The part of the Constitution that guarantees citizenship is the Fourteenth Amendment, Section 1, also known as the Citizenship Clause, which states that "All persons born or naturalized in the United States, and subject to the jurisdiction thereof, are citizens of the United States and of the State wherein they reside."

@@NURREDIN yeah well aware. The Supreme Court just needs to interpret it differently. No amendment is necessary. There are restrictions to free speech and gun ownership as well due to interpretations. Executive action, lawsuit, Supreme Court rules only applies to legal immigrants… done. No laws or amendments necessary

You need to get your facts right. Its not for illegal immigrants alone. He also said for legal immigrants as well. According to him at least one of the parent should be Citizen or have a permanent resident permit. Anyways, he won't be successful in constitutional amendment. Don't worry.

@@airavata7yeah fact checker I have written in the context of this video where it shows potentially 1.6 million Indians origins born in US to see a risk to their citizenship which is incorrect. I understand he spoke about only Citizens and PR holders children’s will continue to have the opp for birthright citizenship but he has not spoken about retrofitting his policy on the child of person with visa. Nevertheless it’s an uphill task that might never see the light of the day.

Firstpost gets it wrong. President elect Trump said - abolishing birthright citizenship for illegal immigrants; not legal immigrants. He could further propose at least one of the parents need to be a green card holder or a US citizen for the child to have birthright citizenship, which is absolutely fair.

@@airavata7 Birthright citizenship SHOULD only be for citizens' and green card holders' newborns. These are the only two groups of people who can be drafted by the USA - and are therefore "subject to the jurisdiction". President Trump's interpretation IS how it was intended when written. He's not "changing" it - he is making a correction to the abuse that's been going on.

The USA constitution is supreme: The 14th amendment says you can gain citizenship ‘with jurisdictions’. Being illegal in USA has NO jurisdiction therefore one who is illegal in USA and have a child in USA will not be illegible for birthright citizenship if the 14th amendment is challenged for clarification. Ukraine and Israel both have restricted birthright citizenship, as do Egypt, Sudan, Iran, Pakistan and India. Suriname lacks a birthright citizenship policy, and Colombia has a restricted policy. The Bahamas & Haiti do not have a birthright citizenship policy, also the Dominican Republic who do not give citizenship if the parents are illegals.

Its a well known tactic in Nigeria. If you hv money, visit America few times, time your pregnancy such that you are in America during childbirth and boom, you hv a child thats American citizen. You have to legalized in America are an American born here for people to have legal citizens ship. So if I get a illegal immigrant pregnant my children because of me being an American is a legal citizens. Now two illegal citizens who have a child in America so that child is an illegal citizens still. Why because they are trying to use the law about not breaking families up to gain legal citizens ship. If that was the case then everyone who come to America and have children so they can't get deported. There has to be a law that prevents this from happening so Those that are coming to America and filing the right paperwork to be an American will have the opportunity. I'm for a law that will prevent people coming to America and having kids so they can stay. I'm American Mexican and I believe people from Mexico should by filling out the right paperwork to become American citizens not illegal.

To eradicate a law in the constitution will only open the door for others to eradicate other laws from the constitution, such as the second amendment. You cannot have it both ways where one believes and argues in the constitution, and argues for second amendment rights but then turn around and eradicate a law from the constitution that they do not like.

The 14th Amendment was for the slaves not immigrants. "Under the jurisdiction thereof" is a phrase that appears in the Fourteenth Amendment of the United States Constitution. It means that all people born or naturalized in the United States and subject to its jurisdiction are citizens of the United States. The phrase "subject to the jurisdiction" of the United States originally meant people under U.S. sovereign authority. This included everyone within U.S. territory, with the exception of foreign diplomats, foreign armies, and native tribes. The slaves were under the jurisdiction, immigrants are not.

The report disnt say a word about the foundation of US consitution. Its not just simply words. The founding father recognized that in order for the constitution work, there must be some condition. The moral fiber of the society. If the society turns into corrupt in general then no words in the world can save the society as we have seen thru history without execption. Another law says if parents are US citizens then kids are too. So best for this to stay not the automatic by birth citizenship. Poeple from other countries just to give birth so their kdis are citizens. It is misused. India doenst allow a kid to be India if they come on visa and give birth in india.

You people have OBVIOUSLY never read the Constitution. The part of the Constitution that guarantees citizenship is the Fourteenth Amendment, Section 1, also known as the Citizenship Clause, which states that "All persons born or naturalized in the United States, and subject to the jurisdiction thereof, are citizens of the United States and of the State wherein they reside." It DOES NOT say that the parent must be a citizen.

She is correct, this will impact even legal non-permanent residents (e.g HB visa holders). Birthright citizenship will only apply if one parent is either a citizen or legal *permanent* resident(green card holder)
