The killing of National Animal Tiger by shooting so it’s Natural Habitat of deep forest area in an Organized Manner is extremely a serious matter & an Offence. There is no antecedents & material evidence in the present case (facts & circumstances are against deceased) that the said Tiger/Tigress had become dangerous to human life. If if the Chief Wildlife Warden wants to translocate (on request of State Government & it’s Authorities) some wild animal as specified in Schedule-I, (which also include a Tiger) for the purpose of scientific management (Section 12(bb) of the Act of 1972), then also CWW has to take prior permission/consent & “In Principle Approval” from the NTCA(National Tiger Conservation Authority) subject to compliance of NTCA Protocol, SOPs etc, only then CWW (who has not fully competent & empowered to take self decisions, if doing so which will be Overacting, Indiscipline, Misconduct & Breaching of the said Act from CWW since since the provisions of Section 38 of the Act of 1972 have overriding powers over those of the CWW under Section 11(1) (a) of the Act of 1972) can issue order in writing any person to hunt (only in extraordinary circumstances but not shoot & kill at sight), which includes capturing for translocation to another wild life reserve area but not zoo or reintroduction of such wild animal. “NTCA being a Statutory Authority” in terms of the provisions contained in Chapter IV B of the Act of 1972 would have Supremacy over all the State Authorities and its powers under Section 38 O of the Act of 1972 shall Prevail over the Powers of the State Government in relation to Approving any Tiger Conservation Plan in our India. State Government & it’s Authorities and CWW ongoing action plan was not taking prior permission or consent from NTCA and so they now under a cover of “Wholly Illegal Action & Offence” which are taking recourse to Section 11(1)(a) of the Act of 1972 and by violating NTCA Protocol, SOPs etc.
