Most property agreements are not registered and when there is a dispute about them, the parties have to go to court. But the rule of law is that the document which is required to be registered and it has not been registered, then the court does not accept it as evidence. There is a provision in the Specific Relief Act that specific performance of certain agreements can be made even if they are not registered. In this video the same situation has been clarified that which property agreements are required to be registered and which agreements are not required to be registered.

1. 2014 me mera agreement भीमा k sath hua tha pr usne registry nhi karwai. 2. Lekin jb mai abhi dusre party ko sale deed krva rha hu to usne Spl.C.S. kiya. Or use TI mila. 3. firbhi maine registry karwai but seller ne Rs. 800000 kam diye taki o first wale ka court matter dekhega or use niptega. 4. But jab first wala compromise k liy tayar hai lekin second wala o Rs.8 lakhs nhi de rha hai. Sale deed cancel ki bat kr rha hai to ab ham kya kare?

Very informative video sir , but i still have doubt for specific scenario - we have a non registered/ non registered agreement to sell on a stamp paper - however the seller is now backing out in the last moment and is not willing to sell . How can this situation be handled in court , 1 . Can i go to court if the seller for non compliance 2 what if seller is admant on not selling property what % should be the settlement amount

If the agreement is not registered and possession is not handed over to the buyer and the payment in full not giving by the buyer to the seller..in this case if any dispute will arise from the seller side then who can move to the court first....and is it viable in the court. And most importantly if the aggreement is done by notary....then???

I find myself in an unfortunate situation. I have paid 20 lakhs as part of a 40-lakh property consideration. This includes 8 lakhs via NEFT as an advance and 12 lakhs in cash. However, the seller has not arranged for the possession, and the agreement's last date is in four days. The seller, a strong individual, insists that he will finalize everything in the next one to two weeks. I am unsure of my next steps. Should I go to the registration office now, which might lead to a prolonged court case? Or should I collect evidence of the 20 lakhs in my bank statement, wait for 2-4 weeks, and then consider legal action? Please advise.

Sir , I am a big fan of your simplicity and great knowledge. I have a question if you can help - If builder transfers the property in the name of wife after demise oh her husband and she gives POA , Agreement to sell and Will along with relinquishment deed and NOC to her daughter in law - Can daughter in-law do registry in her name or sell to some one else ? Possession is already taken but registry is pending from builder because of the OC. Please help if builder can still charge the transfer fee because registry is pending

Hi,under sec 53A of TPA no protection will be available for unregistered agreement,the unregistered agreement can be used as an evidence in suit for specific performance of contract.if you mention the date for registration the time will be 3years from that date.if date Is not mentioned for final agreement,the validity is 3 years from date of refusal to register.

हमारी बिल्डिंग मे बिल्डर के पास ३/५) १९७९ ka सेल अग्रीमेंट रजिस्टर नहीं है नोटरी नही है ओर पगडी की जगा है बिल्डर को ४७ bhadut jo मुल भड़ोत्रि ने आज तक एक सिंगल पै का भाड़ा नहीं भरे है ४० साल हो गये लोगो का भाडा बाकी है बहोत भाडूतो के नाम ट्रांसफ्फर नहीं हुए है लोगो का भाड़ा बाकी है लोग तीसरी पार्टी को भाड़े पे देकर मालिक बने भाड़ा वसूल कर रहे है कोई लैंडलोर्ड की पर्वांगि नही ली है फिर भी भाड़ा खा रहे है बिल्डर ओर उनके भागीदार दो जन ने अलग अलग जगह पे मालिक बता के लोगो से bhada लिया सब का नही लिया किसीको कचि भाड़ा पावती दी किसीको leterped छपाके लिख दिया और kisiko नोटबुक के पते पे लिख दीया ऑफिस पता मुलुंड का दीया ओर व्यवहार घाटकोपार् मे किया लोगो को मु से पार्वांगिं दी ओर उनके भागीदार ne नये आये जो भाडूत का भाड़ा मुलुंड मे लिया वे सब लीगल भाडूत नही है २०१३ मे नोटिस निकाली ओर उनका भाड़ा १९७२ से बाकी है जो रूम के भाडूत १९९० me १९८७ me aaye है उनका भाड़ा १९७२ से बाकी है लेकिन बहोत भाडूत के ऐसे केस मे १९७९ se १९९० मे दो दो तीन तीन पार्टी बदल चुकी है वे बिल्डर को मालूम नही है ज्यदा तर् J भाड़ा १९८७ के बाद लिया है जूने भाडूत बता रहे hai बिल्डर मालिक नहीं है ओर झूठा रेकोड बना रहा है बिल्डिंग को मेंटेन भाडूत करते थे कोई बोलने वाला नहीं था बिल्डिंग me B. M. C. केस file ki पुराने मालिक पे बिल्डर रिस्तेदार बन गया mulund police ने झूठा अहवाल सादर किया or me १९७९ से मालिक हु मै टेक्स भरता हु क्या builder ऐसी स्थिति मे मालिक बन सकता है की मेरा ताबा है फुल घोटाले है हम सब भाडूत परेसान है आप बता हम कया करे

@@sudhachinna3876 unregistered agreement do not gives any title or right in the property, it can only be used to file a suit for specific performance of contract. And can be considered as an evidence for collateral purpose, gift deed is not valid with out registration.

@@prasadvikram4034 sir in 2013 , unregister agreemen t by sis to other party, but my sis is cheated she did not get any amount, his own sis ter husband cheated her, after she give gift deed in 2015, gift deed is registered, but in 2015 agrement holder put case that it not give rtc to gift deed , now in yasodha court i get rtc in my name, cani forward to land convention sir, still case is running

Namaste @VidhankaGyan Sir, 6 saal pehle mere papa ne apne mamere bhai se ek jamin kharidi thi, jiska agreement meri mummy ke naam par 500rs ke kagaz par hua tha. Agreement mein saaf likha hai ki buyer jamin par kuch bhi kar sakta hai, aur unke pariwar ka koi sadasya virodh nahi karega. Uncle ne registration karwane ka vada kiya tha, lekin ab unka dehant ho gaya hai, aur unki beti aur damad wo jamin kisi aur ke naam likhna chah rahe hain. Humne registration ki koshish ki thi, par us waqt uncle ki tabiyat kharab thi. Ab unki wife sab jaanti hain, par unpe pressure daal rahe hain kyunki wo unhi ke ghar mein rehti hain. Jamin Jharkhand state mein hai. Kya hum court mein appeal karke apni jamin le sakte hain? Agreement ki copy unhone maangi, jo humne de di. Kya isse koi dikkat ho sakti hai? Kripya salah dein. सर हमने एग्रीमेंट करके नोटरी करवाई है और उसे एग्रीमेंट में कुछ पैसे नगद और कुछ पैसे चेक से दिए हैं और एग्रीमेंट की तारीख 3.3 2023 में कंप्लीट हो चुकी है उसके बाद हमने उसको नोटिस भी भेजा है परंतु कैस नहीं किया है, अब उसे एग्रीमेंट की तारीख को कंप्लीट हुए डेढ़ साल हो चुका है तो क्या अब हम उसके ऊपर केस कर सकते हैं?

सर क्या 10 से 15 अलग अलग लोगो से जमीन लेकर एक बड़ी जमीन बना सकते है क्या ओर अगर उन जमीन के बीच मे रास्ता हो तो रास्ते का क्या करना होगा क्या हम रास्ते को साइड से निकाल सकते ह अपनी खरीदी हुई जमीन से उस रास्ते के जितनी साइड में जमीन छोड़ कर या फिर कोई और समाधान हो तो बताये ओर maximum कितनी बड़ी जमीन बना सकते ह जमीनों को जोड़कर ओर सर जमीन जोड़ने का पूरा प्रोसेस क्या होगा धन्यवाद

Sir, if there is a single registry for 2 adjacent plots (let's say plot No. A1 and Plot no. A2). Now I want to sell these plots to two different buyers (let's say plot A1 to buyer 1 and plot A2 to buyer 2)and before that I'am entering into a sale agreement with both the prospective buyers. Should I be doing two agreements, ie. one with each buyer?

A person sold one plot number in a venture to 2 different people .... 1st person registration has all 4 boundaries / directions wrong ... 2nd person registration has all 4 boundaries / directions correct and accurate when physically checked in the plot location. Now who has full rights of title 1st registered person (or) 2nd registered person ?

Should we mention that we are taking possession of land in agreement or not? Second question is if registry is not happens in 3 years after agreement what will be further step can we mentioned this in agreement that we can take more time than 3 years for registered agreement_registry? मैंने एक मकान हरिद्वार के निकट खरिदा अग्रिम राशि लगभग 40% दे दी।पर पता चला मकान बैंक के पास बन्धक है। मैं तत्काल रजिस्ट्री के लिए तैयार हुं पर विक्रेता एग्रिमेंट करवा कर 3 माह का समय ले रहा है। मकान का कब्जा मुझे दे दिया है। और एग्रिमेंट रजिस्टर करने को अनावश्यक बता नहीं करने दिया।क्या मेरे साथ धोका हो सकता है?

महोदय, 2014 में मैंने बिल्डर से अपनी भूमि पर निर्माण कराने के लिए रजिस्टर्ड एग्रीमेंट किया था जिसमें निर्माण पूरा करने की समय सीमा नहीं है बिल्डर ने खुद ही निर्माण की राशि लगाने और नक्शा पास कराने के लिए कहा था पर उसने नक्शा पास नहीं करवाया इसलिए नक्शा पास न होने के कारण एल डी ए ने 2019 में बिल्डिंग गिरा दिया है तो ऐसी स्थिति में एग्रीमेंट स्वत: कैंसिल हो जाएगा या कोर्ट से कैंसिल कराना होगा और इसकी प्रक्रिया क्या होगी? अब मैं खुद बिल्डिंग कंस्ट्रक्शन करना चाहता हूं तो क्या बिल्डर भविष्य में किसी प्रकार की कोई समस्या पैदा कर सकता है? कृपया सुझाव दे🙏🙏
