Mr. Khan, I have dedicated my entire academic and professional career on the issue of “evidence” - what merits strong evidence, how it differs from subjective opinions, how to appraise evidence and how to apply evidence. I have applied the rigorous standardized process of ascertaining/evaluating/interpreting best available evidence to my own research and to the teaching of students. I agree the process should/ought to be careful and rigorous. Drawing valid/reliable conclusions are dependent on such rigorous. I doubt the processes used in law differ much. Data is data, one cannot allow contamination, or biasing effects (of which there are many) to distort verifiable truths. The analysis of data is complex. Of course as we all know, there are clear criteria within international criminal law that sets out the determination of “probable” genocide. In addition, to determine culpability or direct causation to the heinous crime of genocide one must consider the concept of intentionality - that is to determine if the accused knew the crimes he/she committed would inflict direct irreparable harm to the victim and if the accused operated with malicious intent to cause the harm in advance (premeditated). The host asked important questions. I was not strongly convinced Mr. Khan was as forthright as he could /should have been. It is insulting to hear the process takes time, I think we respect the rigorous nature of the process. But, seems there are biasing effects that must be exposed - otherwise any conclusions drawn are faulty. For example if there are pressures outside that exert/shape the outcome, the decisions will not be based on evidential truth.

Otherwise he would be castigated as being biased and unfit for office by powerful forces seeking to oust him. The delay in the ICC decision is entirely down to the judges, their integrity and stamina to withstand threats and pressure in upholding international law.

But, why place the judges in such potential life threatening circumstances? Why let them carry such a heavy burden of responsibility? Why would the ICC not have safeguards to protect their judges? Why would the judges be forced to “fly on their own”? If there are forces placing undue pressure on the judges then it is no longer an issue of evidential procedures and processes. Rather, it is an issue of our global responsibility in protecting truth and in protecting the defenders of truth.

The veto exists because the US demanded it, threatening to have nothing to do with the UN and to dedicate resources to undermining it otherwise. UK, Russia and China likely held similar positions. It's absolutely indefensible, but unless the rest of the world is willing to come together and say 'no more, or we disband the UN', nothing will happen to it.

I understand that the judges are under tremendous, indescribable pressure and likely are facing serious threats and blackmail possibly concerning also those close to them. However, the principles of international law and faith of people in the law are at very stake here. Personally, I am on the brink of loosing faith in ICC and ICJ. If arrest warrants for the monstrous Nut and his crime partner are not issued withing the near future, I will have to declare that justice has been murdered in Gaza, bleed out and buried under the ruble.

This UK prosecutor was dragging his feet on investigations about Palestine before Oct 7. It was under huge pressure that he finally made a move. But when he requested an arrest warrant for Netaneyahu, he made a press conference about it - an unconventional move, unlike how he handled the case of Russia. This attracted huge attention - including that of Western politicians. Then UK and other governments interfered to stall the actual issuance of the warrants; Amercan politicians threatened sanctions on judges. Five months on the ICC is still considering whether to arrest Netaneyahu. I don't trust this man at all.

The UN gave upon the rule of law when it took no action against Israel who were supporting the expansion of settlements in the West Bank and took not enough action when Russia invaded Ukrain and occuptied Crimea. The crisis which is leading us towards world war 3 is the result of UN inaction. UN is going the same way as the League of Nations which preceded it.

Why are so many critical of Karim Khan? Khan has done the job by seeking an arrest warrant from the court. He is the only prosecutor in ICCs history who has requested such arrests for Israeli leaders, and is helping to break up a practice that has previously given Western countries special advantages. Moreover, the fact that he announced in advance that he intends to issue an arrest warrant is only a positive. He has indirectly informed the media and the world that it is the judges of the ICC who are responsible for making progress in the case and holding the Israeli leaders accountable for their criminal actions. If the media do their part, they should focus on why the judges are taking so long to rule on Khan's request and whether there is anyone on the judging panel who may be influenced by Western interests. Khan has done everything correctly, within his scope. It is reassuring that we have at least one person in the ICC system who is concerned with genuine justice and equality before the law.
