Discharged Means DISCHARGED Obviously, DISCHARGED, and Discharged and Acquited don't mean the same thing in law. My point is that in law Discharged means DISCHARGED. Which implies that the accused is free to go. The Appeal Court in its ruling simply had expressly DISCHARGED MNK. The AGF must first obey the court order by setting MNK free, as directed by the court. The Court of Appeal never qualified its DISCHARGED ruling with "but not acquitted." That phrase is a legalese, red herring introduced by Mr. Malami to divert attention from his abysmal and disgraceful juridical ignorance, incompetence and bungling, in the way and manner he abducted, arraigned and prosecuted MNK. The learned Appeal Court judges were unanimous in disparaging the AGF for his failure to comply with the rule of law and due process in the way and manner he abducted, extra-ordinarily renditioned and arraigned MNK before the Abuja Federal High Court. The judicial implication of the Appeal Court's ruling is that the Nigerian government must first return MNK to Kenya, from where he was abducted in July last year. Subsequently, if the FGN so wishes, it should then file an extradition request to the Government of President William Ruto of Kenya. The FGN should first argue and win its case for extradition before a Kenyan Court, before MNK can be brought back (extradited) to Nigeria to be re-arrested and re-arraigned on any trumped up charges for which he may be extradited. It should also be noted that MNK was bearing a British passport - by implication, he was(is) a British subject, when he entered Kenya as a visitor. This begs the question of jurisdiction under international law. These issues may take several months, if not years to resolve. Obviously, Mr. Malami has found himself in a judicial hole. He cannot dig himself out of this hole with his legal mumbo jumbo and abracadabra. The more he digs, the deeper it gets. The best advice to give Mr. Malami is that he should stop digging. Acquittal cannot be presumed or read into a discharge ruling/judgment, it has to be expressly stated in the court’s decision. And without a trial on the merits, only a discharge and not an acquittal decision can be entered. Importantly, what were Kanu’s grounds of appeal and reliefs sought on appeal, did they include a prayer for acquittal? A defendant at the trial stage can, however, be discharged and acquitted without a full trial on the merits if the prosecution withdraws its charges without prejudice, that is, unconditionally. If Kanu did not request an acquittal in his appeal, the Appeal Court, if it purportedly granted it, would have granted a relief not canvassed before it nor prayed for and that itself would constitute a ground for further appeal to vacate that particular relief or the whole decision of the court depending on what the appellant wants in his/her further appeal.
