Are you for real??? Tell me, when did anyone formally and legally agree to be bound by the Road Traffic Act? When did anyone formally and legally sign the consent to be governed agreement which would be the evidence required to prove that there are obligations and liabilities? When did that happen? I am not obligated in any way, case closed. So what you got to say about convincing people they are committing "offences", when they are NOT? Nobody ever signed the madatory transfer of power of attorney to be represented. ARE YOU LISTENING NOW??? I always charge the Chief Constable of that area, that Chief Constable does not sign any part of the fraudulent documentation sent through the mail. No signature =FRAUD by misrepresentation, a known chargeable criminal offence committed by every lying, thieving, parasitic private corporation policy enforcement chiefs. HM Parliaments and Governments STATE is a company not a government. There is ZERO evidence of a legal government anywhere on Earth.

There is no court. Its a private company policy enforcement office, and any fool that walks into the lions den when they have ZERO obligation to do so, grants the consent by that action of walking in there. You agree by your actions to be bound by the company policy, that doesn't apply to you FACTUALLY, LEGALLY. Time to wake up and take off the blinkers folks.

They often won't send you the photos. If you can't be sure who was driving, you can't identify the driver under Section 172 of the RTA. It's illegal to knowingly provide a false statement. If you're willing to identify the driver from the photo and they won't send it, there's no more you can do. I had a red light camera fine disappear that way.

The best advice I can give is not to follow any of this advice, as it is simply the ultimate guide in complying to get prosecuted by a speeding ticket. I've personally been down all the routes this woman describes, & all that happens is you get stitched up the minute you enter a court room. What really works from personal application is this: write a Notice of Conditional Acceptance requesting for clarification, that the road traffic offenders act 1988 applies to a living Man/Woman? i.e. not a person. Give them 72 hours to comply. Do not fill out any of their forms or paperwork, by providing your details including driving license number on a separate sheet of your own. It's all to do with contract law, & by completing their paperwork you have contracted with them & are then bound under the terms of their contract. Hope this will assist those who are looking for a real way out, by failing to comply with any of their legalese nonsense.

Hmmm. I do see that point of view, like we agree to use roundabouts and traffic lights the correct way, but when it comes to speeding fines, I am saying NO, and they address it to your legal fiction i.e. your full name, therefore that is not you the living human. I might get into a lot of trouble with the police over my current speeding fine, but you have to stand up for what you believe in. I wish you good fortune in the wars to come.

Thank you for sharing this video, it's very informative, I've got a question for you, if the police pulls you over, and wrongly accuses you of speeding, if you've got a dashcam with GPS with a speed stamp, which displays the correct speed you're doing, what do you do? show them the footage, or when you get a ticket, can you contest it by sending the dashcam footage? Thanks.

Car GPS units aren't average..... they literally measure your speed at the time. Mine was a cheap £80 front and rear 4k dashcam and has speed measurement on the footage, it literally changes every 1-2 seconds in line with my vehicle speed so it's not average. I was caught speeding in the north of Scotland and I live in the south of England and have been summoned to appear in the county of the incident. It's way over two hundred miles to get there and also the same going home and was hoping to avoid a further five hundred mile journey (there and back) just to say, 'Hello!' to the court. Is that normal to have to report to the county where it happened? That would be ludicrous if I lived in Italy or wherever.
@thefiestaguy8831
@thefiestaguy8831 11 ай бұрын
I'm not sure how it works if you were caught in say Scotland but live in say Brighton, but usually there's something called an SJPO, which means you can essentially "plead guilty by post". Saves you having to go to court, and saves the magistrate having to speak to you in person etc. A colleague of mine was dealt with this way when he was caught doing 105 on the M25 during early 2021 COVID lockdown. He pleaded guilty via post, received 5 points and a £550 fine.

I worked for a rail agency in York for a year, I commuted from Sheffield to York 5 days a week and on a weekend worked all over the country, Edinburgh to London. I did 40, 000 miles in a year. I still regularly drive to Scarborough (camera vans always on the A64) and all over the country. Continuous roadworks with camera enforced speed limits on the M1, a 30mph, yes 30 mph speed limit with average speed cameras on the M180 to Hull.......cameras everywhere I go and just can't seem to join your club!

If you don’t answer the NIP you’ll be prosecuted for it
@thefiestaguy8831
@thefiestaguy8831 11 ай бұрын
If you don't respond to the NIP, the registered keeper is prosecuted for failing to provide particulars of the driver involved in the offence at the time, usually 6 points plus a hefty fine. From the date of the offence, they have 6 months to COMMENCE proceedings against you. I.e if they "CHARGE" you to go to court for the offence on month 5, but court is delayed or closed for 2-3 months or you can't attend for a good reason, it doesn't mean as it's now 7-8 months down the line you're off the hook, it's to bring PROCEEDINGS against you within 6 months. If you get summonsed to court or issued a fixed penalty, that is when that "time limit" stops.@@NoBody-gf8ie IF they don't charge, summons or bring some other form of proceeding against you within 6 months then that is when you can be considered "off the hook" so to speak. Note this is ONLY for Summary offences (most motoring offences but not all), also includes common assault.

8:17 - What if you get a NIP for speeding, and you simply cannot remember who was driving on that specific day, at 8.30pm, on that night . . . was it you? , or was it the wife ? (both legal to do so, i might add) Stating it was the wife, is perjury Claiming it was yourself, is admitting guilt to an offence, you possible didn't do! 11:06 - Its not that you *CAN'T* remember, its just that it could be either one of two people - both of whom you can name . . . . but cannot recall which one of the two, was driving at the time Anyone got any thoughts ?
@thefiestaguy8831
@thefiestaguy8831 11 ай бұрын
Then you go to court and tell the court you genuinely cannot remember who was driving, but you HAVE to demonstrate that you have made reasonable efforts to ascertain who was driving (for instance reviewing home CCTV that might show who got in the car at the time the journey started, and who was driving). It isn't a defence or excuse to just get the ticket, and go "I don't remember who was driving, and I can't be bothered to try to find out either" and use that as an excuse. It won't work and they'll find you guilty of failing to provide particulars for the driver which attracts 6 points if I recall and a hefty fine.

Hi can I ask basically I was stopped by a police officer a few days ago the time was around 2-3am in the night the speed limit on the road was 30mph I was speeding and a undercover came up behind me I did slow down quite a lot whilst he was coming and was driving normally after long story short I got pulled over up ahead in a side road and they said apparently there looking for a vehicle involved in a hit and run so not my car I complied with them checking my licence and everything they realised it wasn’t me the person. One of the officers just said the speed you were going you would get banned I want you to think about it. He said the police chopper got me that means not him. At the end he said we’re giving u a warning make sure don’t do it again. My question is as I got no ticket on the spot would I still get a ticket or not through the mail.

@@Nothing2cHere01 I got camera'd by a camera van doing 37 in a 30 - but it was an inner city road ( that seemed like a 40 ) plus, there was no signs entering that mile or so of road. There were only streetlights toward the end of that road. Apparently, the law says you do not need signage to indicate these speed zones. Very surprised about that. There was no signs. However, as a person like myself, who has spent 20 years outside the UK, the road systems seem rather different, having not driven in the country for that time. Also, in a town I have have been into. The thing is, these fines, for those in high powered sports cars, they do not care. if the idea is to reduce traffic accidents, then surely making signs abundantly clear and very large would be the best idea ? I'm amazed it is not the law to have signs to indicate speed limit zones.
@thefiestaguy8831
@thefiestaguy8831 11 ай бұрын
As a UK officer myself - no, that's a verbal warning. If he wanted to prosecute you or "report" you for the offence he'd verbally tell you at the roadside "I am reporting you for the consideration to be prosecuted for the offence of speeding, dangerous driving, no insurance" etc. Or you could receive a NIP through the post but this is usually from speed or red light cameras. If you get stopped and they report you it's usually a verbal notification from the officer which fully complies with the legislation. In your case, you were given a verbal warning to slow down. Nothing more.
