The Appeal Court ruling should be appealed to the Supreme Court for clarity as to the Power of state high courts to entertain cases of vacancies. Even with a Supreme Court ruling from this appeal, the former legislators seats would still be considered vacant. For the former legislators seats not to be considered vacant, the Supreme Court would have to rule on section 109 of the Constitution related to the former legislators seats being vacant, that this section should not be applied to the former legislators.
