@UK-Conscience
@UK-Conscience 3 ай бұрын
@@helenab7390 clearly the ICC were able to move fast when it suited USA and western allies to call out Putin as a warmonger with imperial ambitions. But in the case of 🇮🇱 it is obvious that 🇺🇸 want to enable their warmonger proxy to pursue their own imperial project to expand territory in the ME, making it difficult for the ICC to function. The "rules based system" of 🇺🇸 only applies to their enemy states alone. Pure hypocrisy.

@faywarnock2311

Mr. Khan, I have dedicated my entire academic and professional career on the issue of “evidence” - what merits strong evidence, how it differs from subjective opinions, how to appraise evidence and how to apply evidence. I have applied the rigorous standardized process of ascertaining/evaluating/interpreting best available evidence to my own research and to the teaching of students. I agree the process should/ought to be careful and rigorous. Drawing valid/reliable conclusions are dependent on such rigorous. I doubt the processes used in law differ much. Data is data, one cannot allow contamination, or biasing effects (of which there are many) to distort verifiable truths. The analysis of data is complex. Of course as we all know, there are clear criteria within international criminal law that sets out the determination of “probable” genocide. In addition, to determine culpability or direct causation to the heinous crime of genocide one must consider the concept of intentionality - that is to determine if the accused knew the crimes he/she committed would inflict direct irreparable harm to the victim and if the accused operated with malicious intent to cause the harm in advance (premeditated). The host asked important questions. I was not strongly convinced Mr. Khan was as forthright as he could /should have been. It is insulting to hear the process takes time, I think we respect the rigorous nature of the process. But, seems there are biasing effects that must be exposed - otherwise any conclusions drawn are faulty. For example if there are pressures outside that exert/shape the outcome, the decisions will not be based on evidential truth.
@UK-Conscience
@UK-Conscience 3 ай бұрын
@@faywarnock2311 With all due respect to your knowledge and experience in this field, but Karim Khan KC as the prosecutor could not (should not) offer commentary (let alone judgements) on the culpability of the perpetrators beyond indictment papers nor the judicial process. Otherwise he would be castigated as being biased and unfit for office by powerful forces seeking to oust him. The delay in the ICC decision is entirely down to the judges, their integrity and stamina to withstand threats and pressure in upholding international law.

The evidence, in this case, is clear from the mouth of the beholder and the many many clear videos uploaded by the criminals themselves, on top of all this the occupiers have no right whatsoever, Do the Nazis have the right to defend themselves? Were the allies resistant to terrorism? Netanyahu clearly said no Palestinian state under his watch regardless of what the whole world said including the hypocrites, isn't this clear evidence of his intent?
@faywarnock2311
@faywarnock2311 3 ай бұрын
@@UK-Conscience thank you - and yes, assuming the entire process is free of bias and contamination- it will come down to the integrity and courage of the three judges. But, why place the judges in such potential life threatening circumstances? Why let them carry such a heavy burden of responsibility? Why would the ICC not have safeguards to protect their judges? Why would the judges be forced to “fly on their own”? If there are forces placing undue pressure on the judges then it is no longer an issue of evidential procedures and processes. Rather, it is an issue of our global responsibility in protecting truth and in protecting the defenders of truth.
@UK-Conscience

@@faywarnock2311 You cannot safely assume that "the entire process is free of bias and contamination". The previous ICC Chief Prosecutor Fatou Bensouda was threatened in 2021 by 🇮🇱 intelligence agency to drop war crimes probe with full backing from 🇺🇸& 🇬🇧 (pls google details). The hypocritical West forces international judges to "fly on their own" when it suits them, unlike in the case of Putin of Russia. Hence definitely an "issue of global responsibility" which you are witnessing at the UN but blocked by the usual suspects of the West.

The UNSC should be abolished, and all issues should be addressed directly by the UNGA, eliminating veto power for any state. Decisions should be made through UNGA votes, with the ICJ serving as a legal resource. This restructuring would ensure a more democratic and fair approach to global governance, free from the undue influence of powerful nations. It is imperative that the UN evolves to meet the challenges of our time and uphold the principles of justice and equality for all.
@xThronex
@xThronex 3 ай бұрын
The veto exists because the US demanded it, threatening to have nothing to do with the UN and to dedicate resources to undermining it otherwise. UK, Russia and China likely held similar positions. It's absolutely indefensible, but unless the rest of the world is willing to come together and say 'no more, or we disband the UN', nothing will happen to it.

This UK prosecutor was dragging his feet on investigations about Palestine before Oct 7. It was under huge pressure that he finally made a move. But when he requested an arrest warrant for Netaneyahu, he made a press conference about it - an unconventional move, unlike how he handled the case of Russia. This attracted huge attention - including that of Western politicians. Then UK and other governments interfered to stall the actual issuance of the warrants; Amercan politicians threatened sanctions on judges. Five months on the ICC is still considering whether to arrest Netaneyahu. I don't trust this man at all.

Why are so many critical of Karim Khan? Khan has done the job by seeking an arrest warrant from the court. He is the only prosecutor in ICCs history who has requested such arrests for Israeli leaders, and is helping to break up a practice that has previously given Western countries special advantages. Moreover, the fact that he announced in advance that he intends to issue an arrest warrant is only a positive. He has indirectly informed the media and the world that it is the judges of the ICC who are responsible for making progress in the case and holding the Israeli leaders accountable for their criminal actions. If the media do their part, they should focus on why the judges are taking so long to rule on Khan's request and whether there is anyone on the judging panel who may be influenced by Western interests. Khan has done everything correctly, within his scope. It is reassuring that we have at least one person in the ICC system who is concerned with genuine justice and equality before the law.

Good questions asked by the journalist, but she should have pressed him more on the deadline when he started saying that the court did not have endless time to make their decision. How long can they take before the court is shown to be a charade?

The prosecutor said; we don't have jurisdiction over the countries but we have jurisdiction over the individuals. The question is: are the individuals acting in an empty vacuum or they are acting in the name of countries using the tools and state craft of the countries they represent?

Sadly, despite the high hopes and aspirations that the ICC would finally bring justice to the victims and punishment to the world’s most serious war criminals, with people like Khan in central positions, the ICC is plunging into ever-deepening decay and regrettably assisting in its own suicide

The TRT journalist did an excellent job of trying to pin Mr. Khan down, especially on the issue of time. Why is justice taking so long? Most informed world citizens suspect the Court, after all, is very political indeed.
