Many thx to you, hats off! Why wouldnt all examiners do the same as you? You'd think the money was coming from their own savings accounts- but the funding is already in the VA coffers, waiting to be dispursed. For example- why or how any vet who worked 20 yrs around loud dangerous equipmt does not get tinnitus / hearig loss rating automatic? My husband got Zero % even though VA listed it as Service related... 🤯 One can only conclude the examiners are not in it to help vets. But we are now wiser to those tight fisted naysayers- and we wont give up this time.

@rickbrown8865 One rule of thumb when you get to the property for your c&p exam appointment you will be monitored whether you will be aware of it or not. You could be greeted with a good morning or good afternoon how are you doing do not say I'm doing fine. Say I'm in a lot of pain and I'd rather not be here but it's what it is. Hopefully you will do well in your exam. Stay calm and be yourself.

My husband of 36 years has at least 3 issues now that I know comes from his military service in Germany and being out in the field for 30-60 days at a time, but was denied. I knew him before the service and after so it’s clear to me. He definitely struggles from PTSD, hearing loss and back issues. He was oversees and worked in the aide station and was always seeing issues and caring for others , but never had any of his issues documented, but just lived with them. He really should be compensated. Many of his military friends he cared for are now compensated and have been for years because of the care he gave them during sick calls. They all pretty much suffer from the same issues however his issues were never documented. His initial claim at a Baltimore, Maryland facility was denied, however I’m glad I came across your channel and will be taking much of your advice. He took care of so many, it’s time he be compensated for his issues.

I bought copies of my records and even had my Dr fax some records to my C&P exam, i was ready for 4 things IBS,Gerd, sleep apena & migraines. My C&P gave me 100% P&T. I only served 6 months in basic training and got a honorable discharge. I still have more claims, but she said she was giving me 100% , so i wait 6 to 8 weeks for the letter! Im glad i went, she was the best, but i was so ready, there was no reason not to! Thanks KDM89! only took 2yrs!

IU can be tricky, I've seen cases as a former rater where vets went in the opposite direction trying to get IU and not knowing what to do. Greetings Dwayne!! I was rated at 90% until October 8th, 2024 at which time I was increased to 100% due to prostate cancer. I am a Vietnam vet who served at all of the bases listed for AO. I actually sent a copy of my travel orders to those areas when I submitted my claim. My Oncologist laughed when I told him that I wasn’t given a permanent rating. I explained that even though he cannot say when the cancer will come back, the VA feels I’m recovered after 6 months. I have dribbling problems from both ends and have to use a pad and change it 4 or 5 times a day. Am I going to loose my rating in April when I have to have my appointment? Also had State II Melanoma while on active duty but am not given any rating for it. Thanks regardless, your videos are very informative and I appreciate you expertise so much. After six months you will have an RFE, make sure you understand the diagnostic code for prostate condition, if you wear absorbent material and day time and night time voiding. Make sure you have your doctor to write a letter letting the VA know what your residuals are. I just received 100% P&T last week. They also noted one condition was approaching 20 years but there would still be no chance of improvement. It’s been well over 20 years since I was first rated at 10% for that condition. I had to put up a fight and contact the regional office to get my C&P exam. Thanks for the timely video. I am a Vietnam Vet who recently went from 10 percent to 100 percent P&T for chronic heart failure that I proved I had by insisting that my cardiologist do a cardiac catherization. Test don’t lie. Hey Dewayne i am 100p&t despite rejection of several important claims and unclaimed stuff namely TBI without even filing for it. On the internets “They said” don’t file anything else now, but i feel its important to get these SC and also get TBI sussed out with my already rated psych. If you got 80% P/T I don't see the point of going for 100% its the same money. You may open up all of of other claims if you go back in and deal with these idiots at the VA. If you are getting all the 100% P/T benefits like ChampVA for dependents/ Education Benefits for dependents I wouldn't do nothing. There is no such thing a grandfather in. ALL P/T still have the 20 year rule.

Dewayne how do you dispute the amount your attorney gets (he dropped my 2 yrs prior to me getting 100% P&T) from your back pay if you know it's too much because he didn't do the work to deserve it?? I know you know!

Your lawyer not doing the work and dropping you are two separate things. If you have a copy of your VA claims file, you can see the letter from your lawyer to the VA stating they are removing themselves from your file and they forgo future earning (20 percent). If you don't see that, they didn't forgo their fees, which is only 20 percent. The only reference to 'permanent and total' in my letter is in the paragraph listing basic eligibility to dependents' educational assistance. BUT, everything on the line items list 'static' ... kind of requires some careful reading.

Asking for thoughts on my situation. I was service connected for heart failure in Dec of last year, however I was never given an exam that is used to determine the level of disability. I filed an HLR and they admitted a DTA error and sent me for a new C&P exam they admitted I had never had for a METs rating (stress test for my heart). I scored a 0-3 which is 100% however in the decision narrative it said I scored a 3.1-5 which left me at the same 60% rating. I scheduled a VERA appointment to show them the mistake and met with them. The regional rep and his supervisor both looked at it and said this was obviously a mistake and filed a supplemental claim and sited them not following the guidelines for the CFR 41.01 as a CUE error. Ive read CUE errors are difficult to prove and now I am worried if this was the correct thing to do?.. any insight or help please.

@Dewayne - Two questions: (1) My ratings code sheet says all of my disabilities are static. I'm not 100% yet, but when I do get it, will I be P&T? and (2) Some of my ratings that are labeled static I barely just got rated for, so is that considered permanent even though it hasn't been 5 years for them? @@AllDefiAreRugs all 100% P/T get CHAPTER 35 benefits and it will say that on your paperwork. It includes education benefits for your dependents and ChampVA health benefits for dependents. This two things will let you know if you are P/T.

I have a 100% scheduler rating and all of my ratings are static, plus I am 75 yo. I had a cancer rating that was reduced which caused the VA to remove my Housebound SMC effective in the near future. I have not been granted P&T yet, but my VSO says my claim is actually still open and once the SMC is removed they will reevaluate my rating and should grant me P&T at that time. I trust he is correct, but I would like your opinion on this situation. Thank you for what you do.

While in the hospital 10 days after returning home from Vietnam I had a relapse of Malaria. While in the local VA hospital (1 month stay) someone from the government ask if I wanted not the regular 30% disability for Malaria but rather 60% for one year but after that time I could no longer claim I have any Malaria issues so I signed his form to get the 60% for a year, question, does the VA do that anymore?? I made the 100% without the 30% malaria included and no one outside military benefit programs can answer my question, can they do that legally?

You mentioned in slide 2 that at age 55 they can't do an RFE unless special circumstances. I slide 3 a total evaluation on the basis of IU but they could do an RFE but can they do it even if the veteran is over age 55?

Great information, I am 100% from Agent Orange. I am 50 % from PTSD. I am 100%% from Apnea. Total now 250%. I have 4 deferred heart problems from chemo and needed open heart surgery. I have A Fib , stenosis aortic and 2 other Herat claims. I expect to reach 450%. They want to re evaluate me in 2 years for the Cancer ,non Hoskins lymphoma. I am 78 years old. Do you think they will reduce me below 100%? Thank you..

Dewayne, VR&E for becoming a physician via Biomedical Engineering. 100% PNT many years ago. I mean it has been a long haul but however what has happened to facilitate the forward movement is due to applications and certain life happenings. Would not fall under the current healthcare system because the delivery is not regulated and would never be regulated because it is individualistic. However the path could be used in improvements to medical care for years to come. I am getting ready to challenge them.

No GI Bill because they denied my VEAP conversion to the Montgomery GI Bill. The laws had not been legislated just yet but in the same year and technically I was still attached to active duty on TDRL.

Dewayne, as always good vid and excellanr info. Just to let all know living overseas and at 100 P&T, we don’t get any medical travel reimbursement, nor for C&P exams, nor property tax waiver, and there are no VA medical hospitals. I go to the military base for my medical since I’m retired. Oh, and no dental benifits here. Seems like you must live in the US or it’s territories to actually see the benefits of being 100% P&T. Really upset with the VA for not reimbursing medical travel expenses.,(gas). Between med appts,C&P exams and hospital visits I probably drive 700kms a month for the last 1 year or 8,400kms.

That means you have an RFE as explained in the video. You don't have to wait until the RFE comes around to ask for an exam, you can simply ask for an increase in that condition but make sure you know the diagnostic code criteria. I am at 80% been trying to get unemployability 100% just had back surgery still need more procedures done also got numerous other things wrong haven't worked for 17 years last 5 years bed ridden 6 to 8 months a year now surgery relieved a lil not completely bed ridden but was denied on a grade 4 and a grade 3 knees bone on bone also had had triple bypass and type 2 diabetes have cck layers on my case but keep getting denied oh yeah forgot got tinnitus but was told don't put in for it that it won't help rating since I have 130% all together but v.a only gives 80%

Sir I would like to draw your attention to what appear to be that of in error where you reference 100% rating and 100 rating P&T in regards to future exams 38 CFR 3.327, 38 CFR 3.344. Sir having a rating at 100% or 100 P&T BOTH ARE STILL SUBJECT TWO REEXAMINATION....period. At the discretion of the VA. So, rather it's a 5, 10, or 20 year timeline. The VA can re-examine you at any given time at their discretion.....period. Why because 38 CFR 3.327 GIVES THEM THAT AUTHORITY IN THE FIRST PARAGRAPH.....(a) " General. Rexaminations, including periods of hospital observation, will be requested WHENEVER THE VA DETERMINE, THERE IS A NEED TO VERIFY EITHER THE CONTINUED EXISTENCE OR THE CURRENT SEVERITY OF A DISABILITY GENERALLY, reexaminations will be required if it is likely that a disability has improved, or if evidence indicate there has been a material change in a disability or that the current rating may be incorrect. Individuals for whom re examinations have been authorized. It's scheduled are required to report for such reexaminations. Paragraphs, b and c of this section provides general guidelines for requesting reexaminations, but shall not be construed as LIMITING. V A's authority to request reexamination or periods of hospital observation, AT ANY TIME in order to ensure that a disability is accurately rated."... SO SIR IT IS CLEAR A VETERAN WITH 5 YEARS 10 YEARS 20 YEARS, 100 % RATED OR P & T 100% a VETERAN CAN BE EXAMINED AT ANY GIVEN TIME AT THE V A'S DISCRETION. Why I know this to be so because I am a 100% P & T for now, over 28 years, I was re-exam at the request of the VA in June of 2024. I had to report to a C& P exam AND I WAS NOT HOSPITALIZED.....

There is a lot to un pack here. Coming from someone that rated. I never went back through a veterans claim that was 100 P & T, unless they came in for an increase or new claim. Even then, I didn't go back and look at everything they previously claimed nor all the evidence they submitted. Every claim is different, just because one veteran went through something does not mean all veterans do.

There are benefits one can not get unless he or she is 100% P and T, so it's not a matter of veterans losing 1000s of dollars. Unless the veteran is 100% P and T, he or she doesn't have access to additional benefits through no fault of his or her own.

It took me 13 years to get my disability. They fought me at every turn. I appealed it and after it went in front of the board did I finally get it. It's amazing how the VA will not assist veterans and will oppose us any way they can. The good thing about it taking that long was that they back paid me every day of it. That was the day I laughed at them. 365,000 dollars and I did have the last laugh.
