@biscotti4017 I have read about that case. His parents were here legally. Big difference, but even still they were foreigners. He should not have been allowed to become a citizen by birth. Senator Howard was very clear about this. I hope that their decision is overturned. This is akin to the magic Cervix. Where someone magically becomes human after being born in some people's opinions. One of your parents need to be a citizen in order for you to be a citizen by birth.

SCOTUS looks at the intention of the founders and documentation of that time to interpret the meaning. There is documentation to backup owning automatic weapons because there were automatic weapons like the Puckle and the Chambers. Plus there was private ownership of cannons and warships. The ruling is obviously wrong because just as an example, if two American citizens have a child in Spain, that child is an American citizen because the two American citizens being under the jurisprudence of United States as mentioned in the amendment -thus transfers American citizenship to the child. To illegal aliens in the United States cannot transfer citizenship to the child because they are not under US jurisprudence. But liberals love to act stupid when they read the constitution and say that the 14th amendment guarantees same-sex marriage where it doesn’t say anything about that and also birthright citizenship -where the constitution has a qualifier along with it.

All Congress has to do is add a few words to section 1 on the 14th amendment The new sentence shall read, "All people born or naturalized by the citizens of the united states, in the United States..." This will define the amendment and it will not change it

Exactly! Birthright citizenship is greatly taken advantage of = Anchor babies, Chn "Tourist Babies", misinterpretation of the 14th Amendment, taking advantage of taxpayer money and resources. Every other country the child’s citizenship is determined by the nationality of their parents rather than their place of birth. Many (certain country's) nationals come here to have a baby, leave back home, pay no taxes, then come back to reap all the taxpaying rewards for their child and retire here. They need to pay their way like the rest of us.

They are, in fact, subject to the political jurisdiction (and allegiance) of the country of their parents. The same applies to the children of illegal aliens because children born in the United States to foreign citizens are citizens of their parents’ home country.

It's a little more complicated than stealing a car. Add a house, free money, access to American rights (which get abused), social protections (that actual citizens don't get) and an attitude that intends to shove American culture aside, instead of meshing with it. It's not kind, no, but that's not the point. To reduce what's happening to 'stealing a car' ignores all the burden and assimilation Americans go through for this to happen. 12 Eggs are 18 dollars in places. We can't afford houses, barely apartments. I work with people who refuse to learn English and make fun of me when I try to learn theirs. The balance is way off, and america has decided through the vote that enough is enough.

A french woman giving birth in the US doesnt make the child American because the woman is French and not in our jurisdiction. @JZH10000 No. It's the U.S. Supreme Court's job to interpret the 14 Amendment. Obviously, Congress did its job in 1868 when it proposed the amendment, the states ratified it, and it was adopted into the U.S. Constitution.

That law doesn't take into account the circumstances of today, which is a loophole abuse. The spirit of the law was to protect Americans who are here naturally and those who come legally. Back when this 14 Amendment was made on June 8, 1866 there were slaves born in Africa brought to America. Note: The 14th Amendment, ratified in 1868, extended citizenship to freed slaves and their children. Today there is mass illegal immigration very different from the 1800's were there was not many immigration laws at all. If you have a baby in France while being in France that does not make your baby a French citizen. You have to have one parent a national citizen before the baby can be a citizen. HELLO? If your traveling to Russia and have a baby that does not make that baby a Russian Citizen unless one of the parents is a Russian citizen. HELLO? ANYBODY OUT THERE LISTENING? The children of foreign nationals who haven't become citizens themselves are not covered under the Fourteenth Amendment, as they're still subject to the jurisdiction of their home country. To prove this theory, when foreign diplomats come to United States and subsequently have children, their children do not receive American citizenship. Ask yourself why?

Too many women come from all over the world as a tourist when they are 9 months to give birth in the US. Also, there are companies that set up homes or hotels for women just to give birth in the US. There is too much fraud going on. But all these fraudster's babies are all US citizens? Does that seem right? The solution should be that nobody should get aid or money unless the parents are citizens or legal.
