It was put forth by the attorneys before the trial. The judge ruled against the immunity and because there was already an immunity ruling being decided in another case Trump couldn't appeal this immunity ruling. The scotus ruling came out before he was sentenced and the attorneys filed a new appeal based on that ruling. Rather than making any ruling on the immunity matter the judge just kept delaying the sentencing. He finally ruled on immunity in December which is why Trump is now able to appeal that ruling. Since a matter related to immunity normally must be decided before a trial even happens, let alone before sentencing, it's clear that this appeal needs to be addressed before he can be sentenced.

This should be conditional discharge rather than unconditional discharge (also he should have been disqualified because of section 3 of the 14th Amendment, which means that he is ineligible to serve, without a congressional vote, to serve because he is an adjudicated insurrectionist).
