Although the cammer was an idiot to even think of overtaking there and then really dim to try it again when the lorry was already in both lanes, the lorry driver could have done better. If you need both lanes to get round the roundabout, take both lanes coming onto the roundabout. Caveat - There may be reasons not obvious in the video why that wasn't possible here.

Just because the police cannot see the driver does not mean they wont prosecute. Section 172 of the Road Traffic Act is the legal requirement of a road vehicle owner to provide details of an alleged road traffic offence to the police. It is invoked by a range of driving offences, most notably for offences of speeding. You are required, by law, to supply the details of the individual who was driving the vehicle at the time of the alleged offence. A section 172 notice is not an expression of guilt, but failure to cooperate can potentially lead to six penalty points instead of three penalty points. The police must send a notice of intended prosecution within 14 days of the offence. Failure to comply with section 172 within the designated period of time, or if the notice is returned containing false information, you could be subject to: A fine of £1000 A temporary driving disqualification Up to 6 points on your driving licence In the case of intentionally completing a section 172 notice in order to mislead the investigation into the offence, you could also face time in prison. Many people have been arrested for Perverting the Course of Justice and given custodial sentences for giving false information to the wrong driver.

So you'll get people just making their dogs the registered keeper.

If the police need to know whose driving at the time of the incident, they will sent the registered owner a Section 172 Notice. Section 172 Notice (Road Traffic Act 1988) is also known as a Notice of Intended Prosecution (NIP). It is a letter from the police which contains the details of an offence and asks for the details of the driver at the time of the alleged offence. They must identify who was driving and must do so in strictly limited time and just to say I do not know is not good enough. Section 172 gives registered keepers a defence if the information requested cannot be provided, and it's as follows; “A person shall not be guilty of an offence [under Road Traffic Act 1988 s. 172(2)(a)] if he shows that he did not know and could not with reasonable diligence have ascertained who the driver of the vehicle was”. For failing to provide information you will receive a fine of up to £1,000, 6 penalty points on your driving licence and/or a disqualification from driving. You must not withhold information as this is a much more serious offence.
