Hi there, great video. What about an app that connects people to professionals (e.g. health professionals)? If the app is downloadable and offers a service, would it be Class 9, 42 and 44? I browsed through the Class 9 list and don't see a good fit. Thanks!

Yes, you pretty much nailed it. I'd recommend going after classes 9, 42, and 44. This will cost a few extra hundreds in government fees but will give you the broadest protection for your brand. Last thing you need is having to oppose someone else's trademark that the TM Office might approve in one of these classes-just because they didn't bother to draw all the necessary connections.

Fiverr's core trademark is in class 035 registered for the following goods and services: "Operating on-line marketplaces for sellers of goods and/or services"

Allowing advertisements is very different from offering advertising services to others. You only need a trademark in class 035 if you do the latter. Otherwise, get a trademark for what the app actually does (usually, class 042). Think about it this way, we all do a bunch of different things as part of our business (print documents, pay taxes, hire people, sell stuff). None of those things is what our brand is known for. You only want to trademark your brand for goods and services that you want the market to value you for.

Great question. The answer depends on whether you are going to be letting people use your software (in which case it is class 042), provide services to advertise and promote people's products and services (in which case it is class 035), or both (and then it's both). A good example of both 042 and 035 is Facebook that offers software and a platform for people to advertise their stuff.

Hey Robert. Talent agency services are covered by class 035. Serving advertising for others would also be 035. There may be some room for class 042 when it comes to the actual platform, but these are the classes I would focus on.

@@robertdavis3036 Not necessarily. Coming up with a proper list of goods and services is often more art than science. This is not something I would undertake via a public exchange on KZbin. But generally, what you want is to make sure your trademark application covers at least classes 035 and 042 so that you can block OTHER talent agencies from using a name similar to yours-even if you are not strictly a talent agency yourself.

What does the app actually do? If it's just a frontend for an online retail store, then your class is 035.
