Pro-Fubara, Wike Lawmakers Clash Over 'Vacant Seat'

As the political tussle in Rivers State continues to fester, the gladiators are unrelenting in bringing more turmoil in the state. This time, the Martin Amaewhule-led Rivers State House of Assembly and the faction loyal to Governor Siminalayi Fubara have initiated a fresh round of crisis. On Tuesday, the Amaewhule faction declared the seats of four of their colleagues loyal to Governor Fubara vacant over absenteeism. Reacting, the pro-Fubara faction, led by Victor Oko-Jumbo insisted that Amaewhule and his group have ceased to be lawmakers in the State. The group called on the Independent National Electoral Commission, INEC to conduct by-election to fill the vacant seats. The new power play followed the battle for the political control of the state between Governor Fubara and the Minister of the Federal Capital Territory, FCT, Nyesom Wike.

Uncle Jide, I've watched you with keen interest over the years and I'd like to thank you for your role, and comments so far. However, in this Rivers HOA matter, permit me to share my opinion. I would like to respectfully express my disagreement regarding the need for the court to declare the seats vacant. The Constitution is explicit on this issue: when lawmakers defect from the political party through which they were elected, they automatically lose their seats. This interpretation does not require judicial intervention. The courts typically become involved only when a party, in this case, the defected lawmakers, seeks to act contrary to constitutional provisions. My primary concern lies with this APC's infested judiciary reliability in delivering sound judgments. We are watching. Thanks

Very biased man. He keeps asking where in the world do 4 law makers sit. But he didn't ask where in the world that lawmakers defect and the defection supported by court affidavit and public announcement, yet such men remain lawmakers, and later claim they never defected? Where in the world. The biased journalist wouldn't talk about it. These are the people that continue to parade Nigeria as a banana republic. The Supreme Court has ruled that losing seat upon defection is automatic, and a journalist can't overcome his sentiments a in public platform. The ondo lawmakers that he cited, he seems to forget that their seats were declared vacant upon defection and they never operated as lawmakers even as they challenged the case. Till now, they never came back. He is hanging on judiciary because they know how it works today. The right thing to do in Rivers State is for INEC to hold by election to fill the vacant seats of the the lawmakers who have defected to APC. Simple. In the meantime, the remaining members of the house will be functioning.

Governor Fubara, a complete gentleman by nature is being misled he knows that. You cannot have only four members in the house of assembly and you think you are serving the state. It is weird and ridiculous. The governor is not above the law. The two speakers in the two houses of assembly have called on INEC to conduct elections on the vacant seats and let's wait and see whose request INEC will be be honoring. This should put an end to which members of the house of assembly is in charge. This will be an unnecessary embarrassment to the governor which may lead to and impeachment offence for not obeying the court orders especially on the budget issue. This is just a misguided power show which may not be in the interest of the governor at the end.

Most times TVC news are always bias, there was never a time the 3 members said they are going to continue carrying on the job of assembly alone, the Martin amehule group decamped, and the remaining members wrote to INEC to conduct election, but INEC could not, Jide you cannot tell me for the fact that three members cannot precise over the assembly therefore that the amahule faction that have decamped long ago should be legalised. The best thing to do here was to conduct election, but in the absence of the election the assembly must go on, you cannot lock up the assembly because some members decamped that's not normal

This thing is very technical. The members were till now havent been defected with formalities needed to do so. Only mentioning it has no weight and i believe that was why PDP had to discontinue the case and proceeded to find legality to how the few members left will continue to run the house. There's a process in democracy, those that claimed to have defected have not written any letter to their party, PDP. They did not filled any form with APC, there's no concrete evidence that their defection has been formalized, all was just a political jamboree to distract the governor. Can you as an employee who has been duly employed by a government or organized private sector, tenders your resignation verbally? Let's not encourage abhorrent behaviour Uncle Jide. The power play that led to the mass defection was reprehensible. The drafters of the Constitution did not contemplate such wholesale defection, such that the house membership goes below the minimum prescribed and the allowable quorum. So while the remaining members may in theory have the constitutional powers to declare the seats of the defectors vacant, they couldn't validity exercise it because they didn't have the Constitutional numbers to sit. In essence, there is a Constitutional crises. The matter needs to be litigated upon until the supreme Court before we could get a definitive pronouncement on how to sort out this madness. Then a constitutional amendment would be appropriate forestall a reoccurence.

Constitutional provisions are not always interpreted by the court in a society where the rule of law is respected. The 25 former lawmakers should have vacated their seats since they decided join the APC when there was no division in PDPas the time they cross carpeted. Consequently, INEC should have immediately conducted a bye election to fill the vacant seats. This would have solved the problem of 3 or 4 members running the Rivers house of assembly. Jide as most of the times, was disingenuous in always hammering on 3 the members and not addressing the main issue.
