The judge is going to look at the way it's marketed to the producer or consumer. Right on the front page "Use Splice samples to create anything. They're cleared for commercial use in new works. " "Keep everything you download, even if you cancel." It's really the content ID systems that are screwing everything up. How was it handled for Rihanna's Umbrella? She used a blatantly ripped off Apple Loop for her entire percussion section. Huge hit. Who cares if someone else uses it. It's none of YT, TikTok or whatever else's god damned business.

I guess they put little digital numbered tag like things inside a lot of sounds a guy I know said that splice samples can have them but it’s rare so you never know when it’s gonna happen which sucks if you have to remake all the content again it sucks when your whole audio gets muted especially as a person who makes music lmao!

These are two different claims. They may get joined during a suit, but if splice is forming a suit for misuse based on the TOS, then that's what they're looking at. A counter suit could be made for misrepresenting their service of course. However, the suits could get passed where splice wins the contract suit and the artist/producer wins the misrepresentation suit. But their misrepresentation doesn't immediately cancel out their contract. It's just two different issues.

This is far more complicated than anyone here in the comments realizes. The whole reason ContentID and these AI copyright infringement tools even exist to begin with is so that Google and KZbin are not legally responsible for hosting content that contains copyrighted material. It’s all just for them to be able to point the finger at a user, legally speaking, rather than to be the responsible party themselves. It’s not like they did it just because they wanted to, they do it to avoid litigation

I don't use splice. I recently got an MPC and it has splice integration. I never even activated it because I was concerned about the legality of using it freely. This video helped clear a lot up for me. Thank you.

I love that you "nerd out" on this stuff and share it with everyone. We are continually bombarded with T's and C's whenever we buy, install, or demo anything these days. I personally don't know many, let alone any, that actually read everything before ticking that "tick" or "yes" checkbox. Love ya work!!

I have a friend who’s a lawyer and he always says that law school had very little to do with how to conduct a criminal trial and EVERYTHING to do with how to read this kind of stuff and make sense of it. 🙂

I am an independent musician. I play all my music, no samples. I had a strike when I turned on a delay-reverb effect during one of the songs I posted. KZbin refuses to remove the strike even though the effect I turned on has absolute immunity and does not apply to copyright infringement. It's like the music industry is trying to take control of all sounds that float throughout the entire universe. We need regulation upon the music corporate world, or next will be that the everyday speech from our mouths and tapping the countertop with your fingertips will infringe on copyright laws. Even laws that don't even exist. Read the last line again.

None of that has anything to do with the music industry, it’s the content id system, not copyright or even the music industry. It’s tech companies that designed this system.

@@ac3theartist225 The issue is that it is not a legal system whatsoever, and in fact it subverts US copyright law by its very design. It is against fair use, and it takes the livelihood from literally tens of millions if not billions of people just because it is poorly designed in every possible way. And they use the label “copyright strike” to appear as if they are some official arbiter of any legal system, but they are in fact a private company who false flags more people than probably any single system in all of human history.

Splice has been stomping hard in KZbin ads. I'm not looking to sign up though. Another KZbin personality offers royalty free samples, and I bought a pack. I found some of the music useful and started a project with a riff they made as space filler... A couple of days later I noticed they put a read-me file in the download, so I read it... After seeing that they want money after I have some success with the music I make using the sample, completly soured me on using any more services like Splice or Tracklib. I'm now making my own source materials, and I'll inspire myself. 😂

You just have to find the right loop packs that are royalty free (though some of those will have royalty splits too if you land a major placement or get over a million streams). I use splice personally but only for smaller things. Rarely full on melodies or drum loops. I really like splice for what I use it for and would have no issues with a major placement, but from talking with a lot of people that full on sample, they feel better about tracklib as you get built in sample clearance based off of what license you buy. You can also buy a basic license, then if the song blows up, you can upgrade so you don't have to possibly deal with any legal trouble. Basically the same way beatstars works. You lease a beat for fairly cheap, the song ends up blowing up, you go back and purchase the exclusive license, and now it's fully yours and you can copyright claim it and the seller takes the beat down. The seller then contacts everyone who bought the beat at a lower license tier and tells them it now has an exclusive. If you pay attention to the finer details and cover your bases if the song blows, you won't have any issues. The main problem is people don't want to go back and purchase the rights thinking no one will ever notice and that screws em over. Companies have the means to compensate the people who make the loops or to clear the samples, so you don't really have royalty splits. With loop packs, that's usually a single person or a collab so if it blows, they'll ask for royalties as that's part of their business. They don't have the backing of investors to eat the cost of their time they put into the loops.

Thank you. This is exactly why I have not worked with folks I knew would not invest in clearing samples. I have some royalty free samples, factory sounds, or I make my own..If you know how to use samplers for more than ripping records, you'll find they do so much more...

The cost of arbitration vs court is not just why companies force arbitration. It is a service that they pay a provider for, which likely makes the arbitrator a financially biased party because the service provider wants to provide arbitration services for all disputes. ABSOLUTELY, IMMEDIATLY follow the steps to opt out of forced arbitration.

This was really fascinating! Can you do a video about ghost writers/producers for EDM artists and in what way that relationship benefits both parties? I love EDM, but it just seems like some of these ghost writers may get really screwed over when they write a huge song and the artist gets all the credit.

I could never figure out why samples sounded different when you imported them into your DAW. Turns out splice were applying 12:1 compression at -24db and not telling anyone. This is unforgivable to me. I’d import samples and think “what was I thinking, it doesn’t sit” but I was sure it sat in the track when playing from the splice browser. To mess with producers’ instincts is a disgusting thing to do.

almost every single song in the billboard top 100 is using splice samples one way or another. Espresso by Sabrina carpenter is a splice sample. I would not worry about anything as long as you're using the samples creatively.

Is Sabrina Carpenter signed to a major label? The problem seems to be that these companies only pursue legal action on small independent artists that they know don't have the resources to defend themselves. Major label artists don't have this problem because the major label will just negotiate for the sample rights with the other label which alot of times is owned or associated with the artists label

Splice don't even create 99% of the samples and presets on there, there's no way they can claim ownership of songs using stuff they don't have the rights to unless they're also ripping off the pack creators? I can't see screwing over both would do them any favours

I find it really interesting beside the question of possibly not being able to use samples commercially that they also include presets in "Splice Sounds". I really wonder if there's any legal precedent for that - like can a preset (which is quite abstract as it can be used in so many different way) even be something that could be flagged for copyright?

@@elijahworden219that’s the problem… can’t make money off of something you can’t copyright without possibly being sued, but the catch 22 is whoever produced the sample/ loop gives up ownership to splice for it to be royalty free, however even after you download it and use it in a song, it’s still available on splice for others. Best bet is to just not use splice and actually make your own music

@@RAM_845 artists copyright their own songs. Unfortunately if it has samples, usually the first one that applied for a Content ID gets registered in the YT system. Everything after that using the same sample in a very evident might get a Content ID claim.

@@antiherorecords link me to the video will check it for sure. I was talking about a slightly different issue. I have seen it happen in the past. Artist A used a sample and Artist B who used the same sample later got content id claimed by Artist A. Though Artist B can get it cleared once they provide proof of owning the sample license as well. This is not Splice or any other sample library's fault, it's just how the YT content ID Claim system works. I myself got content id claimed for a song which I had license for. But the claimant was a cover song artist not the original 😂💀. We solved it later on email and the correct content id claim was registered to my video.

Great information. I personally do not use Splice . About 60-70% of the time my instrumentals are disqualified from youtube, TikTok & Facebook/Instagram content ID programs. I generally make my own presets and sound design. That is my thing. I opted out of content ID last few releases, still it goes through this content Id system. As I understand it, it is AI software used in reviewing tracks before distribution and seems sketchy, prone to errors from my musical adventures last 5+ years. Like who gave the rights to Google and corporations to be the Pinkerton's of Music?

So if you cannot re record for example sing a vocal with your own voice. .. what does this mean in the terms of "This means that you may modify, reproduce, publicly perform, distribute, transmit, communicate to the public, sublicense and otherwise use Sounds, including for commercial purposes." It says reproduce is fine

I just use the rent to own feature tbh. Not really into samples, I'd rather design my own sounds.

I'm a producer who make loads of samples that end up in Splice. I've always thought that the gamble of doing this is that you know that your samples could be used in huge records and all you're going to get is bragging rights. I wouldn't think I'd get the royalties or money from that record.

BTW some distributor platforms even have a special step of the release process where you are asked if the music contains samples from Splice 😀I've never used Splice so I always chose "No", but after watching this video now I understand why they have this (maybe to skip creation of content ID or other stuff that might contradict the splice license)

This is really great content. Thank you for posting this video. The part that I still can’t wrap my brain around for producers and people who make sample packs is that every sound you make came from another sound is copyrightable. So how did you actually draw this line. Because every sound was created by someone else or something else, do we draw the line?

Cannot believe they put a 'certified license' in for each sound. I've been using the platform for years and grabbing those for each sound I've downloaded is going to take ages. Such a sleazy move; they know it's a pain in the a--. They know most people won't.

I've been a TV library composer for the last 10 years I've clocked in over 370 tracks for various TV shows around the world and now my solution is to start again. I'm launching a brand TV library next month in Canada and I will only use live musicians, bands, solo artists. Minimal MIDI, NO SAMPLES, NO AI. if you can't play, or find someone to sing, you're not in. Every sound will come from the hands and voices of musicians. Say hi.

I hate that every time I login on a new computer or something Im not able to download my sounds unless im actievly paying the subscription. I should not have to pay everytime I wanna access the sounds I already paid for (also idk if they recently changed this)

What you do is take an audio sound loop sample and convert it to midi then use your own preset even if it's a splice preset or factory. Doesn't make sense because most of us use Splice for one-shots like a kick drum or snare or some sort of effect. How are they supposed to know when a kick drum sounds like a kick drum to a point that you're going to have similar sounding kicks. I also use it for vocals because I don't know any singers and even if I did they would still have to be willing to collaborate so it's not easy to find someone in your town or near by to record. I'm willing to give that singers vocal sample royalties if used for commercial use because it's a great way for a creator to make something out of that singers samples. A win for all involved but not for a fking drum one-shot. That's just ridiculous. Seriously this is how all these companies screw us. Contract Law. We need a decentralized system where no one can get in the way with these stupid contracts. It's called a CONtract because it's made by Cons abusing us legally when in reality you're not trying to deal with that and simply want to make music and distribute it to others in hopes to maybe earn a little money if even that. I don't think any of us have in mind when we create something that it'll blow up but if it's something that does all the sudden they pull out the bull shit contracts, that we HAVE to agree with in order to use the service. Will someone out there please create something better without all the Bull shit I'm tied of this fking red bull trying to constantly stick his BS up my a$$. Leave creators alone. Seriously I see a future of a world with no human art because the machine. Hey maybe that was what Terminator was actually really about because it sure feels like we're now in threat of these machines where's Jesus Christ I mean John Conner? You said Termination not once but twice as I read Terminator lol.

So maybe I am big dumb but what am I missing here? Title of the video seems to suggest Splice could be an issue; but, after watching the video it does not appear to be that bad. My takeaway is so long as you are using samples in a work that does not make up a huge portion of the song or make a main motif, you are ok. This is something I have been saying or suggesting all along. It also seems to show sublicensing for commerical works for the example of sync and for shows/commercials are fine too so long as you are keeping the same concept of not making an overtly derivative work of a sample. Also, you can't copyright the actual sound you use or remake or alter them for sample packs (which to me would be stupid anyway). Am I missing something?

Splice on its own isn't an issue, the issue is KZbin's copyright algorithms which will sometimes cause use of a sample to trigger a copyright claim because someone else already used it in a copyrighted song. Generally you can go through the process of getting this cleared but I don't want that hassle so I avoid it. Maybe if splice convinces KZbin to fix there algorithms I'll consider it

@simonlees2848 well you are talking about a whole separate issue with KZbin copyright as a whole. I would argue Splice is not the issue, KZbins copyright bots are an issue. I've seen and heard of varying accounts have take downs and strikes when the song is cleared for use or it's even the own creators track. I like KZbin as a platform for getting content, but it is shit to creators and awful when it comes to music copyright.

ultimately, it's not a critical video, but as a user of the service, it's still very important to know your rights. For instance, if these terms change at some point, you'll know what changed and have more context, and_or can defend yourself better if they choose to bring action against you or others in the future

this is partially one of the reasons why I never stick with sample based content. Because of copyrights. I know how these things kinda work. There for I usually create my own stuff from the ground up. Sometimes I use samples as one shots, and these are hard to copyright. Because you are dependant on how I wrote the rhythm down. And there is no copyright on rhythm. Because if it would, then music would stop today.

I'm only at 06:40 but with Content ID - as far as I know unless you own the copyright for the sample it is against Content ID ToS to add it to the Content ID database - which essentially excludes samples from Splice (assuming you don't own the copyright i've not gotten to that bit yet - but i would assume not?). Which basically everyone ignores and they upload to Content ID anyway which is why everyone gets flagged for it. Idk if you have done a Content ID ToS deep dive, but might be worth it. I of course could be completely misinterpreting that :D

It mentioned that you have the rights while subscribed to their platform, but you should download the licences (of each sound/midi you bought) while on an active subscription of Splice so you won't potentially lose access to your licences if you unsub or exit somehow. Hope that clears that up.

The whole remix thing, i remember that being a problem for samples, like Cymatics got their start ripping their samples straight from copyrighted music way back when and got caught and called out which was why alot of big producers at that time always said "fuck cymatics" but yheah they'd take that, repackage and sell their sample packs only for TONS of people to get copyrighted issues up until they still did (idk now i haven't messed with them since those incidents) but word of forums say they still do it they just ":remix" the samples and sell them and no legal issues happen

I only use Splice for theor rent-to-own plugins. And 9/10 if i ever use a sample any sort i just convert it from audio to midi and make it my own thing. But nothing against people who are thr slice and dice sample choppin wizards. Because thats what you are: wizards

If you’re making sounds and licensing them out, it’s just in the nature of what you’re doing that someone’s actually going to use it to make something. If it goes big, it would be nice for the owner of the music to share, but it’s kind of the “risk” you run
