the charge simply because they're thick and would think he got away with murder in the first. Going away for life isn't getting away with it, even the lawyer himself had to admit to that as it is absolutely absurd to suggest it, but that dismantles his whole argument. The charge now doesn't matter, he's finished. I suppose it could entice and fire up the psychotics to smash their own neighborhoods up due nothing more than wording and semantics.

From the moment George Floyd started gasping for air and saying he can’t breathe, Chauvin should have at least found found it in himself to maneuver into another position that would allow George to breath while still holding him down. (Holding him down was however unnecessary in my opinion as George was unarmed and already handcuffed while laying on the floor.) The mere fact that he heard and saw George struggle to breathe, but insisted on pressuring his knee on to his neck for that amount of time was enough evidence to render that Chauven had the requisite mens rea required by law for the purposes of a homicide. It is a principle in Criminal Law that mens rea for any crime can be superimposed into the acts of the accused. Chauven was definitely liable for 1st degree murder!

He said he couldn't breathe before he ever was on the ground, before any knee touched him. They were trying to get him to just sit in the police SUV, but he said he didn't want to be in there, and asked to be put on the ground instead, all the while saying he was having trouble breathing. But yea, Chauvin went too far, either way. You see someone fading away like that on the ground, you don't keep digging the knee in harder. You ease up and start trying to render aid. Instead he kept forcefully restraining, and delayed calling the ambulance. I think on the cam you can even hear someone say that are medically qualified and able to render aid, but they wouldn't let them near Floyd.

I don't agree with how the incident played out, but as I understand it, Chauvin did everything as instructed in his training. George Floyd was not pinned by his neck; he was frequently lifting and turning his head and could clearly breathe. He was claiming to not be able to long before he was placed on the ground. Derek Chauvin had to maintain that nothing was wrong so as not to upset the crowd. He was also not allowed to perform CPR. George Floyd had ingested more than a lethal amount of fentanyl in an attempt to hide it from the police. These are the facts as I understand them.

Thanks Vlad. Great as usual. There's a million questions in George's case. Including: Why did the shopkeepers call the police and state that 'George was really drunk and not in control of himself' yet they felt no threat and completely safe to go out to the car to ask him to hand the cigarettes back? Why did the police not ask the shopkeepers for George's car reg and visit him at home later? How did the police arrive so quickly over a counterfeit $20 bill? How come this very busy shop had never seen one of these newly printed $20 dollar bills. Did George get extra early stimulous? In cash? Would be interesting to hear Tom's views on the public mounting a case against the force as opposed to just the officers; on the basis of inadequate training (with Chauvin testifying as to who trained him in the knee technique and exactly how much pressure was applied to the neck). Although I guess it's not his area as a celebrity defence lawyer. But that's what needs to happen for change. The whole force needs to go under investigation and the public needs a case against the force! Not just be cracking champagne bottles over Chauvin who's gonna be 'silenced' for 40 years in solitary!
