No one else wants to be restricted according to what you do not see. You are free to go on with not having a gun. You are not free to impose that privation upon us. Under the highest law of the land, neither is any government entity within the United States. Those that do and violators of the US Consitution and as such traitors to their oaths of office. I know that you are much to young to remember it, but there was a very long stretch of human history, thousands of years, in which guns were absent, and there was no "gun violence." Guns that one could carry individually were not invented until the tag end of the Hundred Years War back in the middle 15th century. For that there was no shortage of ultra-violence. In mediaeval times, the lives of most people were literally lorded over by barons, earles, and dukes who were backed by professional soldiers who ruled through greater strength and fighting ability and the possession of swords and armour. Stupid, low, and common peasants, most people, were not allowed to have weapons and were monitored closely as were blacksmiths who could manufacture them. The invention and evolution of firearms played a large role in ending the mediaeval period.

States should be required to pay for any and all appeals to the Courts where SCOTUS has already made decisions regarding constitutionality. The states continue to ignore these decisions because they know that most of us can’t afford this lengthy, expensive process. As long as it costs them nothing, they have nothing to lose.

@@tristenklein225 Well add another problem to that. SC has our main ally in Justice Thomas. There are three judges on the left that don't rule based on the constitution. That may be a future problem given Thomas's age. The actual enemy is the left and whoever had infiltrated the alphabet agencies. To answer your question it's going to have to be you and me working to get those morons out of office. They have been groomed for years to do whatever it takes to destroy our country. Soros has stated it publically. I guess the people that really want to save this country may need to be the ones that refresh the tree of liberty and you know what that means. We have no means of forcing the states to obey SCOTUS rulings. I wish we could simply state if you fail to comply with the Bill of Rights and Scotus Rulings that affirm that than you are no longer part of USA. Unfortunately, SCOTUS rulings have no teeth. No power to do that.

One thing that would be beneficial to viewers, I think, is to periodically have experienced 2A lawyers from each state as guests and have them explain some of the more important points of firearms and self-defense laws in their individual states. I'm over 60 and the worst crime I've ever done is a handful of speeding tickets in my life. But two of the areas you touched on here could combine in a bad way. On a given day if I decide to legally conceal-carry, then I have a personal rule that I never leave a gun unattended in a car. Period. As the anti-2A people define more and more places as "sensitive where we cannot take a gun", the risk increases that someday I might violate a sensitive place rule and maybe, possibly, somehow it gets discovered and I get convicted of a crime. Then I would "be a felon" and lose my 2A rights simply because I safely and properly conceal-carried into a place that somebody defined I should not take a gun. The anti-2A people would call that a victory.........

The only place you shouldn't be able to carry is in a court room. Anywhere else should be fine. Being told you can't in certain places is an infringement on a person's freedom. Why do people want to live in a free country then want to restrict someone else's freedom. If you dont like guns maybe the USA is not for you. Just a thought.

Their playbook is death by 1000 cuts. Little by little, until gun ownership is owning a single shot 22 or is too expensive for the average citizen to own and shoot via fees and taxes. Funny how they really want to ban AR platform and similar other platforms, even though the ar15 is responsible for less deaths than blunt objects. Once they do that, it’s on to handguns because “too concealable” and they kill the most (they will include suicides in this count as well). Next will be larger calibers because “long range sniper machine” and “nobody needs a firearm that goes passed 300 yards.” Shotguns will be next because “close range death machine that even the nazis feared.” What gets me the most about the “gun violence” number is that they always include suicides in the number. When somebody gangs themselves, we don’t call it “rope violence”.. when somebody jumps in front of train, we don’t call it train violence. Same thing with cutting. We don’t call it razor violence.

Thank you for the insightful analysis. One thing I would like to see but I don't know how feasible it would be is to describe what "effective advocacy and networking" looks like for your average concerned citizen. I get it, we've all heard, "call/email your elected official". But I take the inspiration for my question from my experiences with a dedicated gun-control activist who is married to an acquaintance of mine. She is an activist who is enabled by Everytown and a few other gun-hating organizations. How can we connect disparate pro-2A citizens to coordinate a grassroots army to counter those efforts. I donate to the GOA, 2AF, NAGR and NRA. I contact my elected officials but I don't get successful feedback about my efforts or who else in my city, county, state are doing the same.🤔

Tom, appreciate you diving into this subject. What I don't understand is how under other precedent setting cases we see the states effectively cease all lawmaking that would be in conflict with the ruling ,or if there is a such a conflicting law, the plaintiffs challenging appear to get immediate injunctive relief. In the case of the 2A law, we have a continuous stream of bad legislation that has to be litigated over every nuance of the law and the cases just drag on for years. This is trampling our rights as a legislature can pass bills all day & night in direct conflict with Supreme Court rulings you noted. What if anything can be done given the power imbalance of legislatures who continue to pass new laws clearly in conflict with multiple precedents and the state attorneys who have the infinite budgets to draw out the cases for years.

the democrats control the U.S. senate, but a strong majority of the state legislatures are republican controlled. this is important because it prevents the radical democrats from holding a constitutional convention to revoke all of the Amendments in the Bill of Rights. As regards historical racist/discriminatory actions against African Americans with regard to gun ownership during the slavery period and beyond , I've just completed a book "Negroes and the Gun" written by Nicholas Johnson. It's a great read and provides a key perspective on how important gun ownership was to African Americans in their struggle against slavery.

I reside in NY, which reacted very quickly to Bruen by making almost EVERYWHERE a "sensitive area". Every place of business must post a sign stating they are OK with legal gun carry, and if a place of business has no sign, then BY DEFAULT THAT MEANS it is illegal to carry concealed in that place. This law was passed, but not advertised, and so of course most business owners have never heard of this law, (and obviously have no sign!) Talk about a quick law that has no precedent, and no consistency with history or tradition! So anyway... my request here would be that you keep abreast of the NY battles, and let us know who (if anyone) is fighting this particular battle (ie the "we'll just make EVERYWHERE a sensitive area" concept), and also let us know how those battles are going! Thanks, and keep up the good work!

I concur. I've always known "standard capacity" magazines to be STANAG magazines (NATO STANdard AGreement magazines for all NATO countries magazines, drafted in 1980, so that all magazines would be 20-30+ rounds and fit in most NATO 5.56x45mm AR15 lowers), so (though I know where the Anti-2Aers got their 10 round magazines "hunting story") I'd also like to know why the Anti-2Aers are focusing on reducing STANAG magazines from 20-30 rounds to 10 rounds. Not accidental imo.

I live in NY state. What I'm not understanding is why I need a permit to purchase a handgun. Not to conceal carry. Just to have in my house. We can buy shotguns or rifles with a 4473. Why is it that we need a permit just to "look at" a handgun in the store?

One problem in the tactical stance of citizens who are in litigation is to forget that THE ATTACK of the anti's is against the Objects of the self defense right; i.e. mag capacities, bumpstocks etc. but these are in law irrelevant to the meaning of the 2nd Amendment; its purpose is that every human being have the capability of armed defense, wherever they are at a given moment, in public or in private scenes. The focus, Constitutionally, is the person, not the kinetic means! We must not lose sight of this ! We cannot allow ourselves to be "nibbled to death by ducks!" History is clear that the person/people must have whatever means it takes to remain safe,OR, TYRANTS WILL RULE. This is 1000's of years of history, not simply legislative US "history."

We all know that prison is a graduate school for criminals. It's about punishment, not reform. Plenty of unsafe people are released from prison every year. Check out the very high rate of recidivism. They shouldn't be out in society but they are.

I strongly agree I would say that they should be done with all probation and or parole but most definitely need to be a full citizen again and not a life sentence for any felony charges I have family members that have been in prison and they wouldn't hurt a fly so why wouldn't we all want them to be able to vote and own a gun to protect themselves the only rational reason is that the government wants to take away all our rights and so they will have the lowest of scum attack everyone possible to make as many people as possible into a felon and destroy the ability to vote out the trash in government jobs

Please do a video with an analysis of the Constitutionality of magazine capacity legislation. This is of particular interest to me as I reside in Colorado. We have had a 15 round limit in effect since 2013. RMGO fought the ban in Colorado state courts for three years and it went to the Colorado State Supreme Court and that court (populated with Democratic Party installed Jurists) upheld the capacity limit using interest balancing analysis. RMGO filed suit against the capacity limit in 2022 (post Bruen) in Federal District Court and it is in process. The anti 2A defendants in the suit, (State of Colorado with a lot of Bloomberg money assisting them), are of course arguing that the ban is Constitutional as firearms magazines are “firearm accessories” and are thus not protected by the Second Amendment.

The 2A has been severely degraded for about 90 years and is not too far away from its inevitable death. I’m sure I’ll see its abolishment or complete neutering within my lifetime. But what I’m most worried about is how they’ll go about collecting them seeing that they have a registry.

Tom, I am curious to know which is dominant Federal law or State law with regard to the 2A? As with marijuana laws many States have passed their own laws disregarding Federal law and for the most part gone unchallenged.

GREAT summary and foresight! BG2 11:46 “ordinary weapon”… in contrast to “dangerous and unusual”? Can you dive into that? CRS has said that phrase was taken out of context, and perhaps should be dangerous AND unusual AND used/displayed in a threatening way? Others say “dangerous OR unusual” (4 boxes diner says that is wrong). I would think any military or NATO standard issue weapon is “ordinary” and the 2A was for arms used by civilians and military all the same.

Thank you for continuing to create such informative content, I have especially appreciated your previous videos providing a prosecutor's perspective in order to help me think through not just the physical risks, but also the legal ramifications following an exercise of my 2A to protect myself. There's been quite a bit of defensive litigation to remove infringing legislation, but I'd be interested to see if there is any offensive efforts against future constitutional infringements. Legislatures have nearly limitless funding to create and defend constitutional infringements, and citizens are stuck paying the salaries and expenses for creating and defending those infringements, while also donating for the challenges; it seems like citizens are footing the bill for both sides. I'd also be interested to see if there's any movement to hold gun control accountable for the claims that it makes. Do we see any emerging accountability regarding "sensitive spaces"? Unfortunately, I still live in a state that believes in such concepts and hopefully that changes in the future, many people I know are unable to escape these ideas in their legislatures. Since citizens aren't legally allowed to carry in "sensitive spaces", are the governments/businesses that classify a location as a "sensitive space" accountable legally and civilly liable if there is an attack for putting those citizens in harms way by disallowing them to personal protection in the event of such an attack?

Tom, as you know NY immediately crafted a new anti-2A law ( CCIA, Concealed Carry Improvement Act ) after Bruen, which is even worse than what Bruen dealt with. It's been challenged, but the challenges have been stagnating. One of the judges in Second Circuit ( ? ) forget which exactly, but made a comment "all these people going around with guns". Information is very hard to find, so I would like to see a close watch on this issue, and the status of it. The CCIA is a slap in the face of SCOTUS and the people of NY. Thanks

Thanks, Tom. I would like to see gun owners, including myself get more information on two tier balancing and why Bruen struck that down. More information on weapons considered dangerous AND unusual(goes to common use) . More info on chevron deference and why it's bad. A bit more rounding out on when the burden of proof shifts to the government versus text, history and tradition. There's a lot to unpack but the little I have learned has really helped me to understand why and how the recent decision by that nit-wit activist judge in Illinois on the 'assault weapon' ban fell apart re Bruen. Just hit the mechanics of these concepts without going too far afield. IMO it's important for those of us that value the 2A understand it's upper-level workings .

Really enjoy your posts. Very interesting broad over view here. I suggest we are looking at a. A 20 to 30 year maturation of the Second Amendment b. This issue is a States Rights vs. Federal Powers. The States and Feds have been at this for the last 100 years, I see this being an ongoing 100 battle. It's not just guns rights and incidentally knife rights.

Like most gun regulation, it was written based on the fears of the day. Automatic firearms were in there because of Mob violence. The St. Valentine's Day Massacre in Chicago was only a few years before. There was concerns about poachers using suppressors. They were going to ban handguns, and worried about people adding a stock on them to work around the ban. So they banned short barreled rifles. The handgun ban was dropped to get it passed, but the SBR ban remained. They were thinking of things like the stocks for the handguns like 1873 SAA, the Luger holster/stocks, etc as workarounds to a handgun ban.

From what I have read is U.S. Post offices are off limits to gun carry. They have posters on bulletin boards. You can't even be on the property / parking lot with a gun in your car. If you park in the parking lot with a gun on you or in your car, and if the Post Office has what is called special handling area where Guns and Drugs or other Dangerous item are recieved or shipped you will get inhanced charges put on you. Their is several cases on line where employees have been charged.

What’s your suggestion on what citizens can do to help stop or amend legislation going into discussion? MN has SF1723 coming through the pike that will try to implement registration, “assault weapon” bans, large capacity magazine bans, etc. MN also has a very low rate of gun homicides, nearly neck in neck with CA even without the restrictions that CA has. I’d love to see a video about what we can do besides vote those out who bring these forward! Thanks for all you do!

@@jaynecobb1 I also spent a few years of my childhood growing up in New Mexico. It pains me to see the beautiful state I grew up in and loved ruined by liberals. Santa Fe has been a liberal stronghold for years, but I remember it in the 70's and 80s. It wasn't this bad, this unhinged.
