Fair Dealing

Certain exceptions only apply if the use of the work is a ‘fair dealing’. For example, the exceptions relating to research and private study, criticism or review, or news reporting.

Factors that have been identified by the courts as relevant in determining whether a particular dealing with a work is fair include:
* does using the work affect the market for the original work? If a use of a work acts as a substitute for it, causing the owner to lose revenue, then it is not likely to be fair
* is the amount of the work taken reasonable and appropriate? Was it necessary to use the amount that was taken? Usually only part of a work may be used
The relative importance of any one factor will vary according to the case in hand and the type of dealing in question.

The concept of fair usage exists within UK copyright law; commonly referred to as fair dealing, or free use and fair practice. It’s a framework designed to allow the lawful use or reproduction of work without having to seek permission from the copyright owner(s) or creator(s) or infringing their interest.
Fair dealing law is not only applicable to text-based works; it applies to musical, dramatic, artistic, literary and typographical works too. However, it does not cover the copyright of printed music.
As an exception to British copyright law, fair dealing is governed by Sections 29 and 30 of the Copyright, Designs and Patents Act 1988, which outlines three instance where fair dealing is a legitimate defence:
* If the use is for the purposes of research or private study;
* If it is used for the purposes of criticism, review or quotation;
* Where it is utilised for the purposes of reporting current events (this does not apply to photographs)
A statutory definition for fair dealing does not exist; it will always be a matter of fact, degree and interpretation in every fair dealing case. Nor is there a percentage or quantitative measure to determine fair dealing. The Intellectual Property Office lists the key factors used to determine the validity of whether a particular dealing with a work is fair as follows:
* Has the use of the work impacted negatively on the market for the original work? If the creator or owner has lost potential revenue through the re-use of their work, it is not likely to be fair.
* Was it reasonable and necessary to use the amount of work that was taken?
The Copyright, Designs and Patents Act 1988 also outlines the potential fair dealing defences that permit the use of copyright works without permission from the author(s) or creator(s) under UK copyright law.

His genius gets quite a lot of recognition, IMO. Genuinely underrated is OMD, who directly inspired Vince (and Moby, while we're at it) to pursue electronic music in the first place.

@@nagashtheforsaken OK in the music world and people like you and me. But ask the general public about Vince clarke or show them a picture and they would have no idea who he is. I suppose that's probably the way he likes it (Like Chris lowe). But a lot fo people would know Depeche Mode, Yazoo, Erasure (or at least know the songs when they hear them). Erasure should be as respected as people like the Pet shop boys, Depeche Mode, OMD and even a Daft Punk.

@@airlane66 I think it’s pretty good, tbh, just far from complete. Am not sure why more recent tracks from the soundtrack of the movie Drive are included, even if brilliant, as the majority seem to be from the ‘80s. You mightn’t agree, but for me I just can see further than ‘Souvenir’ by OMD. Doubtlessly many others outsold it, like A-ha’s fantastic song ‘Take on Me’, the extraordinary video for which appears to have been watched by most of the world’s population 😂. But it’s Souvenir for me all day long. Love the ‘80s ❤

DM only did a couple of albums as "synth pop" and and they were quite unknown by then to have enough impact. The list almost forgot OMD wich, for those who didn't know it, is the main reason DM exists: in words of DM members and Vince Clark. And they had a huge success in the eighties in Europe. Millions believe everything in the eighties was synth-pop and NOOOOOOO. DM's third album (1983) is already industrial music. In this list there are more stiles than synth and I found it ridiculously stupid. They put A Flock Of Seagulls (new wave) in the Top 10 and they never had a top 5 but once in the USA!!!

Why do people keep missing the second one lol. But youve contradicted it with the opinion point because this isnt about the most significant to the genre etc, its about the sound of the songs. Otherwise it would be Kraftwerk and Gary Numan at the top with one or two others lol. Cheers

Yeah i did actually have The Great Commandment in there when i uploaded this the first time (on an old channel) but i had quite a few comments asking why i didnt have Maniac by Michael Sembello in there (never really thought of it as synth pop before), so i had to swap that in for that really as its such a big song. But it really could have been there its a great song and they had a great synth pop sound. Cheers

⁠​⁠@@Media_Rankerbut if you were compiling the list and you knew that Maniac has no place being on a synthpop list shouldn’t you have used your better judgment and not capitulated? With that said I do think the top 5 are excellent and was particularly pleased to see Heaven 17 Temptation in there. The only song in that top 5 that I felt should have not been there, even though I absolutely love it is Enjoy The Silence simply because I think there are much better DM songs which are more fully synth based, however, regardless, Enjoy The Silence is a banger and the last great DM song IMO. I was glad to see Duran Duran included but I wish it had been “Is There Something I Should Know” or “Union Of The Snake” both of which are much more synth sounding than “Hungry Like The Wolf” (nothing against Hungry Like The Wolf at all, which I freaking love).

En los 80's brillaron todos lod géneros electronicos de primera línea del EDM 80's: House, Techno, Synthpop, HI-NRG, Freestyle, Italo, Electro Funk, New Beat, Trance, Ácid, Electro, Eurobeat... Same thought here. Glad to know this list is so close to my favourites bands. Of course, there’s never a perfect selection: I would love to see some germans ‘hit factory’ bands like Camouflage or Cetu Javu to get this even better but nevertheless I’m quite happy with that.

Perhaps purely from an American perspective (and Los Angeles for me, where the broad New Wave genre first broke through the radio waves in the US), some of these don't check the box of Synth Pop... mainly because they were already crossed over too much into another genre, like mainstream pop or New Romanticism. With Synth Pop, right away I think New Order, Depeche Mode, A-ha, OMD, Soft Cell, Bronski Beat, Human League, Eurythmics, Ultravox, PSB, Erasure, Talk Talk (which btw, the song "Talk Talk" isn't on the list?!)... But Michael Sambello, Kim Carnes, Corey Hart - while their songs used synthesizers, they were more of a "Top 40 pop" sound - something much more mainstream, and out of place in overall New Wave. Stacey Q is definitely way more Freestyle genre, but I just love her too much to kick her off this list! And then there's bands like Duran Duran, Spandau Ballet, Ice House and to a lesser extent Simple Minds - all which I love. To me, they aren't quite as leaned into the synth pop aesthetic. They check the "synth" and the "pop" boxes enough while still definitively under the broader umbrella of New Wave. But then again, technically so does INXS - and they're nowhere to be found here! I'd argue for their place on this list over Corey Hart, Kim Carnes, and Michael Sambello. The UK perspective probably looks a bit different: I just took note that the 3 exceptions I mentioned are from North America. By the way, thank you for giving respect to my all-time favorite New Order... who I think is too often overlooked. Their contribution to synth and the obvious influence they had in the decades that followed is immeasurable. (Oh, so many house songs at clubs in the 90's - overall less sophisticated & less thoughtful compared to New Order's work, but many house artists ripped off elements straight from New Order's tracks). I personally think Bizarre Love Triangle is the best song of the three, but I'm just very happy you even included it!

No 'Cambodia-R', no 'Chequered Love', 'You Keep Me Hangin' On' or 'You Came', never mind all the even more important masses of them that always get ignored: 'Bitter Is Better', 'Ego', 'Take Me Tonight', 'Stay Awhile', 'The Second Time', 'Hey Mister Heartache', 'Child Come Away', 'Boys', 'House Of Salome', 'The Touch', 'Shangri-La', 'Dancing In The Dark' etc. There's no China Crisis, Shakespears Sister, Natasha England, Real Life (you did mention this act above), Blancmange (unless I missed them), Kirsty MacColl, Thompson Twins (which you also add), 'Til Tuesday, 'Voice Of The Beehive', 'Machinations, Kids In The Kitchen and more. List is just done to put Depeche Mode in as many times as possible (I don't know why, they completely abandoned their sound in the 90s so stop sucking up to them people). There's decent Duran songs should've been here: 'The Promise', 'Election Day', 'Skin Trade', 'All She Wants Is', 'Sound Of Thunder' too.

It's not a great list at all-Kim Wilde is not on there AT ALL! Here we go again, another completely dumb compiler deaf and blind to this amazing woman and her equally amazing brother's output-she was only biggest UK female of the lot, yet you make sure you put Eurythmics, Yazoo and even Bananarama in there. You certainly didn't listen to one of those songs on it-'Don't You Forget About Me'-as you clearly DID with Kim bloody Wilde! Then there's Sandra, Real Life, Camouflage, Information Society, Kirsty MacColl, Blancmange, China Crisis, Nick Heyward, Lene Lovich, even ABBA, it reads more like a who's who of who you DIDIN'T feature. Strange definition of synth-pop. If Simple Minds are a synth-pop band, then why no Genesis, Pink Floyd, Van Halen or The Beatles?

Theres sort of two sides to it because those songs are definitely synth pop songs, synth pop is one of the genres for them if not the only one. However yes there are big (well bigger) artists who maybe do technically have songs like that too who i chose not to include because they couldnt be considered a synth pop artist generally. Cheers

Good list although I’d question the order. I’d also question if some these hits are true synth pop. Just because a band has a synthesiser doesn’t make it synth pop. And no Bjork!! Hyperballad is just monumental!
