Runkle of the Bailey did a video on the Canadian porch pirate thing. The short version is the statement the police released doesn't really hold legal weight. Even he said, there is no reasonable expectation of privacy when you're on someone else's property. A police official in Quebec had also mentioned the issue of a presumption of innocence. Ian Runkle in his video said that sure the government has to make that presumption, but a private citizen does not. He of course explains it way better than my paraphrasing does.

I would have thought that claim made sense, but I trust Ian if he said it's BS in Canada. In most, if not all, EU countries it unfortunately is correct, you cannot post any identifiable information about someone else online without their consent. Most countries had that law already in place, and I believe it's also covered by the GDPR now. However, it is not comparable with one-party consent for phone call recordings, which is legal in most EU countries. Recording a call vs making it public are different things.

Yeah he said you could be in defamation territory if you name and accuse the wrong person of being a thief. Even accusing the right person could go there, but only under very specific circumstances. BUT for the most part just posting the video isn't likely to lead to such a suit. Pretty much had the usual warnings against self help which is probably where the police statement was going and that the police statement by itself was mostly inaccurate.@@nero3700

The problem is you have to first prove they stole it. Them taking it does not equal stealing, in a legal sense. So if you post it first, before you prove theft, then you are still violating Canadian law. I'm not advocating for the law, just spelling out reality.

The Canada porch pirate statement was in response to someone getting a delivery alert, realizing from the picture that it was left on their neighbor's porch instead, and going to pick it up. Then finding out his picture was posted on social media with false accusations.

Done looking. No luck.... But consider what the statement was... Warning to people that posting the images CAN result in exposure to a defamation suit. No criminal consequences, and since the truth is the ultimate defense to defamation, if they were actually guilty... no liability. The only situation that the warning would apply is if you falsely and publicly accuse an innocent person of theft.

The missing context here is that picture was originally posted to Reddit by a building inspector who regularly posts the dodgy stuff they see on the job. My guess is this was a DIY job, and the person thought it looked tidier, gave them more vertical space, and that they had an IQ less than their age.

That bad plumbing is a spectacular hack job. You can already see the floor joists starting to buckle. It’s going to cost the homeowner a lot of money to have that drain pipe removed, jack up the floor, sister up all the joists, and then have a professional put another drain pipe in.

If little Timmy is below the age of criminal culpability then don’t bother with the cops. Many states that 10 years old and they can’t charge the child. In most states the parent won’t carry criminal liability for the actions of the child outside specific circumstances defined by statute. That’s why you don’t see criminal charges for the parents of juvenile murders.

Small Claims court would be the best option because it's cheap to file, you don't need to file a lawyer, just have proof. Easy to get from his employer. Along with cost to repair or replace. She could argue he shouldn't have put it down, but at the end of the day the little turd shouldn't be touching what isn't his. I'm a retail employee and I hate parents who let this happen non stop. They'll be looking at something while their kid is pulling stuff off the rails. They notice, stop their child and move to another section and repeat the process while I am staring daggers into that poor excuse of a mother. Yes. It's always the mother. Get the fuck out, be a parent and then maybe come back when they can be trusted to behave. Yes, she should pay for the phone.
