Virgilio Aguilar Mendez, an undocumented 18-year-old indigenous-Maya teen from Guatemala, is currently being held without bond in St. John’s County for a crime he DID NOT commit. On May 19, 2023, Virgilio Aguilar Mendez was on the phone with his dad outside the Motel 8 building where he was residing when Sgt. Michael Kunovich, an officer, approached him.
Sergeant Kunovich stopped Virgilio because he "looked suspicious" and he began yelling and interrogating Virgilio. Virgilio expressed he didn't speak English more than one occasion and tried to explain that he was residing at that motel and that he was eating.
Sgt. Kunovich escalates the situation by grabbing Virgilio by the arm, and tries to pat him down for weapons despite Virgilio not understanding what Is happening.
Virgilio resists, and is thrown to the ground. Other officers arrive on scene and wrestle him onto the ground. This leads to an 8 minute struggle where Virgilio was physically abused and tased multiple times. After handcuffing Virgilio, officers retrieved a pocket knife from his pocket that he uses to slice "sandia" or watermelon.
Moments after Virgilio is taken away, Sgt. Kunovich collapsed at the scene from a heart attack and later died at a local hospital.
Medical examiner ruled Kunovich died of a heart attack, and that "physical exertion and possible emotional stress while apprehending a fleeing suspect" may have contributed to his death.
Despite this ruling, The St. John’s County Sheriff’s Office and the Office of the State Attorney for the 7th Judicial Circuit of Florida have charged Virgilio with aggravated manslaughter of a police officer.

This is my first time ever posting something like this. As a daughter of immigrant parents this case hit so close to home, so I had to share this with you all. This is outrageous! It doesn't sit right with me that Virgilio may be convicted & sentenced for life because an officer had a pre existing medical condition and suffered a heart attack while on duty??? If it were a different scenario, if the officer was performing CPR or running after a suspect and suffered a heart attack and dies, should the victim or suspect be charged for aggravated manslaughter?
I want to keep this short. I can go on and on. But as of right now the petition has 548k signatures. Lets get it to 1 million.
