Once again, a very good and thorough video. The only thing that I would add regarding forms is to make sure you check the expiration date on the form itself to make sure that it is not denied based on a Veteran using the correct, but outdated forms form. One that I saw recently expired in 2021.

It's going on two years since my last appeal. I was advised to write time limit extension due to covid on my next appeal to keep my effective date

What if I have my C-File, but I can't find the documents from where I did the First and Second Gulf War Review (back in the early 90's, where I described all of my problems from service and they did an overall examination and made some diagnosis's), and the first Toxic Exposure Review (sometime in the early 2000's)? I also don't think my early "paper" VA medical records are in my C-File.

I joined the army in 1981 and a month later I was diagnosed with perforated ear drum and was given a honorable medical discharge am I eligible for benefits? remember I had just started basic training only served less than 30 days.

i already filed to get my C file for my recent claims that were denied so i’m sure it’ll be a couple of months before i see anything. i read somewhere that my VSO may be able to get a copy of that C&P exam faster for me, is that true?

The Page where you submit your claim literally says they will Accept the Statement In Support form 4138 still, so long as you fill out your stressor, symptoms, date of event and personal info.. I did, and got called in for a C&P 10 days later.

In July of 2018 I had a C&P exam and the report was filed 3 hours before my appointment. The VA lowered my rating from 60% to 30%. I have gotten back to 60%. The claim was for unemployability.

So I had such a poor back exam through QTC that I contacted my Congresswoman and she opened a congressional investigation. All I got was an apology letter from QTC but NO rescheduled appointment. Do I go back to congress? This examiner was way out of line. Tell Matt Lou in Maine says Hi:)

Do you have to prove a link with Desert Storm presumptive cases such as IBS or GERD?

IBS is a presumptive illness for Desert Storm vets. GERD should be an easy secondary claim.

One Million Dollar Question for you. Can a Vet Rated at 100% P&T with SMC L1/2 with Aid & Attendance still work from home on the phone selling life insurance, granted conditions fluctuate from day to day but can a Veteran work under this rating (Part Time) under these circumstances without loosing his current pay status? As stated there is no way I can work efficiently on a regular basis but writing a few policies a month considered gameful employment? Were can I find the VA rules on this specific circumstance. Thank You

1:46 I was denied because it was not service connected but I can't prove it if my records are missing. I was pregnant while in the service due to a rape by an officer and all my medical is not there due to the fact that only records I have is that I'm 4 months pregnant and then 7 months pregnant no other record of my pregnancy or child birth, so I sent them my son's birth certificate to prove my pregnancy and that I was pregnant and had a baby while in the service.

What if I was awarded 70% for anxiety and depression and I was tested for Sleep Apnea and found that it was a secondary issue from Depression. I was issued a CPAP machine but the VA will not make it service connected. Even though I complained about sleeping in service and should be documented.

All apnea claims are DENIED first time. Ask around and try to find 1 person who had it approved the first time. You won’t.

Submitting supplemental info is 1 year also.? I thought it’s 4 months before expire the window expire?

I have 2 set of claims that were submitted in October 2021. One set of 7 supplemental and one set of 8 new claims for a total of 15 claims. I had about 3 C&P exams for a total of 6 claims. No decision has been made as of today. The VA states that no additinal information is required from me. What could be the holdup? Are they trying to combine all of them? How would I find out?

@The Deuce Transparency Thanks for replying. I agree with you. My VSO actually did it for me. He had taken over after I was denied on 3 of 4 claims. He resubmitted the 3 as Supplemental and added the others in the process. Maybe I have to wait much longer. I have no way of knowing

is it ok to write my own statement and upload it as evidence? kinda of like a buddy letter, but its my own statement? Will the VA use this? thanks guys

Yes I wrote my own statement on my own behalf and the VA accepted it.

That's the Statement In Support of Claim form 4138. Input your info in the small boxes, and then the huge empty space if for you to write whatever your argument, claim, event, stressor, symptoms..etc into.

@@eQuariuz do you have to do this on that form? I’ve uploaded personal statements I typed out on Microsoft word doc and uploaded it as evidence to support the claim. Thanks for the help.

​@@InvestingwithNickCowles I did. But I think I've heard one of these law firm ladies say that you could hand write it on a .doc, but they frown on it because they need certain specific information. I just use the 4138 because it's built for that. for example i put at the top of the input paragraph space: DC 62600 (Tinnitus) then start a paragraph: (what this is about) I am filing a claim for tinnitus - ringing that I experience in both ears, (qualifier) due to my service in blah blah unit, under: *U.S.X.X. - MOS, ####, ( Noted on form DD-214 ). (nexus or events) In the XXXX service, i was exposed to . .1.xx 2.xxx 3. xxx things, without hearing protection. (valid timeframes) I first noticed it in 20xx while on active duty (or whatever) doing xxxxx job, and it has afflicted me since, getting more noticeable *over time until current....etc. (symptoms) It has affected me by creating stress, limpdick, headaches, loss of concentration...etc etc etc.. (disclaimer) *I have NOT been exposed to any noise trauma since service and worked as a xxxxx (or I worked around noise but always use Osha approved hearing protection...etc) (call to action) Pls schedule me for a C&P exam. Thank you for your time. John J. Rambo That's how i fill out every claim bc they need certain points of info. But you probably already heard it so... I'd just use the form. it's up to you though. I am a disable vet since 1970 I ve been seeing doctors and trying to get my disability since 83 I've got nothing but LIES from VA I need help fielding another claim

If you recently got out Bumed has your medical records. If you got booted in boot camp and didn’t even serve 90 days of active service you don’t get any benefits and to avoid public embarrassment around military personnel you should avoid calling yourself a veteran 🤗

@john kehler you are indeed a veteran as long as you served on active duty, regardless of the amount of time and location (boot camp included). You were obviously limited to serving more time due to the medical condition you were diagnosed with which led to your discharge. While your medical records were lost, there should be an electronic version of it somewhere, especially if you recently served on active duty (ex. In the past 10 years). Furthermore, your DD 214 should serve to confirm you were medically discharged.

There are some reputable company out there but there is a charge for it. I have changed the range anywhere from 600 $1200.

No, your "Statement in Support of Claim" is written by YOU (and anyone else who witness or knows your symptoms) on form 4138, The nexus is written by your doctor.

Write your letter as if you're writing in your diary. Make it CLEAR how you feel, how it affects you, your family and your employment status. Be bold and don't hold back. Above all be honest. Good Luck 👍

Please be careful regarding you rating physician thru OSI. I worked in the medical credentialing / records field for over 20 years. Many of the doctors selected by OSI to review your claims are not even credentialed to evaluate certain claims. Due your due diligence on the doctor before you agree to allow that doctor to review your claim.

Could you list those 8 reasons? As I made notes I only heard 6. Here's what I heard: A establish service connection B do not miss appts C doctor report needs to be credible D have the same evidence the VA has E miss an appeal deadline F file the wrong form
