H1-B starting company and sponsorship of his/her own H1-B has more depth to it such as the worker should be sponsored by a legal entity and the job should be bonafide position and 51% of the time should be spent on speciality occupation work duties. The owner of the company should have legal presence in the US so that if there is any legal issue the company/owner can be sued.
