How does the First Amendment protect public employees? The First Amendment to the U.S. Constitution says that "Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof; or abridging the freedom of speech, or of the press; or the right of the people peaceably to assemble, and to petition the Government for a redress of grievances."

Curious how it applies to public employees' speech? What do you think?
@dlmullins9054Ай бұрын
They are supposed to keep the peace, and all they should have done is educate the security guards and let them know for future reference, you have the right to do what you are doing. Their ego prevents them from it. That is not only unprofessional, but also very sad for our freedom and those who are hired to protect it.

All public employees and all law enforcement employees and all judges should be required to take continuing education classes on local and Constitutional law. Period.

If there is personal information available to see surely it's up to the DMV to keep it private. You could go in there without a camera and still see and hear it.

WHENEVER A COP OR SECURITY GUARD , OR ANYONE FOR THAT MATTER , TELLS AN AUDITOR WHAT THEY CAN OR CANT VIDEO FROM A PUBLIC PLACE THE AUDITOR MUST REMIND THEM THAT HE CAN LEGALLY VIDEO ANYTHING THAT HIS EYES CAN SEE . AND THAT IF PEOPLE DONT WANT SOMETHING TO BE VIDEOD' IT IS UP TO THEM ALONE TO KEEP OUT OF SIGHT

What is the balancing test courts use to decide these cases? Once a plaintiff states a claim for unlawful retaliation, a court must decide if "the interest of the employee as a citizen, in commenting on matters of public concern, outweighs the employer's interest in promoting the efficiency of the public services it performs through its employees." Courts have to make this decision after weighing the facts of each particular case. Some balancing factors for a court to consider include whether: the statement impairs discipline by superiors or harmony among coworkers, the statement has a detrimental impact on close working relationships for which personal loyalty and confidence are necessary, and whether the speech in question interferes with the normal operation of the employer's business

Sheets v. City of Punta Gorda (2019), as one example. Courts routinely find that the insides of public buildings do NOT afford the same broad protections of first amendment activities, even in otherwise unrestricted areas. The courts generally recognize that public government buildings with unrestricted access to the public do, in fact, have specific purposes for their existences ... and, therefore, have a lawful ability to restrict certain behaviors that would distract from conducting those specific purposes. Hate that all you want, but it's not as simple as merely saying, "Public Building + 1A = You Can't Tell Me No." It's more complicated than that.

If you want to eliminate auditors then , ENCOURAGE public filming of police , the government businesses and the public ., but more than that i encourage those being filmed to accept it 100% . invite auditors in and provide refreshments and chat them up for as long as they wish . why do i advocate this? because no one will watch a video of people inviting those with cameras to film all they want with zero resistance. the auditors would become bored and their content would put people to sleep . the subscribers would become unsubscribed in short order . encourage filming everywhere !
