I have 3 legal easements across my property in another field and they have a right to use the road and maintain it if they want to...thats the reason for an easement here in NY. I cannot stop them from using the road to get to their property. Ya a verbal is nothing these days. Sounds like the son was trying to be friendly.

Never buy land from family unless all easements are covered and everything is included in an iron bound contract. Families are the worst when it comes to the unwritten promise’s. When something happens, most often all hell can break and every thing “promised” gets forgotten!

Great video coverage. Interesting situation you had. Fourteen different households had to sign off when I made a home purchase in Haywood County, in Western North Carolina. The Patriarch passed away sadly, and her home was forsale. Decades earlier she deeded out 12 separate parcels to many family members in equal shares. My home had to pass 5 other home sites down a shared easement driveway. Homesite/owner (lot#7), erected a gate and locked it closing off access to additional homesites preventing access to their land and homes. All this coming years prior to me finding the home thankfully. Over years of battling in court it was settled that she can retain the gate but it could never be locked or secured, Dividing the family forever. That history came to playout during my transaction, delaying my purchase closing date by over 3 months as I awaited each household to sign off on the sale itself. BTW as the new guy, I did maintain the common use driveway to help ensure peace remained.

^^^^ this right here is the best advice on the whole comments section; we have a deeded easement w/our old neighbor- but he passed away and the property got sold to some new folks; a really nice lady and her now ex-husband; the ex-husband thought he could shut us out of it which would have left our parcel land-locked; after a few calls from our lawyer he had to concede; he's outta the picture now, and her and i are now good friends and she's a great neighbor! there's a reason you get everything recorded with the county, and it is worth every cent.

I was a contractor for 30 years before I retired, those are just a couple of the worst. I've also had some great neighbors who will have a place in my heart till the day I die. My daughter trained and became my 'line and grade' at the age of 19, and she looked much younger, as a result people often did a double and triple take when they saw her. On one particular job a 6 year old girl walked by everyday on her way home from school and when she saw my daughter she started stopping. Before long her dad showed up to check out the situation, he turned out to be a teacher at the local school and we all became close friends. I ended up letting her stand on the catwalk of my excavator for hours, (not quite osha), and ask me relentess questions while I dug sewer and water mains, (she barraged my daughter as well). She wore the cutest pink cowboy boots so on my last day in town I took her a cowboy hard hat as a parting gift, by coincidence it happened to be her birthday that day.

I do not think they should be called "neighbour". His real title is "landowner" and everyone but them has zero right to be on their land. Look at it that way, not the way the person that hired the contractor told them what they wanted to be real. BTW the contractor did not and should not have to go through anything. He should never have started a job without legal right to enter someone else's property. Sounds like the hiring party is a real winner, thinking the real owners were away for a longer period of time and arranging an illegal trespass to occur at that time. NO doubt they thought that possession of a road has some sort of legal standing. If so why are they building another road across another property? The same law applies to the old road the former owner used to access. Just nothing legal so just stop trespassing. I have a feeling all these people may just not talk to each other, forever. PS contact your real estate agent if they did not state there was no access to the property. THAT should have been on page one, initialed and notarized on all legal papers.

Raphael Szok in the state of South Carolina you cannot sell nor buy land that is landlocked either they have access to the state road or there is a recorded deed of a easement. I know this because my driveway is a easement to 2 other houses. And we all have to pay the taxes on it each year. That is a state law and there is no way around it.

@@vickiel1284 one tax bill but all of our names is on it. We just split it between us. When it's an easement right of way every person with land that touches it is part owner. And as owners we have to do all the upkeep on it. As far as the tax collector goes they don't care how the bill is paid as long as they get there money. And we just split it 3 ways. This is how the state keeps land from being land locked.

So, it's my understanding that if you are the property owner and you verbally agree to easement access, after 7 years of property (easement) use... the property owner loses his/her rights to the easement property and the non property owner then legally shares easement property ownership with the original owner. So, it may not seem 'nice' to say no to property usage, but as a property owner, being 'nice' can cost you ownership of your property. Now, I'm no lawyer so I could be 100% wrong, and if I am, I'm sure the internet will gladly let me know of my stupidity, but my point is, controlling property access may not be as simple as it might seem. It depends on the state laws. Your scenario is not the same in every state. In many states, you cannot be prevented from accessing your land and the owner whose land blocks the access has to provide an easement to the land-locked piece of property.

I don't know the details but when neighbors can't agree on a driveway it is usually because local government codes require ridiculous updates if more people use an existing driveway. Often easier to just build a side by side driveway and avoid mandated road maintenance associations and bylaws.

One thing I have learned over the years is to not take sides until you have listened to both sides. If I remember the story correctly the customer just bought that property. About 15 years ago I was part of a family argument over the land left to us kids by my mom. I did not live in the area and really did not want the 1/4 acre to start with. I wanted to keep the parcel together and sell it. After almost 6 months I called my sisters husband and asked him to meet me at a local cafe for some hot coffee my treat. We sit and spoke for about 2 hours. We finally agreed I would sell my part to them and would self-finance it. I'm still considered the black sheep of the family and the one being unreasonable. This is why I live almost 8 hours from my sisters.

In our little town you aren't allowed to share driveways. The town is trying to avoid future conflicts with snow removal, drainage, maintenance, etc. Sort of like, "Fences make good neighbors."

If there is no deed of an easement on the books at the tax office then they have no right to use his driveway. Also in the state of South Carolina you can not have land that is land locked. So for them to have bought the property all of this would have been brought to light when the survey was done. Now as the old saying goes. Not sure about SC but in GA that original drive could be a prescriptive easement if it was originally used to access your customers house and all that could have been avoided. Might have had to go to court to make it final but courts in GA don't allow for property to be landlocked if there was an existing drive that accessed it in the past.

currently going through this very same ordeal at my cabin here in arkansas, current driveway was made in the 50's, crosses on the neighbors land a tad. he approached me a few day's ago, asked me if i knew where my property lines were ?, i said..sure do !. he had this driveway surveyed a few weeks ago ( new stakes and markers were placed ). he told me he wants to move his mobile home over on driveway, i explained to him..sure...move it..but i'll tell ya this..according to arkansas law, YOU CAN NOT BLOCK, DENY ME ACCESS TO MY CABIN , IF NO OTHER ACCESS IS THERE FROM MAIN ROAD ?!. he say's back, yep..you are right...you seem to know the law. i can not speak for this guy's property in this state ?, but i can tell you this..no one..AND I MEAN NO ONE IN ARKANSAS CAN DENY YOU ACCESS TO YOUR HOUSE, CABIN, TENT..WHAT EVER, IF THERE IS ONLY ONE CURRENT WAY TO IT !.

I don't know which State this problem is happening in, but in most States, laws are clear about "land locked property access. Also, again, depending on the State, if that road/driveway has been in use for X number of years, it is "grand-fathered in and can't be blocked. I've dealt with this same issue in two different States when I owned rental property before I retired. The Court's take a very dim view of people that try to block off a road/driveway. One of my rentals had a gravel road, about a half mile long that had 6 houses on it. The road was beat to hell, full of potholes, flooded every rain storm. I talked with the county road commission about them grading and maintain the road. They claimed it wasn't an Official road because no one had ever applied for it. I hired a attorney to research the issue and what needed to be done. Basically any property owner could apply to the commission to make it a county road. Any objection from neighbors would require a Court hearing. Of course one refused, he said "not one inch" when he was told his property line would no longer be in the middle of the road, new property lines would now start 8' from the center of both sides of the road. My attorney even found courthouse records dating back just after the civil war about this road. It was a no Brainerd for the Cort to rule in my favor, and a couple months later, construction crews/equipment showed up, graded the road, spread new gravel, and then ran a big roller back and forth compacting the gravel. Then on top, the road was officially named by the county, and a street sign was put up.

I wouldn't just leave. If the owner of the house wants to smooth things over, leaving it in the best condition is a great start. You also don't want to leave it in a condition where it could cause damage later or erode quickly and have issues of non-payment due to perceived poor work. So I suppose it's the right thing to do by himself for there reputation and for the customer. Mutual benefit, well done!

They don't NEED permission to use that driveway, If that is the only driveway onto their land and it goes across someone elses land, then that person CAN NOT stop them from using that driveway to get to their land.... It's the Law (Whatever that means nowadays!) I believe it's called something like "The Right of Way" or something like that, I can't really remember....

We’ve found using geogrid in some culvert pipe installs to be quite useful. Cut out what we can put the geogrid down and backfill with a lift of good fill dirt then place the pipe. Geogrid runs up the sides and folds over to extend under part of the road. Anchors it nicely. Tough deal on the easement crap. I had a large clearing we had to postpone because the neighbor threatened to use physical violence on us. While we could have had the sheriffs force them to use the legal easement (in the deeds) we chose to not go that route because we knew our equipment would get vandalized while we were gone. So the owner is trying to purchase an additional easement now. Really stinks how ignorant some folks are.

In Virginia, I am buying a tiny house on a land locked piece of property with a right of way to use the neighbor's driveway to access my property. The neighbor lady tried to take the right of way back, but could not do it legally. The courts told her that once a right of way is given it is permanent. She tried to do this with an earlier home owner that she didn't get along with

This happens here in the UK also, they call them "ransom strips" where someone else owns the road/access to another piece of land/property. They call them "ransom strips" because basically the property owner who doesnt own the access is basically held to ransom for how much they got to pay to get legal access. There is a formula on how the price is calculated & it's not small change either, it often costs as much as the property you own to get access to said property.

when it comes to Easements, You really need to get it in Writing from Both(or More) Easement Owners. Just something from Future. If You Do Not get it or Verbal only. Say No to the Job. Since that 30 year old person said it was ok. But He isnt the Landowners. So now, guessing its the Mom and Dad. Could Technically Go after Not only the other Easement Owner(s) But you as well in Lawsuit. It has happened before, Couple Times around here too. Where Person gave Verbal Permission but wasnt the actual Landowner but a Uncle while landowners were out of town for abit. Company came in, Put in a Different Road access. Landowners came home saw it, Decided to Sue and won lawsuit as it was not part of the easement rules.

My family has an old cemetery from the 1800s located in the middle of someone's property. Over time it had got forgotten and to get back to it we had to get police to come out to tell land owners we had a right of way and make a road to it.

*The landlocked property owners are begging for problems.* From what I could find, they can usually get a court ordered *"easement by necessity"* if they can show the landlocked property and property needed to cross was once owned by the same person - it assumes the original owner meant for the landlocked property to be useful. However, this doesn't mean that the easement runs on the existing road - the owner can insist the easement take a different route. If 3 or more properties are involved (same original owner), the owner might insist on only a 20 ft. easement running down the property line (10 ft. from each property), or argue the easement should cross a different owner's property. There is also a *"right of way easement,"* which allows passage, but doesn't allow construction of roads, etc. (can be as little as foot traffic). The owners of property(s) that are candidates for an easement might claim the original intent was to leave the landlocked property as a nature, hunting, and/or rudimentary (tent) camping reserve, that could only be accessed on foot. *You shouldn't even consider landlocked property* (unless you own an adjacent property) unless it was inherited, because there's likely a reason the previous owner didn't get an easement. *I think on this property there is more involved - 3 properties:* The driveway to the landlocked property crosses over the property of another person who has been allowing them to use the driveway. It also crosses into another person's property to get around the ravine - that person understandably wanted to road off their property. The owner of the property with the driveway gave permission for them to use it, but was understandably upset to arrive home and see they went further to began clearing his land. *The owner of the landlocked property should have* tried to buy an easement, and barring that, gone to court to get an "easement by necessity" before performing construction.

Getting along is OK this isn't that....pay the man for right of way access or get lost. Both parties paid for their properties so let each use their own property or pay for the use of it.

I once made an offer on a house that ended up having easements on all 4 sides. One was to a 100 acres that could have become an apartment complex. The one easement necessary to get to the house I was buying was recorded in the wrong county and was invalid. I walked away.

Land sales are full of issues. Not to mention unreported wetland that get special gov protection or other waterways that get to be expanded or diverted by the gov whenever they decide.

I understand some people can cause problems. I did work with a logging crew. We would move in a place a the guy who was in charge of the timber deed would have everything marked out for us. So we went in and started hauling logs out pretty quick. I ran the loader and people would watch all the time. You could tell the trouble makers by the way they waved their arm and shouting. Didn't bother me because it's was so funny when they demanded me to shut down. But I would be like I don't work for you and stay back.

There is a parcel directly behind ours. Some people who were interested in it came roaring right through our property barely missed hitting our dog ( we are 1 mile off the main road). When my husband stopped them to ask what they were doing they told him they were buying the parcel. He told them there was no easement. They looked baffled, then said, but the realtor said it wouldn't be a problem. Husband said, "nope, no problem. There is NOT an easement" We are not required to provide one and did not want anyone driving through our yard just feet from our house. We bought this property for privacy.

When I bought my property, the realtor asked me what I was looking for. I said it would be easier to tell you what I'm NOT looking for! No easements, right of ways, shared anything, HOA's or neighbors! I would never buy a landlocked piece of property, especially family owned! That's a good way to start a war!

In Arkansas, that existing driveway to the house that had been used in the past would be an easement by prescription and the homeowner would win in court.

I watched another video from a KZbinr that I am sub'ed to... and he was helping an older woman move a potbelly pig off her property. WHY? Because the new neighbor noticed that she had a pig. So they contacted the county and found that the area they live in (very rural), didn't allow livestock. The gal had gotten this pig when it was only a few months old. It wasn't suppose to get much bigger than a medium sized dog...but it did. This was her pet. She didn't have a dog, cat, or a husband. You would think living out in the "sticks" that folks may have critters. If I had a neighbor that had critters, I would LOVE IT. I would rather listen to a rooster all day long than sirens or cars with loud exhaust rip up and down the main thurofare

We live in a litigious society.Verbal agreements can have liability consequences. The parents were not wrong to order the work to stop until those issues can be addressed.

When land is subdivided in NJ they make temporary rights of way easements, and correct the lot size if necessary which then gets approved! That’s the only way land can be sold. Unless your a nice landowner and you give the new landowners and right of way lease, which also has to be on the deed and survey! Went through this on my property! All good

Interesting how things are different from state to state and such. Here in Hawaii, if you have land-locked properly the surrounding property owners cannot prevent you from accessing your land. I'm not sure of all the details, but it seems like such a no-brainer thing that you have an automatic easement to access your property. I have heard cases wheret the property owner of the land you have to cross made things difficult, but they cannot block you.

Great excavator operator 👍👍👍 I used to run a 32k lb heel boom Barko log loader. And got damn good at clearing a landing of unwanted boulders. Could pick up a watermelon sized rock and sling it to hit a target 50 feet away 🤣🤣🤣 That, of course was on down time between trucks. I had a good time as a young man 👍 Also worked for a logging road builder up in the N. Cal Sierras. We had all our rock crushing and grading equipment on mobile trailers.

I tried to buy a nice landlocked piece of land (~50 acres) with no formal easement. The jack ass that owned the property completely around it wouldn’t grant an easement, and wouldn’t sell a tract. He and the family that owned the 50 acres hated each other because they wouldn’t sell to him cheap, so he was making it impossible for them to sell at any price. It would cost more to sue for access than the land was worth.

Been watching Chris " LD18" for years now, I'm so impressed with a young Man his age, at the pride he takes in his work, and how good he is as an operator. Well, I can't tell you the times over the years this same thing has happened to me !! lolol... I'm in Western Ky., and tell you what Man, there has been some times back in the day , i seen some knock down fights over easements !! lololol...And come to find out everytime they was wrong !! lololol.. But, it is what it is, all you can do , is just load up and leave , just like you had too, until all the fighting is over, and it's always a lot cussin' and fighting going on with this kind of thing...lolol...But, I'm sure it will get cleared on up so you guys can finish up...lolol... I had some one get some blank 'stop work orders' from the city and fill them out on a job of mine. They weren't signed, (I guess they weren't so stupid as to commit forgery), so we didn't take them serious. There were so many hostile neighbors on that project that we never found out who did it. We were developing the last big stand of trees in the area, (twenty acres), and they had begun to consider it as their own private park. On another project I was hung in effigy, (they made a little straw man with a hard hat and hung him from a tree in one of the back yards).

Never share a driveway and always get a easement in writing. And most states have laws about landlocked property and easement rights granting you the ability to put a driveway into your property due to accessibility

Allowing permanent driveway use can backfire if future structures are wanted nearby. However courts frown on landlocking.
