ok i get, the owner sends a cease and desist to tell the enemy to stop using the trademark and by them using the trademark AFTER the 30 days of the cease and desist USES the trademark (which is a secret because the owner told them not to USE the Mark and they did) which this action is "Misappropriation of Intellectual Property" which is infringing on trade secret use the 5th Amendment because the government or state will USE the trade secret IP for public use/purpose and the enemy needs to pay just compensation to complete the provision even if they try the 11th amendment to get away from the law suit but little do they know the IP is an "Instrumentality" because its Registered trademark :) awesome Steve, thanks mann
