On this week's episode of RYGTBKM, a Toyota dealership in Arizona pays $60k to settle claims of false advertising on their Internet prices; a Nissan dealership falsely advertises the price of a used Tesla Model 3; and Stellantis lays off more workers and closes 3 of its business centers!

I just started a new case with the Florida Attorney General against all Autonation dealerships in the state of Florida. Since 2004 They have been charging a $199 tag agency / electronic filing fee on every single deal but the tag agency only charges them $74. On paperwork they make it look like those are mandatory statutory fees that you must pay with every single purchase. The customer never sees a penny from the kickback check Autonation gets from this titling company of $124 per deal. They have a hell of a side hustle going! They are deceiving the public and have been for 20 years. I’m going to take them to the cleaners. I hate to be the whistleblower, but I also hate to be taken for a fool. I was told by the GM at dealership I purchased two mustangs that the fees are convenience fees, even though they don’t state that anywhere. I am requesting they refund every single customer who has purchased a vehicle since 2004 from any of their Florida dealerships $124 each.

I lived for 47 years in a state that does not elect the Attorneys General (Tennessee). In TN it is appointed by the state Supreme Court. I also lived in CA for 20 years and now live in FL which elect their Attorneys General. The AG in TN seemed to be more proactive in consumer fraud and I suspected it was because AGs in states where they are elected are more easily bought off just like all other politicians.

Low mileage for a car 24 years old (last year). Now it's a classic at 25 years old. Dear Ray and Zack. Thank you for always posting informative and frank content. We live in Ventura County CA and unfortunately our state’s Attorney General has no desire or backbone to stop dealers from gouging the customers. I filed a complaint with his office about some of the similar crappy practices you guys talk about. His response, basically “car businesses in this state can do what they want and their office cannot dictate how they should conduct business “ which is why I see so many of these shady things still going on. I can give you multiple first-hand experiences but I am sure you are already know about all these unwanted add-ons, market adjustments (really? Even now?), low published price on sites such as Autotrader, only to say oops, was a mistake, etc. I have been in the market for over two years to buy. Pick up but refuse to buy with such unfair stuff going on, especially with Nissan, Toyota, and Dodge/Ram dealers near me.

If it’s an option, make a deal with a Midwest dealer that isn’t gouging. Many aren’t these days. Then fly to pick up your new ride and drive home, as several of my Cali and Florida friends have done. Or hire a car broker to make a deal for you. I had 20 different Chicago area Toyota and Mazda dealers pleading for my business last month. Ultimately drove off with a sweet deal on a CX 5. Tip: get the numbers in writing before making a trip. Eliminate those dealers who won’t.

Thanks for the suggestions. Perhaps it is my terrible luck. I have connected with dealers in all adjacent states and as far as Texas but when the moment of truth arrives, they are the same. It must be something inherently bad with how Nissan, Toyota, and Ram dealers operate these days. Not considering Ford/GMC for quality issues noted on many online posts.

All this money that the state makes from fines is chump change compared to the money they've been defrauding the customers. The customers should be getting their money back + interest, not the courts. These business's should be audited every 5 years - every sale. Each count of false advertising or fraud detected, they should face a separate charge for that. This will stop them in their tracks - the length and breadth of the country. Part of the problem in the USA is that ALL retail outlets put one price on the shelf for an item , but at the till, they add on tax. In the UK, this is illegal. If they charge 1p over the price advertised on the shelf, they can face fines so high that the retailers could go bust. If the USA made it law to include all taxes to the shelf price, customer confidence at grass roots would be much higher.

I've seen listings where the stealership lists a low price on a car aggregator site which triggers a 'great price' classification only to read the fine print it says the price is after a $2K down payment and/or a trade-in valued at a minimum amount. I find that deceptive. All paperwork, including gap insurance has an MSRP of 61 not 64, what changed? And nowhere and at no time was I informed the 1.9% financing didn’t include a $1500 rebate that was including in sales price advertised until after financing. Additionally, they advertise no fees that you only paid tax and title and provide you with out the door prices. I was in fact, charged document fees. Bait and switch!

I had an excellent experience where bought my car because the price advertised was the starting point and I was able to get my car for about $700 less than the advertised price. Everything we negotiated was down in paper and everything promised was delivered. I now understood why this dealership had such a high reputation. So glad people recommended me to use them. My car ended up being a few miles and a few days outside of their short warranty that they had for used cars but they still handled a problem that happened with my steering. Excellent service. Excellent customer service. I didn't feel super haggled or anything because the negotiation didn't take long at all. They allowed me to take the car to get it inspected. And I'm a woman that went in there by myself negotiating my car for the very first time. Wish there were more places like that. It helped that I knew the salesman but he was just an acquaintance.

There should be a law that states the price shown/advertised by the dealer is an "all in price". The price includes all add-ons, dealer fees, options, packages, etc. The only additions would be sales tax, government fees, state registration. These 3 not included as they are not taxable and the sales tax might be lower after the haggling is done on the out the door price. The all-in price would be the price where the haggling is done. And all purchase document would have a clause that if any other options or fees or anything else is added to the purchase document, where by "accident", or was "forgotten" the buyer can get them for nothing or can walk and get all deposits back. Also goes for leasing. The Real Total cost of the lease including deposit and buyout must be shown. And all in big bold type.

So why shouldn't people call for police to come and cite someone or perhaps even arrest the party committing an ongoing crime? Do you think it would make a difference if people started showing up, calling the police, and dealer staff/managers/owners left in handcuffs?

The $60,000 fine leveled at Toyota dealerships is inconsequential. When this sum is apportioned among all the dealerships, it amounts to a meager $5,000 per dealer. In the fast-paced automotive industry, where significant sums of money are exchanged and profits are substantial-especially over the span of a few years-such a fine is scarcely a deterrent. It is unlikely to have a meaningful impact on the business practices or the financial health of the individual dealerships.

Ray and Zack, I'm in Hawaii on the Big Island. We went into the local Jeep dealer, and we want a Jeep Gladiator. When at the dealership I noticed a $9995 markup. I asked why such a large markup up, and they told me its supply and demand for that model of Jeep gladiator. Watching car edge, I know Stallantis has a over flow of such vehicles. Is this even legal to do? The dealership is asking 10 grand more than the MSRP

tim dahule nissan try that same trash with me 5 years ago adding a recondition fee, on a used car. that dealership is just shady, its their whole auto group, they have 3 or 4 dealers in ut. that dealership is just shady. They said all do this the recondition fee plus the price of what they are listing the car for sale for, instead of just saying what the real price is.
@NVRAMboi
@NVRAMboi 5 ай бұрын
Ray has pointed out that any reconditioning costs are on the dealer (it's part/parcel of the used car business) AND SHOULD BE COVERED BY THE DEALER WITHIN THE ADVERTISED OR LISTED SALES PRICE. It can be difficult to be respectful to people who are so outwardly/blatantly dishonest.

What you guys never mention or talk about it and also a lot of people don’t know, is that in almost every state in the US, car dealerships are the top 3 biggest source of tax revenue for those states. That means one of the biggest industries that state has. For most is the #1 income a state has. Look it up and let that sink in for a minute. States will never get rid of car dealers and hurt them on purpose. Is like biting the hand that feeds you. These fines are nothing compared to 100’s of millions that the states make from the dealerships of any kind. People who think that manufacturers car dealers are going away are clueless. Unfortunately it ain’t gonna happen!

@@adama7752 I am talking about taxes generated from doing business in that state, income tax the dealership has to pay based on how much money they make every year. Taxes on profit of the business, just like a manufacturing plant or a restaurant business or me and you pay income tax to the state every year. I am not talking about sales tax, that’s on the consumer and unfortunately it’s a different story!

Zach. I think your wrong. I would bet that in many of the states that aren’t willing to go after the dealerships, the states have higher sales tax % for new cars or cars in general vs other goods that aren’t addictive type products. However payments and renting a car seems to be addictive to most.

I am suspect of any new Toyota. My 2022 Camry had a mapp sensor failure at highway speeds. Downshifted so violently it nearly left the highway. Faulkner Toyota said it was caused by a rodent chew. No evidence at all of wires chewed on. The only rodent under the hood of my Camry was the dealers technician. Excellent way for Toyota to deny component failures with their products. Cost me $300 to get my car back.
