Thanks so much for all the positive comments! Just a few quick clarifications: -We do expect to be fully reimbursed for the repair (minus the $6,400 deductible) by our cargo/transit insurance company. If we do not we will certainly let you all know. -Ultimately it probably is on the shipping company or their insurance or another third party for the damage however, in order to get payment for the deposit from our insurance company they required us to sign a subrogation form meaning we relinquish our rights and give them to our insurer to pursue the matter on our behalf. -We think it is crazy that we owe a $6,400 deductible for something that happened before we even touched our boat especially when there was an option to sign up for a "Deductible Guarantee" program offered by the shipping company that was not presented to us. This is in addition to $4,000 airbnb because we could not stay on the boat in the yard. Insurance refused to cover this expense.

To put it bluntly, insurance companies suck! They take your premiums and then when it’s time to pay out it’s a major hassle! Glad you were able to get the boat fixed.

As a retired attorney I can tell you that your situation is not at all unusual. If you look around at insurance companies, they and the financial institutions have the swankiest corporate offices in most cities. Whose money has financed these fancy digs, but their policy holders. So either the premiums and deductibles are too high, or the written coverages and actual payouts too low, or both. I did not specialize in the field, but I can say with some assurance that insurance companies are in business to make money and pay the smallest amount they can legally get away with on claims. They count on the fact that most policy holders don't read their policies, even the summary declaration page, and have no experience in dealing with claims. Without state laws and insurance regulators, the policies and payouts would be even more egregious and harmful to the innocent consumer. You are not coming out whole (given your deductible and housing expenses), but then had you been more properly informed, you may have taken the risk anyway in light of the increase in premium to have a lower deductible and housing coverage. I agree you should have had the option upfront.

The shipping company should be required to foot the bill for shipping damage. At the very least, cover the insurance deductible. 🤦‍♂️ Congratulations on finding one of the elusive glass balls.🔮 Thank you for sharing.

You have to pay a separate ins for damage during shipping to the shipping company or its all down to you IE if the ship catches fire and you do not have shipping ins you will get ZERO

Agreed, it comes down to integrity, ethics, morals. When a company is responsible, they should fix it, plain and simple. If they don’t, their reputation will ultimately be damaged.

It clearly states that its the property's owner who is responsible to insure the goods while on the ship ! If you don't IE when the container ship grounded in the Suez canal if its not insured and you want your goods it will cost you 10's of thousands to get your goods or just swallow hard and let them go its all very clear in the terms and conditions of anything being shipped at sea. @@marc_aussie

This is a massively important video! Everyone should be aware of the pitfalls of buying a new yacht, and how to protect their investment. The 'Lessons Learnt' should be watched by everyone. Even if the cost of repairs and your up-front costs are reimbursed, people should be aware that they made to spend many weeks in alternative accommodation, which s not covered. Thank you

Contact the insurance commissioner of the state insurance was issued. Insurance companies will fight you on claims. I’m not sure how boating insurance works. But educating yourself on your policy is a plus. The shipping company should cover everything as it was them that did the damage. The insurance commissioner over looks all insurance companies in their state, and they maybe able to help recoup more of your loss. Good luck. Thanks for sharing your experience. Love the videos

this must be an American style insurance sytem. In Scandinavia the insurer would pay the repair yard as soon as the surveyor has given hi/her opinion on the damage and an approximate cost. Poor guys across the pond! You should get some boating organisations together and target the insurance companies to get their shit together and not try and hold off the repairs by not releasing the funds. i own a trucking company--if there is any shipping damage we pay--we have insurance for any major loss and they are good about paying it--we do not screw around paying for the damage and we train drivers not to accept any damage done while loading or if the receiver damages the freight while unloading--it can be a pain but its part of the process

Name and shame any company that doesn’t deliver what’s owed. Both the boat company and insurer are responsible. Others considering buying from this company or insuring through the insurance company should reconsider.

Something I do not understand is that you should have taken full ownership of the boat only after Seawind completed the commissioning. This means the shipping should have been under Seawind responsibility and Seawind should have delivered to you a spotless unit with any damage fixed by them before selling away.

Unless the boat is "sailed away" from the factory, Seawind doesn't do the commissioning, the buyer's dealer does. Seawind sells the boat to a dealer, who subsequently transfers it to the buyer, with the transfer happening when the boat leaves the factory in Vietnam. The dealer/buyer arranges for the transportation/shipping of the boat from SW's factory to the destination.

@@Alsinsin A judge would not find non-acceptance of delivery of a yacht due to damages that do not effect the functioning and operation of the yacht to be reasonable. So if not accepted, the manufacturer could sue the original purchaser for failure to comply with the purchase contract, so original purchaser would be forced to accept a damaged boat or the boat would be sold to another, and any shortfall in the resale would have to be covered by the original purchaser.

Seawind HAS to have some liability, at least they should NEVER allow anyone to use that shipping company. This is crazy.

Why? Once it leaves the factory, be it with the owner, delivery skipper or on a ship, Seawind aren’t responsible for what happens. This is 100% on the shipping company.

If not the manufacturer then the dealer needs to correct this. What if your new Toyota was damaged during shipment? Is it reasonable for you, as the customer, to accept delivery and then fight with the shipping company? No.

I bought a new C&C Landfall 35 in 1984. The mast was lost intrasit. I dealer had to make good on having a new one build.

@@stan4d1969Again, it depends on the sale contract but once it leaves the dealer’s forecourt (as in the case of a car), if you organised the delivery method then you’re responsible for the vehicle in transit. That’s the whole point of transit insurance. The person / parties responsible for shipping will be the contact for the shipper so if it was the buyer that organised it, there’s not a lot the dealer can do. In saying all that, I am surprised the shipper has a deductible on something they absolutely caused. We had to have similar insurance when we shipped all our goods to the Carib and when things went missing, it was on us to deal with the insurance.

Ownership of the boat transfers to the dealer or the buyer when it leaves their factory. The commissioning at the destination is done by the dealer, not Seawind.

Had Razzle Dazzle in the same spot on the same foam blocks 12mths before you. Bridgeport stuck to their quotes despite scheduling challenges and were very flexible on getting stuff done. Recommended.

Some insurace companies will not pay you in full until you get a lawyer. Then, they pay promptly to avoid legal fees.

Been watching for quite a while, finally subscribed today.. I started working in a fiberglass boat shop when I was 16, now 66. You guys need to start reaching out to your subscribers and fan base.. If that was the only fiberglass damage y'all had, the bill should have been only $1200-$1600.. I don't know what y'all actually paid, but it sounds like you were severely taken advantage of, because (based only on what you showed us in this episode) it was absolutely not a major job at all. The more I see from Seawind, it seems that they might be a manufacturer to avoid. Window stays that don’t hold up the window that they’re supposed to holding open (bad engineering) to not ensuring the boat makes it to the destination undamaged.Then on the new Ruby Rose 2, they had a halyard that was twisted so badly that it was unusable to my novice understanding of sail rigging.

I think I would find out if somebody is an attorney and they can write some letters demanding payment. It’s amazing what happens when you get a letter from an attorney as compared to just a little old you and me.

Sorry you have to go through that. When you purchase anything new, it shouldn’t be damaged. And if it is, it should be corrected…………quickly ! It shouldn’t be that difficult for you to get it done. It should be difficult for who is responsible for the damage.

It's always easier to pay for insurance. Than to get money from an insurance company. The longer it takes is the preference of the company. In the contract their should be a time schedule in regards to payment

When purchasing any insurance for coverage of this size, have a lawyer go over it and through it to make sure you understand it and find out if there is anything else you need to do and if you are okay with say, a $6000.00 US deductible. He will also be able to tell if you have to pay upfront or at the end of a repair, and how long they have to pay (especially if it falls off the shipping container.

Marine insurance is a different animal.. rooted in tradition. Very doubtful that most attorneys would have any knowledge about the ins & out. Find a marine insurance specialist.

It is obvious now that you need a substantial amount of $ for the yearly upkeep of a million $ catamaran! That includes unexpected expenses such as shipping damages.

Generally, if you go through a broker and they fail to correctly insure you then they are at fault and you can sue them. Still, so glad you got it fixed.

Have watched you guys for several years. My take away from your transitions through several boats and all the DIY/Professional repairs is the it really doesn’t matter if you have a 40 year old boat or a four month old boat. You are going to pay big bucks to operate and maintain it! I have always thought of living on a boat or RV full time but have come to realize its all relative, and not much different from living in/on land, in a house with fresh water, sewer, stable electricity, access to food, repair services, etc,etc. Although maybe not as cool or memorable which is, I guess, the whole point. Keep at it!

Sorry you guys had to go through so much crap on a new boat. I just got through looking at my insurance for my boat just to make sure I don’t have any issues but all looks good. But who knows when I actually need to depend on my insurance. Only time will tell. Hopefully all is well with you guys and that you get back to sailing soon. Good luck and much love.

I would have thought the onus and claim was totally on the shipper to fork out the Full amount of the repair work ! As per usual Insurance companies will do there utmost to avoid liability for bloody anything-makes me so mad!

Look into "ALE, Additional Living Expense", it is a cost incurred due to an unforeseen loss with a property claims; there may be a provision in your policy for that. From what I am hearing I would recommend you hire an Attorney. I am an Adjuster though I only handle property (Commercial and Residential). While there may not be a provision for ALE the boat is your home and a lawyer may be able to work with that. As far as them not paying you until the job is paid for that is not reasonable, they owe you for the damage whether you repair it or not. Again, I do not do boats but have worked thousands of claim over the years.

hope you didn't get hit with hidden charges at Bridgeport, they use to be DIY but now I would not go anywhere near that dump......next time go to Norwalk Cove a class operation.....se you down the coast

Ok,I understand your frustration; but..... Insurance company's main job is to keep the collected funds for thier shareholders. They do this by investing premiums The longer they can avoid, by any means, paying claims, the more return on investments. Your claim **may** only be $xx; but imagine the interest on several or hundreds of claims in the same time period! That could amount to really big bux. That is why so many cruisers simply "self insure"😂 I realize you had some sort of broker due to the international purchase; but "caveat emptor" still and always applies. Here's hoping it all works out for you😊 FW&FS

Thanks for explaining how the insurance claim process is going. You know you can't say you have a good insurance company until you have a claim and they come through for you. I would have thought they would send an ajuster to check out the damage as soon as you filed the claim and then authorize getting an estimate. You did everything you should have, especially advising of the damage on Day One.

As a boat owner, you purchase insurance against shipping damage. The insurance company provides that service. And yet, when the damage occurs, they don't want to pay. The insurance company does not have any legal recourse not to pay for a service you purchased from them. The insurance company can do its part for the customer by decertifying the shipping company that damaged the boat.

It’s so surprising to me(but in reality, I guess I shouldn’t be), that when you’ve already paid a fair bit for shipping, neither the shipper, nor the transport companies, take any responsibility for damaging your boat. I guess there’s no incentive for doing a good job, if there’s zero detrimental repercussions. Sad world. Nice that it’s all fixed, and that you were allowed to work while in the boat yard.

I can not imagine the frustration you have experienced. Thanks for the heads up and warnings. I hope I never need to deal with an insurance company. It is better to have good insurance than none. Insurance is there to cover expenses that you can not afford or do not willing to pay. looking forward to more sailing.

Anyone along the Gulf Coast of the US could have told you that the insurance process was going to be a nightmare. That's why it's so ridiculous when idiots say "oh they have insurance". Insurance will try to mess you around every which way they can. Hope y'all get everything straight and you are made whole fairly. Keep up the great work and calm seas..

My chined steel Van De Stadt 34' is currently on the hard, I've spent 3 going on 4 weeks taking the hull back to it's original primer coat, epoxy priming, epoxy fairing compound on the top 2 hull panels (4 chines per side) sanding the fairing compound, another coat of epoxy primer, then an epoxy bitumen coating and antifouling which has to be applied before the epoxy bitumen cures fully, new anodes, and so we go, so far I've spent a 5th of the purchase price of my boat just on the crane, sanding pads, PPE, thinners, acetone, anodes, paints!!!!! Farcanal, and I have only done below the waterline to date, still got to do 2K UV stabilized gloss marine polyurethane on the hull from the waterline, replace all the polycarbonate hull and cabin portlights and hatches, get a new backstay, step the mast, tune the rig, all this after already replacing all the wiring and lights in/on the mast, new windex.......etc etc etc etc Buy a boat, they said, it'll be fun they said 😮

Far, far to many insurance companies are more than happy to take your money because they know the odds are in their favor. Most never have to file a claim and they're relying on that fact. There's also the fact that the longer they can keep money in their account the more return they can get. So most companies will make you jump through as many hoops as they can and if you leave any wiggle room they will exploit it. That's why many insurance companies have their own legal departments that's main job is to protect the companies interests, definitely not the insurance companies clients. I would add that anyone wanting to insure a high dollar item or property to use a legal firm that deals with those sort of needs. They aren't cheap but worth every penny. Happy to hear things are working out for you, we will be praying that when the bill comes due they cover it in a timely manner. Fair winds, following seas, safe travels and God Bless. I've been watching for awhile now and got to thinking. I mean how much would I have to hate all of you and everyone involved with the channel as well as your viewers to not share the peace and joy I've found. Below I am going to link my research that has opened my eyes to truth I'm ashamed to say I neglected for most of my life. So I ask you all to at least please read it and not dismiss it out of hand without looking into it. Please I beg you read this entire comment, this isn't about me but the love I have for fall of you. This just may be one of the most important things you ever read and will direct you to something much, much more important than you could ever imagine. It is not the ramblings of a madman or someone who is deluded but is based on sound research and brings to light truths most have never seen. The reason I believe in the God of the Bible, the inerrancy of Scripture and that Jesus Christ is my Lord and Savior. We have a reliable collection of historical documents written by eyewitnesses during the lifetime of other eyewitnesses. They report super natural events that took place in fulfilment of specific prophecies and claim that their writings are via divine inspiration and not from men alone. The super natural events are important in that they show the divine nature of God. Jesus Christ cast out demons, healed the sick, blind, deaf, dumb and paralyzed, walked on water, fed thousands with little, and was resurrected all of which have eyewitness accounts. The feedings alone were witnessed by the thousands He fed on the two separate occasions that we are told of in the Gospels. John tells us that there were many more miracles than what are recorded in the Bible/Gospels and that it would have filled volumes of books upon books were he to have written them all down and that it would have taken more than one lifetime to do so. The claim that men wrote the Bible so it can not be true means that no other book ever written should be believed, no matter the topic as they're all written by man. The Bible is not just a book it is a collection of books which are linked together by One Divine Author. In this collection of books there are over 40 authors but only one Devine Author, (the Holy Spirit), who links them all together over a period of 1500+ years for the New Testament alone. Those authors wrote down His inspired Word given to them by God. 66 Volumes/Books in the Bible. The bulk of the New Testament was written over a period of around 50 years. It was in 49 AD to 53 AD when the Scripture writings of the New Testament are thought to have begun. With the last living Apostle John dying in 100 AD. Over a period of around 1500 years it was preserved and passed on: In 3 Languages On 3 Continents There are 66,360+ source documents that have been found for the entire Bible of which there are 24,360 and counting source documents for the New Testament alone. 5,839 in the original Greek, some 2 million pages 18,524 translations of that Greek into other languages Some of the oldest sources date to 125AD which is within decades of the completion of all the books that were canonized as the New Testament. The New Testament cannon, (Gospels of the Apostles/writings, Epistles/letters to the early Churches, all sources and eyewitness accounts that were to be included), was decided at the Synod of Carthage in 397 AD. Those asking for "Scientific Proof" about the Bible are either ignorant or asking with evil intent. An intelligent person knows that the scientific method can not be applied to verify the Bible. Scientific Method is: 1) Has to be observable. 2) Has to be measurable. 3) Has to be repeatable. Therefore no history can ever be proven via scientific method. You must use the historical method based on: Eyewitnesses accounts. Documents from the time or as close as possible. Make sure the story is corroborated by as many sources as possible. Look for anyone/anything that attempted to prove any of it false in that time period or as close to it as possible. Did anyone successfully prove any of it untrue? If they had/have why is there no record found anywhere of it ever being disproven? Luke = Historian A man of science, a physician, an educated and logical man who researched and gathered the accounts of eyewitnesses. He recorded the actual eyewitness accounts of our Lord and Savior, those who had heard Him speak and were present/saw the signs/miracles He performed. He did this because the life of those eyewitnesses were coming to an end due to age and he was inspired to write them down via the Holy Spirit before they could be lost or perverted by time. John = Evangelist John is organized around 7 specific events/signs/miracles all seen by eyewitnesses and corroborated by many. So he also provides proof of accuracy/truth. Mark = The shortest of the Gospels and is very direct or "Just the Facts" if you like. Mathew = Was written to the Jewish audience and that's one of the reasons for the extensive genealogy of Christ. There are also more references to the Old Testament in his gospel compared to the others. Peter = He lays out all the proof for the Bible and it's accuracy in 1 Peter Chapter 1. He makes the arguments that justify it all as truly what happened and that it all happened as recorded in the Gospel/New Testament, the entire Bible. All of the Apostles were eyewitnesses of Jesus and/or of the resurrected Christ. Including Paul whom Jesus came to as he was on the road traveling to Damascus to persecute more Christians. This would have been the resurrected Christ or a form of Him that came from Heaven. There were at least 300 eyewitnesses still alive when Corinthians was written who could have disputed it but no one did. Mathias became the 12th Apostles after Judas hung himself so the argument of there not being 12 Apostles comes from ignorance or evil intent. There have been over 25,000 archeological digs in which there has been absolutely no evidence found that proves anything in the entire Bible false but in those digs many things have been found that prove it true. This is one such video in which archeological evidence that has been found adds to the veracity of Scripture, the video is "The Archaeology of Jerusalem with Ton Meyer". We don't need finds such as these to know that the Word of God is true but out of His love for us He's preserved and allowed them to be found. This video is on the "Institute from Creation Research" channel and is just one of many they have that proves the Bible true. Other cultures and non believer's historical documents show or corroborate people, places, wars and many things that are in the Bible. Yet none of them prove any of it to be false, in stead they have strengthened it. Word for Word Translations prove just how accurate what we have is when you consider there's no way anyone could have falsified any of it, be it via intent or mistakes. Many church fathers in history have made extensive notes that include scripture throughout the centuries and no matter the time or place all those references to scripture corroborate each other. Which shows just how accurate translations have been throughout time and still are as long as they maintain a word for word ideology during the translation. To falsify any of it they would have to change every single source, do it in three languages, on three continents, over a span of thousands of years, with no one catching any of it, no one ever talking about what they'd done, leaving behind no traces that they'd done it. Not to mention they'd have to steal all of those sources to change them, changing them would be a massive undertaking considering they were hand written in those times and then put them back without ever being seen or caught during the entire process. My last statement is this: Simply put the Bible can defend itself like a lion just let it loose. (Use Scripture to defend Scripture because it is a collection of eyewitness accounts that has been proven true again and again). You must know that God our Father and our Lord and Savior Jesus Christ, the Lord of Lords and King of Kings, that although He hates the sin, He loves the repentant sinner. If people will just come to Him and repent in their heart of hearts of all their sins, and proclaim Him as their Savior, their Lord, the Son of GOD. Just look around, you know time is growing short. So I beg you don't waste another second as we know the Rapture will occur in the twinkling of an eye. Maranatha!!! There's a very good movie titled "The God Who Speaks" that covers much of what I've said above. If you still have doubt I would recommend you watch it and even if you don't because it was very well made and presented. Take care and God Bless

Hi guys, I had the same issue with the private health insurance here in Australia and it is ongoing. They told me I need to give them more proof and more everything etc etc etc. I’ve done that I was scheduled to have the operation on 7 June and on 2 June, they cancelled the operation which I would be able me walk again. I know your stress level is over the top

I would not wish "insurance scenarios" on anybody but I really appreciate your forthrightness. Why would anyone pay to acquire a "Catch-22" ? You have educated me and I am grateful. Unfortunately, I equate insurance with extortion and "necessary evil". I wish it were possible to have an insurance company behave favorably to customers without headaches. If anyone knows of any please let everyone know of them !

Almost hanging 10! And Bridgeport boat works is 30 miles from my house! You can go to Bass Pro Shops right next too there!!! Shipping damage on an expensive boat like that wow that is tough. I would of and you probably did sail to the place to repair and in the hurricane safe zone.

Great episode guys!!! Ya, it seems marine insurance is really always full of all kinds if conditions. So read carefully. In a lot if circumstances your not covered. I found a clause that said an out of date fire eqtinguisher would void the policy. We have 6 on board. Go figure.

This is why I have a cheap old boat. Yes I do have insurance for an agreed value but if they jack the rates up on it, I'll just go with liability and maybe uninsured boater coverage. New boats even if they are paid for need insurance and it's not cheap! I have heard so many horror stories about boat insurance I'm glad I haven't had to make a claim. (Knock on wood). Ouch!

Unfortunately, insurance companies make their money by NOT PAYING CLAIMS - so, finding a company 'with your best interest in mind' is a contradiction. If you manage to get your repairs all or mostly covered - that would be quite 'miraculous'. That's just the way it is. An insurance adjustor who loses money for his company probably won't last long as an employee.
