At the outset, I must compliment for your simplistic explanation of the concept of 'Contribution' but the same is not in consonance with Sec 82 of the Transfer of Property Act 1882 which reads "Where property, subject to a mortgage, belongs to two or more persons having distinct and separate rights of ownership therein, the different shares in or parts of such property owned by such persons are, in the absence of a contract to the contrary, liable to contribute rateably to the debt secured by the mortgage and for the purpose of determining the rate at which each such share or part shall contribute, the value thereof shall be deemed to be its value at the date of the mortgage after deduction of the amount of any other mortage or charge to which it may have been subject on that date". You may kindly post a video lecture to assist us to understand this provision of the TPA-1882. Thank you.

Why we can not exhaust 10 L completely from istam property & then 17 lakh from 2nd property???
@DrAmitabhSingh3 жыл бұрын
Because law have a tendency to protect both the property .

Perfect lecture! One query sir, S.82 ka first part kya Keh rha. Jo concept se samjhaya hai contribution wo to 2nd part of S.82 hai right. Value of such share of part ke ratio me contribute kregi, jo jada value ka share hold krta wo nada contribute krega mortgage debt me right?
@DrAmitabhSingh3 жыл бұрын
Firstly deduct the mortgage money of property then make the ratio with value of second Property. In such ratio the properties will contribute.

@@DrAmitabhSingh ye to jab same owner apni dono prop mortgage kr rha ho. I am talking about the first case i.e. prop belongs to 2 or more persons having distinct and separate right of ownership. To sir kya wahan contribution unke shares ke ratio ke hisaab se hoga? For ex A has 20% B has 50% and C has 30% share in a prop. In payment of a mortgage debt of 20 lakh A's share will contribute 20%(4 lakh) of the debt B's share 50%(10 lakh) and C's share 30% (6 lakh). Am I correct?
