Got stopped at Wetherby a few years ago towing a container trailer. After a lot of inspections I was told I could go but they were arresting the trailer. Phoned the boss up with phone on loudspeaker and he went into a tirade of swearing , all of which was heard by the inspectors. He called them wankers, bastards , arseholes etc. They said they would pay him a visit. Made my day, I didn’t get fined.

Towards the end of my shift I had to make a delivery. I knew (having made deliveries there before) that the possibility of running out of time (15 hours) on site was too risky, so I parked up early, and I'm taking 11 off. This load can wait until morning, I'm not taking the chance for nobody to have points on my licence or a fine, luckily my boss will back my decision all the way, feel really sorry for drivers who are pushed to go over their hours. Remember, if it can't be done legally then don't do it, no matter who is telling you to do it, it's your licence not theirs ..... record calls on your phone, they don't expect that, and keep supporting texts, and screenshot them. Stay safe, stay legal, keep the country moving. Also, you can drive into any DVSA / VOSA checkpoints and talk to the guys, they will listen and advise, They know the law.

Your spot on you should never go over your hours knowingly, in some circumstances where the situation is beyond your control such as caught up in an accident or traffic jam it can happen so keeping a record of this by making notes and taking a printout will provide evidence if you get a pull. 👍

Got done by a dvsa officer 3 months after I ran over my working time. Still had printout signed dated and documented as to my reason for my infringement (accident at next junction) was given fine regardless and informed any explanation despite how its is commonly deemed as an exception to the rule is purely at the discretion of the officer at the time. "Further note I was extremely plesent with the guy the entire time."

Your tacho will flash at you 15 minutes before you need to stop, but it is important to monitor your driving hours because depending where you are, in a city, on a motorway, 15 minutes might not give you enough time, the fine is hefty if you go over your hours without good reason such as being stuck in traffic due to an accident. It is better to take your breaks sensibly and not push the clock to the limit. 👍

Can I ask one question? If that happened, that you passed 13h of work for 10-30min or even hour, what kind of rest you will do then after that printout? That one of 11 hours? Because lets assume you wanted to do 13h of work and 11h of rest, but that happened that you passed planned hours

Still not sure what you mean charles, if your not driving a truck the tacho card shouldn't be in it, when you re insert the card after say a week, it will continue to register your driving hours from that date, perhaps I am not on the same wavelength as you because I don't know all the details of your job, sorry buddy.

good advice ,but dvsa could still fine you despite what you written on a printout.We had a driver who was over by 20mins due to road closure/accident from his depot, did printout/reason on rear still got a £200 fine.Was stopped 9 days after.

Thats bad that he was fined what is the point in keeping printouts for 28 days if the explanation you put on them means nothing? I would recommend doing a printout all the same and even keep a drivers diary with all incidents for each day its your best chance if stopped.

He should have went to court. From personal experience. If you have a good reason they won’t bring you to court due to the cost of doing so. The problem is that drivers mouth off to other drivers. That they done this and that. Instead of going to court to explain themselves. 20 minutes is only 5 minutes over the acceptable amount of time they tend to give you.

I know this video is rather old now. But what you also forgot to mention is that this will also cause you to get a 2nd infringement the following day too. It will add these 2 days of driving together (the day you got the infringement and the following day). So it will then show you have done too many driving hours at some point during the 2nd day. I do a 2nd printout to also explain why you have another infringement the following day too. Hope that makes sense.

It's a good point Rob, but after taking your rest period before starting your next shift the following day the slate should be wiped clean, it would mean that you could not start your next shift until a sufficient rest period has been taken, for example if you were due to start your next shift at 7am but your rest period will only allow you to start at 9am because of being over hours due to something beyond your control the previous day, then you cannot start driving until 9am, if you started your shift before 9am, that would be an infringement to the tacho rules. The Printout from the previous shift is to show that on that particular day circumstances that were beyond your control caused you to go over your hours, but you would still need to take the legal rest period before starting driving the following day. That is how I understand it, I would like to hear if you think I am wrong with that assumption, thanks for the comment Rob 👍

@@BritishTrucking Yea I know what you mean. We use Tachomaster and it shows up there as you effectively haven't had enough rest in the 24hr period due to going over your shift time. We use Tachomaster and I had this exact thing happen just last week. Went over a 15 by 1 minute in the services whilst parking up. On downloading my card it showed this infringement plus the following day at 1742hrs as it had added the 2 days driving together on the grounds that I hadn't had enough rest in the 24hrs. When in fact I officially really only needed 9hrs off, respective of the fact I was over my previous day by 1 minute. I had in fact taken 10hrs off. Cheers Rob.

That is where the Printout is important, where you can provide a reason for any problem encountered that caused you to go over your hours. It can be produced to any relevant agency such as the DVSA, In that particular case, I would probably do a printout and write on it, "over hours by 1 minute due to finding safe parking" you can then produce that if you are stopped and also provide a copy of it to your transport manager for example. Obviously we all try to get it right all of the time, but sometimes things go wrong, so basically if in doubt do a printout, I used to be a poet and didn't know it!!! 😂 👍

You forgot to mention that the printout needs two important things as well as a brief explanation as to why you went over your working time. The date and your signature.

As far as I am aware with researching it they can only issue fines for offences commited in the prior 28 days which came into force last November.

@@doms6741 Don't worry the data on your card will remain until you next work even if its months or years the data is only relevant if you were to be stopped and checked so any infringements can be found easily and quickly by the police or DVSA, Companies download data so they can advise you if there are any issues relating to your driving from the last 28 days and offer you training if necessary. you are all good don't worry about it, the company you worked for has to download the tacho unit every 90 days so that information will go through. when you start working again download your card to clear any data on it and start over.

Yep. The dvsa have a traffic light system for all companies. Red, Amber and Green. If you are unfortunate enough to work for a crap company (RED) who constantly flouts various regulations then do expect to be stopped.

A printout is for the drivers benefit, if you went over your hours due to an accident before parking up and you were stuck in slow moving traffic until you could find a safe place to park, a printout is a record of time and date, then if you were to be pulled over by DVSA 2 weeks later you can check your printout which you would have filled out with reason of going over hours to explain to the DVSA, on a certain day at a certain time i was stuck in traffic on the A49 before i could find a safe place to park for example, that way the driver won't forget what the reason was, plus the DVSA then have a record they can check to see if there was an accident.

If you have a legitimate reason for going over your hours, such as stuck at an accident, take a printout, sometimes it is impossible to comply to hours when it is out of your control. I agree that blatant driving over hours that is avoidable will get you a fine, it is only in extreme circumstances that you have to go over your driving hours. 👍
