You’re innocent until proven guilty... But if you refuse to help police in their investigations they are 100% justified to arrest you for disorderly Conduct. Because that is a law and you would be breaking a law in front of the police then. Thus you are arrestable.

Toothpaste usually contains triclosan and fluoride, but that Oreo prank wouldn't have caused poisoning for the homeless person. The average tube of toothpaste contains only 0.5 grams of sodium fluoride. To get fluoride poisoning, an adult would have to take around 5 to 10 *grams* of sodium fluoride. You would have to eat *at least 10 tubes* of toothpaste to hit the lower end of the threshold. It is highly unlikely that you would consume that much toothpaste unintentionally. You'd likely vomit it back up before you even got through a whole tube. Children are less tolerant to fluoride because of their size. Even they would need to ingest several tubes of toothpaste for the fluoride levels to become toxic. If you swallow too much toothpaste, it can cause intestinal blockage and stomach pain. If it has a lot of fluoride and/or you swallow a LOT of toothpaste, we're talking about breathing problems, diarrhea, heart attack potentially, drooling, shock is possible, slow heart rate, tremors, weakness, vomiting, convulsions, etc. That "lot" of toothpaste is a ridiculous amount, as mentioned above. Any amount of fluoride really isn't good for you. Toothpaste labels didn't have warning labels on them until 1997 when the FDA made it mandatory for toothpaste manufacturers to include information about what could happen to children that consume large amounts of fluoride. A big problem was that particularly with kids, all of the 'fruity' flavored toothpastes that were coming out...they were literally squeezing out huge amounts and eating it outright. That was of course a fluoride poisoning risk and the FDA and manufacturers didn't want to deal with the blowback on that and put the label there just in case.

I'm from Norway, and here you can choose to not talk to police. You are not forced, and they can't force you. Now a trial is another thing, there you can't choose to not answer questions. If you refuse you either get fined or go to jail.
