"This was the object of the Declaration of Independence. Not to find out new principles, or new arguments, never before thought of, not merely to say things which had never been said before; but to place before mankind the common sense of the subject; i[n] terms so plain and firm...." As a combat vet who returned to school at 35yrs of age, I carry a pocket Constitution & try my hardest to bring awarness to my fellow classmates on the state of our current affairs (at odds w/ the Constitution). This is a frustrating endeavor but this video will help immensly in it's clarity & straight forwardness. Thank you!

Thanks for the clear and concise overview of this founding document. Are there states that don't require the Declaration and Constittion to be taught in schools? You can 90% of Americans don't know this, but I teach U.S. History in Illinois, which requires all students to study these and pass a test before graduating 8th grade and high school. I agree, EVERY American should understand the principles within these documents. Thanks again.

Not only are the Declaration of Independence and the Constitution to be interpreted together, but also the Federalist Papers, the Articles of Confederations, other letters and correspondence of the Founding Fathers as well as 230+ years of jurisprudence.
@bsabruzzo
@bsabruzzo 10 жыл бұрын
I'd say you are correct up to a point. If you want to include "230+ years...", you should also include the ancient Greek and the Biblical sources. It gets all encompassing. Others would argue that "case law", what you call "230+ years...", is a major departure from natural law, from which rights are derived, and saying that "such and such" is okay because we said it was once before" or saying "I can't rule if that was right or wrong because nobody else has yet ruled on it" seems a bit self defeatist in some regards.
@mrwooster8571
@mrwooster8571 2 жыл бұрын
@@bsabruzzo Is 'natural law' fixed?
@bsabruzzo
@bsabruzzo 2 жыл бұрын
@@mrwooster8571 Generally, yes as it is nature (living, self defense, protection from others). What we as humans dirive from that is centuries of debate long. But when you boil it down, basic right are just that... basic. To that end, if a person rules they can take a life at will because it was ruled in a previous case, it becomes suspect as it violates a natural law. From three it can be open for debate and reasoning can be applied.

There is a very very holy letter that Rabbi Nachman wrote on the day of the battle of Trafalgar. It mentions the 17th of Tammuz which in 1776 fell on July fourth. The letter was found in 1922 when 17th of Tammuz falls on Bastille day. Gd definitly considers this declaration justification enough to allow the rebuilding of the third temple. People of truth are all from Jacob. (Jews are from Josef).

1) Rights are concepts, they embody the principles and values of a society. They are an agreement among individuals within a society that basic, fundamental, rules about what a sovereign person ought to be able to do, with respect and in concordance to the rights of other individuals. They are not metaphysical nor are they positively abstract, they are based on an understanding of reality. 2) CONTINUED.

Great Job! Very clear and to the point. Our founding fathers thought long and hard about this one. I did not know that our states were considered as equal to Britain's statehood. According to our founding fathers our states should be independent and sovereign. Not under the federal government at all.

That's what they tried to do with the Articles of Confederation; but it was a total failure. One main reason why they drafted the Constitution was to unite the colonies as one nation with a federal government.

***** Would it not be interesting to suppose, that all states of the USA be created as Sovereign states. Perhaps Free Trade agreements, passports, slavery, immigration of certain races, different currencies, etc., would foment wars and peace and mutual defense agreements; to the end that a much different Constitution might be created, to end all the bickering. I suspect it would come to fruition; perhaps at a later time; definitely different. . Food for thought . ad iudicium

2) The main purpose for the institution of government (and in my opinion, the only even moderately justifiable one) is so that one man may not have to fear another. In essence I would agree with Locke's (second treatise) interpretation of the purpose of government, but not his assertion that rights come from a creator. Rights are justified by their own merits, the existence or absence of a creator does not add or subtract to the quality of rights as social constructs based in reality.
@johnberger5539
@johnberger5539 2 жыл бұрын
The most important concept of American Government is that your rights derive from your Creator, not your government, and, should your government fail to secure these rights, you are honor bound to change or abolish it, replacing said governance with whatever form best furthers the pursuit of life, liberty and the pursuit of happiness.

We are the only country in the world that has a document at the foundation of our government that says our "rights are God Given", that government is not the final authority, and how we can be the most free people on earth. @title1teacher I agree with you about the source of rights, but, the same can be said of peoples or political societies. The Declaration of Independence was speaking of the rights of states not individuals. Its purpose was to explain the separation and liberty of the13 American colonies from the state of Britain. Why would individual rights be part of the discussion? Americans objected to being governed by a foreign legislature. This was a group thing not an individual thing.

The essence of government is power. "“Government is not reason, it is not eloquence - it is force! Like fire, it is a dangerous servant and a fearful master.” ~ George Washington. If this is true, then there needs to be a universal standard that exists outside of humankind itself to appeal to and to keep government power in check. For anyone that really wants to understand this, i invite you to read Washington's Farewell Address. It is profound. Ask for it at USCivicsTraining . org

If you want to understand the Declaration, and the ideas that this nation was founded on, study John Locke and read the English Bill of Rights. If you read the English Bill of Rights, you'll find sections of it were implemented into our Constitution basically verbatim. For example, look at the English Bill of Rights: "excessive bail ought not to be required, nor excessive fines imposed, nor cruel and unusual punishments inflicted;" and compare it to the Eighth Amendment: "Excessive bail shall not be required, nor excessive fines imposed, nor cruel and unusual punishments inflicted."

@drocketman2000 If you read the history of The abolitionist movement you will find that the fight to end slavery begin before this nation was founded. Both the Declaration and the Constitution were used to show that slavery was an evil. The US joined the UK in outlawing the African slave trade in 1807. For 30 some odd years leading up to the Civil War there was a constant fight to end slavery in the US. Plus we did pay a huge price in blood and treasure to balance these scales

@drocketman2000 - Slavery is wrong and wicked. However, that said, most people know little about the history of slavery. We immediately jump to the pre-civil war period, when the African Slave trade was at its height and it was its most brutal and fit your description of chattel property. In the period preceeding the revolutionary war, most people do not realize that there were slaves of all ethnicities and in many situations they came as endentured servants to pay for the passage to colonies

This is a good summary but it gets one important fact wrong. The equality clause is referring not to men as individuals but to men as groups or political societies. This makes more sense since the document's purpose is to announce the independence of the 13 American states. It was not a statement of individual rights. Also, this way of reading the Declaration spares the Founders the charge of being hypocrites since so many of them owned slaves.

With History you have to use the same context throughout, and the initial context is that "slaves were not considered equals to men" - a correct premise. The silent premise you have, that slaves ARE equal to men, may be true, but it would not follow to conclude that men in the past were defining "men" differently than today, but rather they were defining "slaves" differently. Your way is to say "slaves were never slaves", which is fine, but not in the particular line of logic you take.

@highenergyboy You do not answer how slavery ever got a foothold here in the USA if "all men are created equal", referring to individuals, was the creed of the Founders. They had to be foolish and hypocritical to say such a thing if they were slave holders. The equality they spoke of was of men as political societies or states. Each state has the right to govern itself, to be independent, to assume its EQUAL station among the powers of the earth. This is what Jefferson was speaking about.

@66605 Abolishing slavery simply wasn't feasible at the time. The Founders needed the support of the Southern states in ratifying the new Constitution. If they had tried to push for emancipation, these states would have most certainly recalled their delegates from the convention and withdrew their support for the Union entirely, and then there would have been no United States of America period. Instead, the Founders did the judicious thing by compromising on the issue and leaving it at that.

And yet, we discriminate against those who want to marry more than one partner. You say "we all know that is conrollable and just selfish". Those that desire a multiple partner marriage don't view it that way. The reason this is more complex than first glance, is once you redefine marriage once and establish some new judgement that marriage is only for 2 no matter what sex, you are in fact being judgmental of those that want marriage to be 3 or more.

LoopTheSnooper The main point--and insisted upon by the "Declaration"--is that the only legitimate government is one formed on the basis of the consent of those governed (and perhaps from "God"), nicely stated in the works of John Locke, Thomas Paine (and, yes, Thomas Jefferson). And, it was a response to the overbearing presence (and legal mess) visited upon the colonists...which, incidentally, we pretty much have again...in recent days in this country....run by the "Power Elite."

Bill Benton And that unalienable rights come from God and not man (or king, or government). And that to protect those God-given rights, government is formed (by the consent of the governed). In the case of the United States this was in the form of our Constitution.

Nerfball6 Yep, but not necessarily the Judeo-Christian god, but more of a general sense of deity (or "Providence"), for most of the Framers were deists (and violently opposed to the formation of a theocracy). Yes, the U.S. Constitution became the basis for the present gov't, but the principles outlined in the "Declaration" (and as reflected in the 9th and 10th Amendments) still exist, and remain seminally important. I have found it very worrisome that many prominent public servants and legal authorities--in recent history--have obstinately DENIED that the Declaration has any legal significance anymore. This stance represents an example of serious mischief, in my view. They also typically deny that our country is a republic, but merely a "democracy," which is--at best--is a very wish-washy concept. Arguably, what we TRULY have today is a kind of plutocracy...or quasi-republic.

Bill Benton To Bill and other readers of this stream. I used to believe the "majority of founders were Deists" teaching, as it became prevalent in the Progressive era and has been propagated for the last 70 years in education. However, I have changed my mind after an exhaustive study of the founders in their own words and in understanding the times and culture in which they lived. I think anyone interested would find the 8 part series on this link fascinating, including "what is Deism", the names of God the founders used, the Jefferson Bible Hoax and more. christiancivicstraining.org/founders-and-deism/

Bill Benton There was no other God that the founders believed in. While a couple had differing views about the divinity of Christ. None of them believed there was any other God but the one God they all wrote about and quoted as being the author of our rights; the Judeo-Christian God. None were deists in the modern sense as they ALL believed that God was active in the lives of men. Understanding this does not mean we are any where close to a theocracy of course. As even a person's right not to believe in God is protected under their unalienable right (from God). A concept they often struggle with. And you are correct ... while the DoI is not a legal document in the same sense that our Constitution is, it's purpose (and that of our government) is to protect the unalienable rights declared in our founding charter. You can not separate the two. the DoI is as important (if not more important) a document as our constitution; and why the 4th of July was and is celebrated with such importance.

At the risk of seeming argumentative, please understand I respect the beliefs of others, but there is something that should be explained if this is indeed for people of other countries. The founding fathers were Christian men, in an era of religious importance, and they still used terminology of the day. such as "Divine Providence" to give weight to their words, but not intent towards the foundation of the country. The United States of America is not a Christian nation, it was never intended to be. It was founded more on the beliefs and teachings of John Locke who believed in natural law, not gods law. It is clearly defined in these founding documents, as well as personal quotations of all the founding fathers, that the idea of separation of church and state was a cornerstone of the new government design. The idea that freedom of religion, the ability for the people to believe whatever faith they chose, or no faith at all, would not be at odds with the will of the governing body. They saw too well the danger of theocracy, where the combination of church and state became an intolerable force of tyranny and absolute, unquestionable power of dominion. And they saw fit to forge a government where that would not be a threat. The idea that our government leaders are sworn in on a bible is a vestige of old habits that die hard, modern officials should be sworn in on the bill of rights to truly represent the spirit of the founding fathers and the intentions they had for the nation.

John Locke believed that the Natural law was the laws God sat up for nature, he was a Christian philosopher who had a great influence in America. He said: The Law of Nature stands as an eternal rule to all men, legislators as well as others. The rules that they make for other men's actions must . . . be conformable to the Law of Nature, i.e., to the will of God. Laws human must be made according to the general laws of Nature, and without contradiction to any positive law of Scripture, otherwise they are ill made. Locke, Two Treatises on Government, Bk II sec 135. (quoting Hooker's Ecclesiastical Polity, 1.iii, § 9 ) Also William Blackstone who all the founders were familiar with, especially those who were lawyers said in his commentaries on the law "Man, considered as a creature, must necessarily be subject to the laws of his Creator, for he is entirely a dependent being. And consequently, as man depends absolutely upon his Maker for everything, it is necessary that he should, in all points, conform to his Maker's will. This will of his Maker is called the law of nature. This law of nature, being coeval [existing at the same time - ed.] with mankind, and dictated by God himself, is of course superior in obligation to any other. It is binding over all the globe in all countries, and at all times: no human laws are of any validity, if contrary to this; and such of them as are valid derive all their force and all their authority, mediately or immediately, from this original. The doctrines thus delivered we call the revealed or divine law, and they are to be found only in the holy scriptures. These precepts, when revealed, are found upon comparison to be really a part of the original law of nature, as they tend in all their consequences to man's felicity [happiness]. Upon these two foundations, the law of nature and the law of revelation, depend all human laws; that is to say, no human laws should be suffered to contradict these."

I disagree. Much of John Locke's arguements were based on biblical doctrines. Yes, founding fathers were skeptical to give any church let alone any religion political power, but it is to secure every religious practices. Separation of church and state is first coined by Th Jefferson to a Baptist Church, against possible tyranny of the Calvinist state. Yet, they never intended church to be of any less significance. They wanted religion to be the moral arbitrators of the new nation.

PS I have studied the Declaration, the Articles, the Constitution, the Federalist Papers, the Anti-Federalist Papers, the writings of the founding fathers and proposed alternatives like the Grand Union. I do not take Confederate [Dixie] Revisionism, Dominionist [theocratic] Revisionism or Libertarian Revision seriously. They are actually self-serving unworkable stupidities like the "Sovereign Citizen" nonsense.

"All men created equal" was just a piece of French liberalism. The slave owning founding fathers did not believe it but they had to say it because they were in the middle of a desperate war. They don't blame much on British parliament because there was a minority block against the war in the parliament. They did not want to spoil that... Sorry to disappoint but the real founding document is the Constitution, not this propaganda document. The real purpose of the US is in the preamble of the constitution, "to secure the blessings of liberty to ourselves and our posterity"

Spinmeister, you disparage others for interpreting the Constitution and Declaration away, yet you do the same here. There is no restriction on rights in the declaration or Constitution [except for slavery in the latter-good luck reestablishing that]. It does not say, "except for gays, lesbians, atheists, brown people or black people." Your attempt to warp the meaning is every bit as bad as those you criticize.

Jason, this seems like a bit of hyperbole... The words "Jesus" and "theocracy" are not mentioned in this video. I invite anyone reading this thread to watch this Declaration video again and the Constitution videos on this channel and see for yourself. The word "theocracy" is usually used as a scare tactic to drive any expression of faith out of the public realm and to frighten uninformed people into thinking that any mention of God in public affairs is akin to having the equivalent of an Islamic Theocracy.

This is evasion and possibly hypocrisy. You have also neglected, for propaganda purposes: "Prudence, indeed, will dictate that Governments long established should not be changed for light and transient causes." You also neglected to mention that the present Constitution is the second, following the first one that COULD reasonably be said to be conjoined, Articles of Confederation and Perpetual Union. Perpetual union is SO difficult for you, that you left it out, of course!
