Just a query: from your first example of 'paratha wali gaali' , the orignal vendor did not got his trademark registered but still his trademark is valid in his geographical location, that means he should be protected in that location.. then can he file a case against the similar paratha vendors that opened in the same area? If no then why?

GI is a community right. Trademark is not. In the present situation , Gi is not feasible as only a single person is concerned.

After 2 years someone from jharkhand starts the same with similar feature and name, but he registers his trademark. After registering can he sue my company ? Plz explain. Thank you!☺

Hii Mam, One important query - is it safe to use "&" symbol in trademark, can any other person replace "&" with "and" while registering the brand. Kindly advice, it will be helpful.

You can use "&" symbol as your trademark, only when you apply for the registration. Once your application is approved, then the authority will automatically give protection to your mark, such that no other entity can name their mark as yours or similar to your mark. Unless you won't register your mark, the other entities can name their company similar to yours.
