Cardano never expected US adoption. It's fine. If necessary I'll turn my Ada stake rewards into Bitcoin on a foreign exchange and bring them back to a Fidelity type brokerage as an off ramp

And adoption and use cases is the goal, not retail investors. If no one in America uses or buys ADA, Cardano will still flourish. It, and Algo to a lesser degree, are really the only chains like them that offer where the future is headed. It's not little dexes doing defi on Ethereum..

The only thing that I don’t agree on with that statement is that Africa is drowning in corruption and investors are not confident that there investments are safe. Until it changes that it will be primarily a commodity export based economy. It has really great potential if it can tackle corruption and the other crime it causes.

Three huge points you're not mentioning: 1) The CFTC disagrees with the SEC and is also in the race to be Crypto Regulators. 2) We have elections coming up. If U.S investors vote primarily for Crypto friendly candidates, and they win, most of the concerns mentioned in this video are invalidated. 3) DeFi - investors can still hold the SEC named assets and just swap them for unnamed assets when the need for cashing out arises.

Does it matter where the ico takes place? Cardano for example - 100% in Japan. If the ICO was outside of the US with no US investors does it change the applicability of the SEC security laws?

In my view, again not a lawyer, the SEC can claim that a cryptocurrency is a security because it was issued using an ICO or similar method even if it’s not in the US. ADA became available on US exchanges afterward in 2017, so at that point the argument is whether or not secondary sales are commodity property transfer or the sale of an unregistered security. That’s the fight. The SEC could not go after IOHK as easily, IMO, for the ICO. Why? Because they did everything in their power to prevent US investors from participating. They can, however, still claim ADA is as security

If they spent their energy and tax dollars on working WITH exchanges and education, and mechanisms that prevent fraud - this asset class can truly thrive.

I dont think all these coins , projects are going to face lawsuits and go to court. The sec dosnt have the funding or resources to open up multiple cases with all these crypto companies, thats why its gone to the exchanges. If ripple win it will look bleak for the sec in any future lawsuits regarding digital assets. Its a crucial time for crypto going forward.

Each token is different, case by case. Ripple's defence is specific only to Ripple, they have a strong fair notice defence, others may not, Hinman emails etc.

The SEC doesn’t have to bring cases against each company who issued the tokens, they just have to win against Coinbase and get legal precedent in place to define all of these tokens as securities Ripple case would help a lot if it went in their favor, but it’s not the end all on its own

Man I really appreciate your content, as well as your delivery style. No hype, just perspective. Sobering thoughts from today's episode, but justified. FWIW I have a friend who works in live events and he was at some recent conference in the States with extremely wealthy finance types. They are getting out of crypto right now, and were heavily in it before. Not sure If they were institutions or just individuals, but they probably got wind of the harshly anti-crypto bent of this current admin. I'll definitely be factoring in crypto policy stance of candidates in the upcoming US elections. Whoever is sane, not 300 years old and has a reasonable approach to crypto regulation will get my vote. Have fun with your kid!

Crypto assets are not orange orchards. I do not think they are securities. They are in some instances used for the fees on blockchains. I cannot see how securities can do that. We need something other than security/commodity/currency. And a separate regulatory agency since the SEC are clearly against (politically) the things they are supposed to be regulating. I have a bunch of alts - on Coinbase, Gemini, and in Metamask. Dollar value too low to do anything with. Was waiting for the next alt bull market to convert to BTC. I think BTC (and gold) are currencies (money, at least). I have, incidentally, communicated with my Senators (in NM) but one of them was a proponent of the RESTRICT Act. XRP was sued by the sec in 2020 but still went at least 4 times the price in the 2021 bull market. So I would not necessary expect to all those coins mentioned to be dormant or disappear before in the next bull market.

Binance (not US) halts service in the Netherlands as of 2023- 7-17. The Dutch are part of the EU. They, Binance, didn't get approval to become a digital asset provider over here. I think we are the first country in the EU that this happens to. Binance already halted withdrawls in fiat currency. So only offramp in cryptocoins is possible. This is a perfect example of what you are talking about. We can not get our money out. On what decentralized exchanges, worldwide, can we stil swap between coins of different blockchains and swap back into fiat currencies and withdrawn fiat currencies. Could you make an indept topic on that. I would like It if you did that. Thank you.

Yesterday I went to the Ohio State Capital to a meeting being held by coinbase. I met several house representatives that support crypto. I also got to meet Paul Grewal. I asked him what can the typical coinbase customer do to support their efforts to fight the ridiculous lawsuit, he thanked me and pointed me to coinbase website stand with crypto. Thoughts on that?

I would say that some tokens have already priced this in for the past 3 years like XRP and by relation XLM though not as much. They are probably the closest to having this priced in. That is not to say they cannot go much lower but it is something to consider.

In the unlikely event that would make me want to sell, I could always use a Cardano DEX (e.g. sundeaswap, pancake swap, etc.) to convert my ADA to USDC/USDT/ETH/BTC and then transfer the coins to my ledger or sell them for fiat on any centralized exchange. What am I missing?

I think it will be big huge problem cause we develop dapps & smart contracts on the blockchain which will have to exchange the native currency of blockchain . Ex Ada on Cardano .. then I if I develop an app I would have release ada to the users or users get Ada for services etc on Dapps .. if it’s security that is not allowed maybe so will choke all development ?? .. difference is I can buy Apple stock but I can’t sell that on an app to others who use it etc ..

I agree with Hashoshi and his view, but I want to add another broader perspective. This is the chokepoint 2.0 plan that the current U.S. government is executing on. The anti-crypto elites do not understand the paradigm shift that is occurring and the capabilities of the blockchain/cryptocurrency (DEFI, tokenization of assets) and the opportunities to change and replace the existing financial and other legacy systems. However, they do understand the threats to existing banks and markets from a liquidity perspective.
