Part of the problem is that the definition of genocide is too vague and must be interpreted. For example, the ICC has charged Israel with genocide but it hasn't charged Russia with genocide, only "war crimes". Why? I think there is far more evidence of Russia attempting genocide than Israel. Both Russia/Putin and Hamas have claimed that Ukraine and Israel are not legitimate states, despite overwhelming, legally indisputable facts to the contrary. Russia has deliberately attacked civilians in Russia, hospitals, schools, etc with the intent of terrorizing and killing, these acts coupled with Putin's comments that Ukraine does not have legal sovereignty, and is really just an extension of Russia, is not only an obvious lie, but reveals Putin's genocidal means to make his point: he would kill or force into submission every Ukrainian so they must deny their identities as a non-Russian ethnicity. This seems quite clear to me to be fit the definition of genocide, even with its room for interpretation. Israel, on the other hand, is not trying to destroy the ethnicity of Palestinians (even though there is no such ethnic identity, so-called Palestinians can be any one of many ethnic peoples who live in what has been called Palestine since Rome changed its name from Judea int he 2nd century). Israel is not deliberately targeting civilians (if that were the case, it would also be targeting Palestinians in the West Bank as part of its mission of genocide). It has bombed areas known to be Hamas hideouts because it is a well established fact that Hamas attempts to hide its military facilities within civilian population for the very purpose of forcing Israel to either risk killing innocent civilians or failing to combat Hamas effectively. Since Hamas's vicious, deliberate attacks on civilians at the music festival in Israel, as well as on Israeli kibbutzim close to Gaza on Oct 7, 2023, Hamas, along with its stated charter denying the existence of the state of Israel, is clearly guilty of genocide. The fact that it isn't militarily powerful enough to actually carry it out successfully is not necessary according to the legal definition of genocide.
