@@DarinJamesSpencer i can't believe they want to argue insufferability clause when the states and employers have suffered, I don't know about any lawsuits that issued forth from that but I know employers here would not hire anyone full time for years because of being afraid of having to pay both insurance for employees and they couldn't afford to pay the penalty tax also. And the left wants to say trumps tax cuts haven't helped Americans, I've seen it with my own eyes and talked to many who believe they wouldn't be working now if trump hadn't stimulated the marketplace. But I'm thankful they gutted the individual mandate but it still reinforces the idea of a command from congress that's unconstitutional for forcing citizens to enter into commerce against their will. I don't believe the majority of Americans would choose to accept a law that forces us to all pay or get targeted by the IRS. The only reason the poll numbers for it were high (i say high but iirc it was maybe 40-45 percent) was because mainstream news propped it up on a pillow.

Why does the government have a legal standing ever to mandate any citizen buying medical insurance, pay for somebody else’s medical condition. If it was so great why did Obama exempt Congress as a small employer. It is not fair to people who make better health choices and care.. it is discriminatory to everybody who works to pay for their own insurance and doesn’t want to pay for abortion, pre or post natal care. Expand Medicaid for those who want preferred, pre-existing insurance coverage. You definitely are FORCING EVERYBODY to pay for illnesses, abortions, they do not have nor agree with morally- The Obama Care Act took away all our choice and affordability in healthcare- where have you been justices? More and more and more government over reach. You can not mandate health insurance and call it a tax just because the democrats want to control us and destroy our liberties. We do not want this, we do not agree as citizens with attaching anymore additional taxes and calling it constitutional.

Most Democracy’s around the World acknowledges the fact that the taxpayers money funds the government and everyone the day they are born are covered for all of their healthcare needs as it should be! Here in America our taxpayers money covers the research and development of lifesaving medicine, immunization’s and vaccines that save countless of lives around the World yet we pay 200%-2,000% more for a single pill. There is a thing called the internet that can inform you of facts. For instance google the cost of Remdemisfeir in Canada, the UK, Germany and America (spoiler Germany is the closest to us at just over $50 a pill and over $500 here!) it’s unacceptable!

Leaving the clause for a tax in the act gives an easier path for increasing or adding a tax back in at the will of Congress. We the people don’t need an easier path for Congress to increase our tax!!

One thing I learned... if the mandate penalty can be zeroed out...it also can, in the future, be reinstated by Congress; meaning they can reinstate a penalty at their choosing. This mandate should be ENTIRELY REMOVED.

It was deemed unconstitutional to call it a tax. So they changed the terminology to penalty. The result is still the same. If you don't buy, what we say you must buy, you will have to pay. With that in mind, yes it is unconstitutional.

Many people would question the sanity of anyone who thinks that the statement could be anything more than an opinion. While Jess may have insinuated something, you're the one accusing him outright of indecency and "shitty" behavior. I don't know the basis for which you concluded that his "indecency" was motivated by political disagreements. On the contrary, he seems to agree with John's original premise of Justice Barrett's brilliance. He just reinforced it with another example of another brilliant person of similar political persuasion.

As it turns out, “shall” is not a word of obligation. The Supreme Court of the United States ruled that “shall” really means “may” - quite a surprise to attorneys who were taught in law school that “shall” means “must”. As a small business owner I provided health insurance since 1979. Ridiculous legislation since 1984 caused health insurance to become a financial burden on employers and individual policies. Making any addiction from alcohol, drugs to shopping addiction caused insurance costs to jump from $141 per month to over $654 per individual from 1980 to 1990. That’s 500% in 10 years. In the early 1990’s hmos became available. Less insurance for more money. At the passing of ACA my personal insurance (hmo) blasted from $379 per month to $795 per month and even less provision. I don’t purchase my insurance thru te exchange but understand there is a $5500 deductible. In that case, after spending approximately $9600 a year for said policy one doesn’t actually have coverage. A terrible legislation by a equally terrible group of non representative representatives.

As an outsider I'm always amazed at how appellate proceedings are limited to roughly an hour or 30 minutes per side and always wonder if the Justices are properly informed or have enough time to put questions. In other jurisdictions like UK or South Africa these proceedings can take the whole day and counsel can argue to exhuastion and question is much thorough in which not only the law is argued but the reasoning, doctrine and philosophy behind the legal points are engaged

It just looks limited to us regular folks. But oral arguments are a very small part of Supreme Court proceedings. Prior to oral arguments, counsels for parties to lawsuits need to have submitted their written arguments and they would have filed their responses to those arguments. In this particular case, if you're really interested in matters of detailed reasoning, doctrine, philosophy, etc., you should go the Supreme Court's docket website where all case documents are located here: www.supremecourt.gov/search.aspx?filename=/docket/docketfiles/html/public/19-840.html

Mr. Mongan does not get it. They are charging based on income that a lot of people will not know what it is until after the year is over, especially small businesses. They should be advertising the prices period. The IRS fined H&R Block for charging based on a percentage of someone's refund. How does the government get away with charging a percentage of peoples unknown income? When people are working multiple jobs and won't know their total until the end of the year having to pay a fine is ridiculous. Then they are fined for getting "too much" of a credit. It is designed to steal their refund. State the actual price and quit using a percentage of future income. Can you see the future!? When working with multiple W2's each employer does not know about the other and cannot know that one W2 for $6,000 would not make a tax burden but 2 or 3 or more would! They could not possibly know ahead of time what part time jobs they will get especially with businesses closing at the whim of control freaking Dem Governors! Do NOT go into the Marketplace as they say "How much do you want to pay?" Not, "This is the amount you should if your income is this." Then our state, Washington, has not gotten the form right yet. They are supposed to be using the SECOND LOWEST SILVER PLAN, but I have to check the site and correct the form every year. If the taxpayer goes to someone to do their taxes and they don't know to correct the 1095A form per their own website, people will be paying tens of thousands of dollars. I just had a client this year that some inexperienced person made her pay $13,000. Would you have that in your account? THE NUMBER ONE THING IS THEY DID NOT TAKE CARE OF THE COST WHICH CROSS STATE COMPETITION WOULD HAVE DONE! Also the first year of this ACA I was 64 and the least expensive insurance was $1,064 per month with a $10,000 deductible. Who buys crap like that and why would you? You could not afford to use it. It would be worthless! Some states such as Washington had, in the case of Gregoire, an Insurance Commissioner, Attorney General and 2 stints as Governor and she sued the insurance companies which left our state. Clallam County has only ONE insurance. They want to charge a single man age 58 $900 per month premiums with a $7,500 deductible. That would be half his income! So there is NO COMPETITION FOR PRICE REDUCTION! Oregon, by comparison, has 25 to choose from and yet they want to make you get it or fine you if you didn't. That's why Congress took away the individual mandate. But you still have not lowered the costs! Get it!!! By the way, THE ONLY WAY IT PASSED IS THE FINE HAD TO BE A TAX AND NOT A FINE! NOW THE ACA IS TAKING HARD EARNED MONEY FROM THOSE WHO CAN LEAST AFFORD IT BECAUSE THE PEOPLE SIGNING THEM UP DON'T TELL WHAT THEY SHOULD PAY! IT's anything BUT affordable!!

Physicians are not required to accept the ACA. Many retired. People like myself have some rare incurable diseases. The ACA was forced upon me and 1 visit to a specialist cost $4,300. None of the bill was covered by the ACA regardless of them having the specialists on their list, would have been imminent death under the ACA for me. Another person I know, her son, since birth, had serious health issues and in a home. He was immediately cancelled and given notice to remove him. She also was disabled and could not care for him. She was forced to move out of this state to receive help. Law or no law some just don't have the funds to buy this forced ACA and private insurance companies cut back or left states. That snowballed and created a enormous copayments. Thankfully President Trump was able to help with what he had to work with along with resistance. Epidemics don't often come around and shouldn't. Physicians aren't familiar with these manmade viruses. They can only do so much. To have the government dictate ACA be the option for Americans. Other countries do not work as well as assumed. Friends with common disease as I have, suffered greatly a slow, extremely painful death with extremely poor care.

FOX used my blog for their news stories on Obamacare after I posted it for public review. I was informed that my blog was read in part on the congressional record on the House floor with my name. Liberal media was very angry when I was interviewed by them about my book and Obamacare....One attorney host on a major station told the audience not to listen to me and that Obamacare did not include death panels, but now he knows I was right as well as the nation .

Before the aca my insurance was 80 a month thru my employer after it went up to 220 a month then was dropped completely last year now i pay 430 a month for my own plan. please Trump make heath insurance affordable again!

@Liberty Hanson Tenth Amendment, Article VI, Section 2 clearly states that any law passed that is contrary to the US Constitution is thereby null and void. Technically they cannot suspend the Constitution, and barring an imminent invasion of a foreign Country, I cannot see any reason to enact such a measure. Have Presidents passed laws that grant them far too much authority? Yes, but technically it is worth less than the paper it's written on. Every unconstitutional law is treason, per the founding documents.

@Liberty Hanson The shadow government does not operate by the US Constitution, they are led by international banking interests, and their main goal is to subvert the people and the legitimate government of the US. Until Trump was elected, they owned every President, the last President to openly go against them was JFK. So yes, you are correct, to a degree. If we are to honor the criminals in power, they can pretty much do what they want, they do have the Country by the balls, so to speak. But technically they are traitors to the Constitution and guilty of treason, all of them.

@@wespro1 No, as both sides and the court stated what could make it unconstitutional is: 1. A citizen can't be forced to participate in commerce. 2. The language in the law say that its mandatory. 3. Can a person be subjected to harm for not following the mandate. Thus this argument can fully be applied to state laws concerning auto insurance. Especially since it directly effects interstate commerce and our right to travel.

So far Congress has not passed a law mandating masks. Darn lairs said we could keep what we had but NO we could not. I could no longer afford it and my kids were forced to buy it, but chose to pay the "stupid" penalty. Free is never free. But it was removed by the trump administration. That was one of the rules that never should have been put in place. Not everyone was able to get insurance through the ACA and shouldn't be forced into getting insurance that was so expensive that they were struggling to pay the premiums.

There is a very simple answer to the question why Congress did not repeal the entire ACA act: BECAUSE THEY DID NOT HAVE THE VOTES TO DO SO. They had the votes to cancel the mandate, but not to cancel the rest. That is not the sort of thing that gets discussed in judicial proceedings but it is certainly the sort of thing that really counts when disputed legislation is passed, amended, or ended in Congress... And I would argue that the fact that they did not have the votes to cancel the whole act is somewhat compelling evidence that Congress did NOT agree or legislate the cancellation of the whole act, no matter what language about severability is found in the act itself. In other words, Congress did NOT want to cancel the provisions about pre existing conditions and other consumer protections which are in the ACA. If THAT was the will of Congress, then Congress could have and would have done so.

I was harassed for months on-line by healthcare providers threatening that i would be charged $600 to $700 each year, whether in a tax or a fine then, if I did not buy into the provisions of the ACA. I live abroad and was told by the person who prepares my taxes that I should not be charged anything. I have a health insurance policy where I live, with the same provider whose policies were a benefit I received when I worked in a private school here. I was charged less than $400 a year then, in about 2000 when I retired, for coverage which gave me the right to choose my own doctor and with no exclusions. Twenty years later I pay about $800 a year. Btw, Justice Kagan and Justice Sotomayor are very rude.

The easiest path to fix this, is for Congress to modify ACA to be a full HealthCare Tax to all Tax Payers at a particular % of Assessable Income. ie: 2%. Apply the tax to both Companies and persons. If a person already has private Health Insurance, they will get a full tax deduction of the entire 2%, thus negating the cash outflow. Essentially bringing down the HealthCare Tax payable to $0. Those persons without Private Health Insurance will not have a Tax Deduction and thus will pay the full 2% HealthCare Tax. The Government then buys HealthCare Private Insurance from Insurance companies (on the Market) on behalf of the tax payer. The Insurance covers the following full tax year. During the Tax year, the tax payer only deals with the Insurance company. Thus essentially making the Government an Insurance Broker. When the Government acts as an Insurance Broker, it has high Buyer Power, thus can drive down Insurance Premiums (the Government pays to these Insurance companies). This strategy bypasses the constitutional wall, that stipulates Government cannot force Citizens into a Commerce trade. This strategy just becomes a tax matter, of which Government has the constitutional power to tax Citizens. As an Australian, this is how we get taxed for Health Insurance. The principles I have mentioned above, flow in our Australian Health Tax Laws.

@@MrYourfriendbutters it would be a direct Tax. 2% on Assessable Income to ALL tax payers, will generate a lot of cash inflow into the cash reserves of the Government to then purchase Private Health Insurance on behalf of the Tax payer. I just came up with 2%, but the Senate can fine tune the best % to use.

If you exam the cost sheet of a hospitalized patient in a Private Hospital vs Government Hospital: you will wonder why on earth is there a huge delta. This is bcoz the Private Hospital wants to milk and milk you dry so at to drive their Stock Price Up the roof. Have a look at the Germans Health Care system. They use the latest Hospital equipment yet their hospitalization cost sheets are very low.

I always thought the task of the Supreme Court was to measure laws passed by the states and Congress and their compliance with the Constitution to see if they were proper. Kind of like in accordance with the Constitution. Seems their role is evolving into that of a Congressional assistance wing. When the Un-affordable Care Act was originally adjucated by the Supreme Court, Justice Roberts couldn't find rationale in the Constitution for support of the law and the penalty mandate. So he creatively came up with the idea to call it a tax (which Congress can do). Now that the mandate (tax)has been (repealed/offset/eliminated/removed), there is no basis for continuing a law that has no (appropriated) funding. After listening to the conversations this morning it seems the task at the Supreme Court is to (be creative) and come up with or devise some other rationale to keep it in place. Still with no money, but soon to be turned into or toward a single payer Government Health Care System and be fully funded by taxpayer dollars. Legislating from the bench.

The ACA is a violation of the tenth amendment of the constitution. The Federal government cannot mandate through fines or imprisonment that a citizen purchase private goods or services. It'd be no different if the government mandated you bought a certain amount of Pepsi every month, or face a fine for not complying. It is a violation of peoples rights, and an overreach of power.
