Hill and Ponton do a much better job explaining this. The widow does not receive the same amount that the veteran had been receiving in disability compensation. The widow will receive DIC (Dependents and Indemnity Compensation) payment which is significantly lower. For example, the 2023 rate for 100% veteran with a spouse is a monthly disability payment of $3823. The projected DIC payment for 2023 is only about $1563, that's less than half of what the veteran was receiving when he/she was alive.

For service-connected deaths that occurred on or after January 1, 1993, DIC payments to all surviving spouses start at a monthly base amount set by statute, and increase in accordance with the same annual cost-of-living adjustments (COLAs) awarded to Social Security beneficiaries. Since December 1, 2020, this monthly amount has been $1,357.56.

As of 01/01/24 there is a Bill working it's way through the US Senate that will reduce to 5 years the couple must have been married before the surviving Spouse can apply. Also the monthly amount to the spouse will be increased considerably. It's called the "Caring for Survivors act of 2023".

If your husband is 100%, it really depends on whether it's only Service Connected. If however, he's "War-Time" veteran, and is getting that 100%, due to war, AND he does from that injury, then you are definitely entitled to around $1,300/month, or whatever the rate is at the time of death, for "Survivor's" Benefits. Plus, as a "War-Time" Survivor, you'll qualify for a lot of other benefits, like Home care, loans, nursing home. Do your research, seek answers from various agencies, not just one place. Good Luck. I’m right with you I’m scared. We are in our sixties he is very sick. What are the steps I need to do I’m trying to get all the papers together from all his divorces as we speak. I’m trying to get all other’s papers together that we are needing to help speed anything along that I can I’m hearing it taken take up to a year to get benefits from the VA for spousal support. I can’t survive without anything plus if something happens to him praise God he’s alive now it’s gonna take a while to get Social Security and even that it’s only a fraction, I gave up working over 10 years ago because of his heart and his emotional issues. I’m praying I don’t lose my home and my car hoping I can pay electric bills I know I’m not gonna be able to have home insurance because in Texas that’s six $8000 for my little home plus my pets and myself I have to have insurance and I have to be able to take care of my pets I don’t want to lose them so that’s veterans spouses are in a pickle I was talking to the VA regional office trying to get ahead of it to be ready and they told me they won’t even talk to me or him regarding any situation until he is gone. That is crazy.

You stated as a surviving spouse you get a 100% of the veterans pension. I lost my spouse in Feb. he is the veteran. I receive DIC but it is not a 100% of what my husband is receiving. I receive the standard allotment plus an additional amount because he was a 100% disable due to Agent Orange 8 years before he passed. A little confusing compared to your statement.

Hi Susan, I take it your Beloved Veteran is Vietnam War era. Survivors only get a portion, better than nothing, I guess. However, the good news for you is, as a War-Time veteran surviving spouse, you get more benefits than those who's veteran didn't go to war, and retired. You qualify for Home care, Nursing home, if needed, and VA takes care of it. You keep your access to commissary, Exchange, etc. You can use the home loan. Happy New Year.

p.s. Go to your County VA, or any local VA, sit with them and go over all your qualifications. Also, if you need someone, like a family member to care for you, as a War-Time survivor, the VA pays for that person, maybe $300/month. Your house can be adapted to your needs, should you need Handicap assistance. So much benefits, as a War-Time survivor.

Check out the "Caring for Survivors Act" that is currently working it's way through committee in the US Senate. 5 years instead of 10 and a large increase in the amount. Even the existing benefit to the surviving Spouse is NOT predicated on the Veteran having died from the disability he/she is rated for.

I have been fighting the VA for 4 yrs for benefits. My late husband committed suicide . He was in the navy for 4 yts on the USS Bryce Cannon which was full of Asbestos. He had a spot on his lung which showed up at time of discharge. His health deterated. With that said, i got a denial in thr mail yesterday now to get all previous marriage information. My husband was 100 percent disabled and he was honorably discharged for the army on a medical discharge! When he passed in 2020 if I remember correctly we were bringing home over 3000.00 dollars I did not get his total disability income of what he was making at the time, I also get DIC , plus I get his SS benefit (a portion) I don’t understand why I feel I did not get what I was intidaled to, it’s confusing and I did question it but I was told the women who helped me no longer worked there she was let go and now it’s too late there is nothing I can do! A statement was made during this presentation that a veteran with 100% disability who is deceased a surviving spouse would receive 100% of DIC. I recently was notified that I will be getting a lesser amount of approx. 50% of my husbands monthly VA disability benefit starting 11-1-2022. Is this percentage correct? I an eligible as is evident that I am receiving a DIC. Another question, with the COLA increase in 01-01 2023 will my DIC increase based on the COLA increase? Look forward to your responses.

I'm guessing you're a "War Time" Veteran, Thank you for your service, sir. I've helped many veteran, surviving dependents and various levels of percentages. War Time Veterans and their surviving spouse gets great benefits, including home aid for spouse, if needed. Life Insurance is automatically 10k, and can get additional amounts with deductions. In the even you pass before your wife, she will receive Survivor's compensation of approximately $1,300 per month. Your wife can get help from your local VA Benefits Office, or County VA office. It would be best for both, you and your wife to seek help now, get all documents needed in the future. Good Luck.

Dear VA Guy, can you help me understand why I cannot get DIC. I have tried approximately four times since 2011 when my husband passed away from Parkinson’s disease. He was receiving a small pension like $1500 or something in that order and when he passed I got nothing and it just stopped. He was in World War II/Korea, but never saw any battle in Korea. He had two honorable discharges and had other problems from being in the military like flat feet loss of hearing post traumatic stress, and I think that’s it. I don’t understand why other wives of soldiers are just automatically given this benefit whereas I can’t seem to get anywhere. I have tried and tried, my husband was a Marine and felt the battles in the South Pacific just charged and then called back during Korea. My husband was 19 years older than me if it seems odd that I am writing to you we were married 26 years very happily. Can you give me any idea what to do where to go because I am at a dead end. He died from Parkinson’s, and was not entitled to anything even though he lived in Camp Lajeune and was discharged there in 52 and the date does not come up to their standards. Seems odd because his first wife and him and a small child all lived in Camp Legeune, but I’m not sure for how long and his wife passed from cancer and my husband passed from Parkinson’s. We understand that your husband served in Korea and he passed in 2011. When did you apply for DIC? Service connection is warranted where the evidence of record establishes that a particular injury or disease resulting in disability was incurred in the line of duty in the active military service. Service connection may also be granted for any disease diagnosed after the military discharge, when all the evidence, including that pertinent to the period of military service, establishes that the disease was incurred during the active military service. VA regulations provide a presumption of herbicide exposure where a veteran served in the Republic of Korea on the demilitarized zone during certain time periods. Specifically, a veteran who, during active service, served between April 1, 1968, and August 31, 1971, in a unit that, as determined by the Department of Defense, operated in or near the Korean demilitarized zone in an area in which herbicides are known to have been applied during that period, shall be presumed to have been exposed during such service to an herbicide agent, unless there is affirmative evidence to establish that the Veteran was not exposed to any such agent during that service. Did your husband serve during these dates? Parkinson’s disease is known to be caused by exposure to herbicide exposure. However, outside of those dates and locations, the presumptive provisions do not apply, and exposure must be determined on a case-by-case basis. Once it is established that a veteran was in fact exposed to a qualifying herbicide, VA will presume that a disease listed under 38 C.F.R. § 3.309 (e) is due to the exposure to herbicides.

You can try to reopen his claim. Unfortunately, many wives like yourself weren't aware of a form needed to be submitted, up to a year after his death. You can gather all his claim documents, along with your marriage and his death certificate, bring it to a local VA office, and request to reopen his claim. Don't take one answer, should you be turned away. Keep trying. Go to the VA's website, look for more information on continuing his claim, After death.

@@cindybraddy7372 if your husband passed away under a year, there's a form for you to continue his claim for Retroactive, from the time he appealed to today. He automatically gets $10k life insurance for 100%, be sure to push for it too. As his WAR TIME survivor, you're entitled to much more than just the monthly pay. You can get ChampVa medical, as secondary, free meds directly from them too. If you, yourself need home care in the future, as survivor of WAR TIME Veteran, you get that too. Do your research, get all the benefits you qualify for. Don't sell yourself short.

We had been married from 1990 until 2007 when his VA representative advised us to get a divorce due to me working. We remarried in July of 2011, and he passed away in November of 2011. We never lived apart at any point of our relationship and remained in the same household from 1990 til 2011. Since we weren't married for a year, they denied me his benefits. Is there anything I can do about this. We were living in Illinois when he passed away, and I now live in Tennessee.

Getting a divorce is the worst advise I have ever seen a VA rep give! That is a tough one becuase you can't get a divorce in most states if you still live together, so the VA is going to ask why you got a divorce and you will say becuase the VA rep to me to in order for my husband to get benefits. I would make the argument that the divorce really never took place becuase you never lived apart.

Depending on the amount you can get the larger of the DIC or Pension. Pension is a needs based program so be ware. The monthly benefit is approximately $1400

Rules allow eligibility in certain cases for surviving spouses who remarried or were involved in a marital-type relationship after the veteran died. Surviving spouses who remarry are ineligible for all VA benefits (including death pension) unless they are mentioned in these rules. They are complex and I don't have enough information to answer your question.

Excellent information! Question to see if I am correct. I am 75 and have been married to my current since 1982. I receive 100% permanent/total. In January my benefit is around $3800 dollars. If I am married when the Lord takes me home my wife would receive this amount.

That is about average. What unreimbursed medical expenses does you mother have? These will reduce her income for VA purposes but increase her Pension amount.

Keep pushing until he gets 100%, then you will get benefits as a surviving spouse/dependent. The magic word for even more benefits for Veterans and dependents are "War Time" Veterans. Do your research, it'll help you both in the long run. Good Luck. Thank your husband for his service.

My mother is being told currently that she may not receive anybof my fathers benefits who just passed away this month. Im not sure this is possible considering the VA website states ahe should. He is vietnam war time and was 50% disabled. He was in the process of doing anothwr claim to get his 100% they say we can't complete now because he's deceased. This claim included ptsd meanwhile they say he was never diagnosed with it but VA hospital was giving him meds for it in and out of the hospital. The medicine actually states for ptsd. I think were just going to get an attornwy. Myboarents waited until my father was in his 70's to even file a claim because they were never aware. They were also never aware they could get a VA loan. To think of all of thw struggling they went through to now be denied in death makes me sick.

@davidsonlawoffices He just passed on the 9th of this month. I'm having to move her in with me as bow she will be suffering financially to pay for their home. My father depended on them paying that to her as it was what the VA hospital social worker informed him of. The man refused to even file for her put right said she wouldn't qualify so now I'm attempting to do so.
