If a black guy did all these crimes. they would put him under the jail
@shenmisheshou70022 ай бұрын
Unlikely. In the US court system, judges follow guidelines based on a matrix. These guidelines were put in place for partly for the reason you mention, which is that black people were receiving far harsher sentences than whites. This federal tool prescribes a range of sentences. The judge can use a sentence that is higher than the sentencing tool recommends, but that sentence can be appealed. Likewise, the judge can sentence lower than the recommended sentence, but now the prosecution can appeal, as they are doing with the Proud Boys leadership, where the sentences were lower than the guidelines recommended. Now the DOJ rarely goes back and challenges a sentence that is on the low side, but defendants often go back and successfully fight unjust charges. The judge then has to justify to the appeals court why the deviated from the guidelines. If you would like to know more, here is a page that is based on the sentencing guidelines. You can just use one of the pull downs, and try selecting some answer to the questions to see how it affects the recommended sentence. www.sentencing.us/ I often make this post in response to statements like this only because I think people should know how the federal system works. This tool was in fact a result of racial discrimination in the pre-civil right era and the sentences were originally based on the average sentences of white people. Interesting, yes?
