The court must appreciate the illegality committed by the State in holding the accussed persons beyond the 24 hours prescribed in law. The State is now committing Criminality of the highest order, and by seeking additional time to hold suspects, after violating their rights adding insult to injury It would be just to release the suspects immediately, as the State has not charged them, and has not indicated any avenue under which they intend to charge them This is a gross misuse of the powers of the State and a violation of Citizens rights . Kenya is not a country where the State can detain you for 14 days, then charge tou in a court of law That behaviour contavenes the constitution, which clearly says that the State Must present you in court, and by so doing, charge you with an offense which you as a citizen will take a plea. If the Court allows the State to enter this dangerous territory of indefinate detention, then the court will be sanctioning a dictatorial and oppressive State. A huge blow to our democracy.
