Great video. On C(2), I would never use it for the reasons you introduced and also for possible future litigation. It's just too murky and I can see some attorney using that box against me. I also feel it's penalizing your seller for something they cannot control. I've dealt with unrepresented buyers in the past and I don't feel there was any additional work I had to do.

You make a fair point. That said, unrepresented buyers should not be offered any assistance above the same courtesy provided to a buyer's agent or attorney. No free lunches.

First of all, I want to thank you for your high-quality content, your videos have been incredibly useful!! I have a question regarding the old RLA form. I listed a property five weeks ago using the previous version of the RLA, with a 5.00% commission and a 2.50/2.50 split. My question is, should I sign an addendum or form with my client to clarify the commission I’ll receive when the house is sold, since the 5% commission is no longer applicable?

Given that the change is so radical, I think it's best to just replace your old listing agreement with the new version.

for part C(3) does this only count for a buyer that YOU showed the home too? or can this apply to any buyer that approaches the listing looking to buy after it expireds? im not sure if you meant that you would only get compensated if its a buyer that you previously showed the home too yourself before the listing expired and that buyer now comes back looking to buy or what if it is a new buyer that you never met that approaches the home/seller loking to buy after it expires...does this count as well? thanks in advance! and i truly appreciate your educational videos! they are helping tremenduosly especially with these new forms and practices

Completely agree about the love letters section and the NHD. Love letters should be allowed and they do get buyers the home. I get why they have the reports section (F3), but they should ALL be optional. I plan to use the additional terms section to eliminate that checkbox.

Most agents will just ignore the checkbox rather than make a change in the additional terms.

@@BalboaRealEstate Agreed. It just takes one more thing away from being negotiable and one more thing that the buyer can't use to sweeten their offer. That's a very small part on why I find this settlement anti-consumer.

Great Video! Regarding section C2. If you are not in any way helping the buyer, how do disclosures work? The listing agent is sending documents to the buyer to sign and they may refuse to sign all of them. If they are drawing up their own offer it may not even reference disclosures. I can't imagine a broker moving forward with a transaction where the buyer has refused to sign any seller disclosures. C2 is bad on so many levels. If the buyer ends up displeased after the sale and a professional is involved (listing agent) in the transaction, courts almost always side with the buyer/victim who was "taken advantage of".

Treat an unrepresented buyer like a buyer's agent. Email them disclosures to sign and return. If a buyer refuses to sign disclosures (effectively just an acknowledgement of receipt) then a notice to perform should be sent by the seller followed by a cancellation. No help beyond the courtesy you extend to a buyer's agent should be given to an unrepresented buyer. Any help you give can and will be used against you. I agree about C2 - it's a trash provision that has no business on the RLA. It will also incentive listing agents to welcome unrepresented buyers and engage in ethical violations to get paid extra by the seller.

Question for you…what if the seller is open to a concession conversation, but doesn’t want to commit to it being publicly displayed, and depending on the seller’s net they may want to decline concessions…Can we complete it as a no (as default)and if the seller has change of heart, they can offer concessions whilst in the transaction?

If a home is listed already, and this form is introduced will the original agreement automatically be void once this is signed?

No, the last one must be canceled or there must be verbiage in the new one that it supersedes the former. there must be verbiage to tie up the loose end.

Thanks much. How about if seller says, "wait till buyer brings their request and exact $ or % amount" on concessions.How do you fill 5B in MLSA ? Can we say yes in MLS

I would phrase it to the seller "is it something you'd ever consider?" If the answer is yes, even remotely yes, then check the box 5B2. Only if a seller said to me there was absolutely no way they would ever consider it would I not check box 5B2.

If I am selling my own property and do not want to collect comission on the sale what should I enter in C(1) 4B. It default to blank if i enter zero or (0%)

If you are a the broker/owner then yes, if you are part of a brokerage then they likely have a minimum commission.

Only if there is evidence the seller ACTUALLY discriminated. I mean, one could argue that showing a buyer's name on an offer could lead to discrimination; it's hysteria.
